Request for a Minor Variance of Rear Yard Setback

1 am requesting a variance for my rear yard setback to be reduced from 18.5 feet to 12.5 feet for an
existing patio cover. I was unaware that my patio cover needed a building permit as I was replacing my
existing patio, patio cover and making other improvements. I was not aware that attaching it required a
permit, because the cover I tore down was attached. So, when I was informed that the patio cover
needed a permit, I applied for one, but was told that it intruded into the required rear yard setback. The
Ordinance is not completely clear on what the required side and rear yard set OOcks are, but accepting
the Planning Dept. 's interpretation, I hereby request a minor variance for my existing patio cover to
reduce the setback to 12.5'. I believe my request for a variance is reasonable as it is only a request to
modify the otherwise required set back by ~30% and should be approved for the following reasons:
1. My lot has unique characteristics as com~red to other lots in my immediate block;
a. Shape and Size: Due to my lot being on a corner and being fairly square in shape, it has
a wider lot width than others. The width ofmy lot measured at the front setback line is
94 feet, compared to 60 -70 feet for most of the lots in my block (see attached exhibit).
Thus for most of my neighbors, their required side yard setbacks are 6 -7 feet, and their
rear yard setbacks therefor 12 -14 feet. Because my lot is so wide, my side yard
setback is 9 feet, and my rear yard setback is 18 feet. To make matters worse, since my
lot is wide and shallow, I have less rear yard to work with anyway, even before the
larger setback requirement. To further compound the situation, it's worse than square,
because the rear width is 15 feet less than the front width, pinching the available
backyard area for usable enjoyment.
b. Topography: Azahar Place is a fairly steep street. This means there are significant side
slopes on the lots which reduce the flat usable area. This effect is exacerbated on my lot
because it's a corner lot. On most lots, since side property lines are at the tops of
slopes, they only have one side slope to contend with. I have two side slopes, which
serves to further reduce the usable area of my lot. The steepness of the street has an
additional impact, because my house is set back further than the 20' standard driveway
to take up the grade differences. My garage is setback 28 feet from the front property
line, more than the required 20 feet. This pushes the house back further on ar, already
shallow lot, reducing the usable area in the back yard.
2. There is no adverse impact to my neighbors. Since I'm a corner lot, I only have two neighbors.
The lot on Azahar Court that is adjacent to my rear property corner is 175 feet deep. The house
is set back from my property due to the wedge geometry of the lot, and the house is more than
50 feet away from the patio cover. lri fact, if the contractor had not decided to connect my
patio cover to the house, it would be a simple free-standing patio, and would be allowed within
5 feet of my rear property line, no variance required. The patio cover is even further away from
my side yard neighbor, so will have absolutely no impact on them.
3. Granting me a variance to allow my patio cover to remain does not grant me any special
privileges not available to other homes in my neighborhood. As noted above, due to special
circumstances related to my lot, the variance is awropriate so I have the same opportunities
and privileges as other homes in the area to er,joy my backyard and the improvements I made
to my home.
