Recommended Action
Adopt a resolution authorizing execution and submittal of a Proof of Designation Form 184
letter to the California Department of Resources Recycling and Recovery to designate Allied
Waste Systems, Inc., dba Republic Services of San Diego, or its subcontractor, E Recycling of CA
–SFS, as an approved collector of electronic waste for the City of Carlsbad.
Executive Summary
State law requires local jurisdictions such as the City of Carlsbad to have programs to capture
household hazardous waste to prevent them from being disposed in landfills, including e-waste.
(California Code of Regulations, Title 14, Division 7, Chapter 9, Article 6.3.) If a private waste
hauler provides e-waste services on a city’s behalf, the city must submit a proof of designation
form to CalRecycle that describes and authorizes the waste hauler’s activities.
Staff are requesting that the City Council authorize an update of the form for the city’s waste
hauler, Allied Waste Systems, Inc., dba Republic Services of San Diego, designating its
subcontractor as the approved collectors of electronic waste for the City of Carlsbad.
Republic Services hired a subcontractor, E Recycling of CA – SFS, to collect and properly dispose
of and recycle e-waste. E Recycling recently moved locations and was required to obtain a new
identification number for the state’s e-waste recycling program.
The designation form needs to be updated with the subcontractor and its new information, and
this update requires the City Council’s approval.
Staff are also asking for the City Council to delegate authority to the City Manager for any
subsequent proof of designation forms, for the sake of efficiency, during the term of the
franchise agreement with Republic Services.

Explanation & Analysis
Republic Services began providing waste collection services in Carlsbad in 2022, and, under the
terms of its franchise agreement with the city, it is the city’s designated e-waste collector, with
the responsibility to provide on-call e-waste collection services to all Carlsbad residents.
Republic Services’ subcontractor, E Recycling of CA – SFS, collects e-waste in the city for proper
disposal and recycling. E-Recycling is an approved e-waste collector and is properly registered
with California’s Department of Resources Recycling and Recovery, known as CalRecycle.
This updated proof of designation form will include E-Recycling’s new address and identification
number and will be submitted to CalRecycle for approval.
Fiscal Analysis
This item has no fiscal impact.
Next Steps
Staff will submit the authorized form to CalRecycle. Republic Services and E Recycling of
CA – SFS will continue with the collection of e-waste in Carlsbad.
Environmental Evaluation
The proposed action does not qualify as a project under the California Environmental Quality
Act under Guidelines Section 15378. It does not result in a direct or any reasonably foreseeable
indirect physical change in the environment.

CALIFORNIA, AUTHORIZING EXECUTION AND SUBMITTAL OF A PROOF OF

WHEREAS, California Code of Regulations, or CCR, Title 14, Division 7, Chapter 9, Article 6.3
requires every local jurisdiction to have programs to capture household hazardous waste to prevent
disposal to the landfills, including electronic waste, or e-waste; and
WHEREAS, the City of Carlsbad does not have city-operated drop-off or collection facilities for
e-waste, and designating Allied Waste Systems, Inc., dba Republic Services of San Diego, or Republic,
as an e-waste collector within the city will allow city residents continued e-waste curbside and drop-
off services at the Palomar Transfer Station; and
WHEREAS, if a private waste hauler provides e-waste services on behalf of a local government,
the local government must submit a Proof of Designation, or POD, Form 184, letter to the California
Department of Resources Recycling and Recovery, or CalRecycle, describing and authorizing the
hauler's activities; and
WHEREAS, under California Code of Regulations, Title 14, Section 18660.49(b)(S), the POD must
be signed by "a representative of the Local Government that is duly authorized and empowered to
execute agreements or contracts related to waste management on behalf of the Local Government;"
and
WHEREAS, the City Council approves solid waste hauling franchises under the City Charter
section 402; and
WHEREAS, on April 6, 2021, the City Council adopted Resolution No. 2021-075, approving the
current franchise hauling agreement with Republic; and
WHEREAS, the franchise hauling agreement, which became effective on July 1, 2022, requires
Republic to provide e-waste collection and proper disposal services within the City of Carlsbad, or
Franchise Agreement; and
WHEREAS, Republic subcontracts with E Recycling of CA-SFS to provide e-waste services within
the City of Carlsbad; and
