Recommended Action
Introduce an ordinance titled, “An Ordinance of the City Council of the City of Carlsbad,
California Amending Title 2, Chapter 2.04, Section 2.04.040(C)(1) of the Carlsbad Municipal
Code relating to eligibility for the office of City Treasurer.”
Executive Summary/Explanation & Analysis
The City Treasurer’s Office is charged with designing an effective cash management and
investment program for the city and all its subsidiary entities. The City Treasurer’s duties
include developing the city’s Investment Policy for City Council approval, arranging for banking
services, forecasting all cash receipts and expenditures, investing all inactive cash and reporting
all investment activities.
Prior to January 2024, eligibility to hold office as City Treasurer required, among other
qualifications, a four-year college degree in finance or a business-related field. The City Council
updated this criterion and, as of Jan. 11, 2024, the four-year college degree must be in one of
the following majors: business administration, public administration, accounting, finance or
economics.
Members of the public subsequently raised concerns about education eligibility criteria
excluding a person with equivalent or better higher-level education. In response to these
concerns, on July 16, 2024, the City Council adopted a motion directing city staff to return to
the City Council in the fall with additional clarifying language to the City Treasurer eligibility
section of the Carlsbad Municipal Code.
The ordinance in Exhibit 1 amends Section 2.04.040(C)(1) to substitute a “four-year college”
degree with a “bachelor’s, master’s or doctoral” degree. The areas of study remain the same.

Fiscal Analysis
The existing fiscal year 2024-2025 budget for the City Clerk’s Office includes sufficient funding
for the cost of amending the referenced code section.
Next Steps
The City Clerk’s Office will prepare the ordinance for adoption at the next regular City Council
meeting. Once adopted, the City Clerk will publish the ordinance or a summary of the
ordinance in a newspaper of general circulation within 15 days. The ordinance will be effective
30 days following its adoption.
Environmental Evaluation
In keeping with California Public Resources Code Section 21065, this action does not constitute
a project within the meaning of the California Environmental Quality Act in that it has no
potential to cause either a direct physical change in the environment or a reasonably
foreseeable indirect physical change in the environment.

EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the City
Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or a summary
of the ordinance prepared by the City Attorney to be published at least once in a newspaper of general
circulation in the City of Carlsbad within fifteen days after its adoption.
