Executive Summary The recommended action adopts Ordinance No. CS-478 amending Title 2, Chapter 2.04, Section 2.04.040(C)(1) of the Carlsbad Municipal Code relating to eligibility for the office of City Treasurer. Prior to January 2024, eligibility to hold office as City Treasurer required, among other qualifications, a four-year college degree in finance or a business-related field. The City Council updated this criterion and, as of Jan. 11, 2024, the four-year college degree must be in one of the following majors: business administration, public administration, accounting, finance or economics. Members of the public subsequently raised concerns about the education eligibility criteria excluding a person with equivalent or better higher-level education. In response to these concerns, on July 16, 2024, the City Council adopted a motion directing city staff to return to the City Council in the fall with additional clarifying language to the City Treasurer eligibility section of the Carlsbad Municipal Code. The proposed ordinance amends Section 2.04.040(C)(1) to substitute a “four-year college” degree with a “bachelor’s, master’s or doctoral” degree. The areas of study remain the same. Explanation & Analysis Ordinance No. CS-478 was introduced and first read at the City Council meeting held on Nov. 19, 2024. On a motion by Mayor Pro Tem Bhat-Patel, seconded by Council Member Acosta, the City Council voted 5-0 to introduce Ordinance No. CS-478. The second reading allows the City Council to adopt the ordinance. Dec. 3, 2024 Item #12 Page 1 of 4 Fiscal Analysis The existing fiscal year 2024-2025 budget for the City Clerk’s Office includes sufficient funding for the cost of amending the referenced code section. Next Steps The City Clerk Services Department will have the ordinance, or a summary of the ordinance, published in a newspaper of general circulation within 15 days following adoption of the ordinance. The ordinance will be effective 30 days after its adoption. Environmental Evaluation In keeping with California Public Resources Code Section 21065, this action does not constitute a project within the meaning of the California Environmental Quality Act in that it has no potential to cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. CS-478 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 2, CHAPTER 2.04, SECTION 2.04.040(C)(l} OF THE CARLSBAD MUNICIPAL CODE RELATING TO ELIGIBILITY FOR THE OFFICE OF CITY TREASURER WHEREAS, the City Treasurer of the City of Carlsbad is an elected office; and WHEREAS, the City Treasurer's Office is charged with designing an effective cash management and investment program for the city and all its subsidiary entities; and WHEREAS, the City Treasurer's duties include developing an Investment Policy for City Council approval, arranging for banking services, forecasting all cash receipts and expenditures, investing all inactive cash and reporting all investment activities; and WHEREAS, eligibility to hold the office of City Treasurer currently requires a candidate to have a four-year college degree majoring in business administration, public administration, accounting, finance or economics; and WHEREAS, members of the public raised concerns about the education eligibility criteria excluding a person with equivalent or better higher-level education; and WHEREAS, on July 16, 2024, the City Council adopted a motion directing city staff to return to the City Council in the fall with additional clarifying language to the City Treasurer eligibility section of the Carlsbad Municipal Code. NOW, THEREFORE, the City Council of the City of Carlsbad, California, ordains as follows that: 1. The above recitations are true and correct. 2. That the Title 2, Chapter 2.04, Section 2.04.040(C)(l} is amended to read as follows: § 2.04.040. Eligibility for office. C. To be eligible to become a candidate for the office of City Treasurer, a person must meet the ' following minimum criteria at the time nomination papers are issued: 1. The person must have a bachelor's, master's or doctoral degree majoring in business administration, public administration, accounting, finance or economics. Dec. 3, 2024 Item #12 Page 4 of 4 EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption; and the City Clerk shall certify the adoption of this ordinance and cause the full text of the ordinance or a summary of the ordinance prepared by the City Attorney to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption. INTRODUCED AND FIRST READ at a Regular Meeting of the Carlsbad City Council on the 19th day of November, 2024, and thereafter PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 3rd day of December, 2024, by the following vote, to wit: AYES: NAYS: BLACKBURN, BHAT-PATEL, ACOSTA, BURKHOLDER, LUNA.
