Executive Summary Maintaining adequate cybersecurity is crucial to protect the city from threats and cyber extortion attempts. The City Council is being asked to approve the purchase of additional cybersecurity products under its contract for Microsoft products to better protect the city’s data and operations. The city purchases its Microsoft products, which are used in all aspects of city operations, under an agreement from CDW Government LLC. The agreement covers software licensing, maintenance and support of the city's Microsoft product inventory. It was executed in 2022 with a 36-month term ending Dec. 31, 2025. The agreement allows the city to buy additional items during the term. Staff are recommending the city purchase additional cybersecurity products for the third year of the agreement. This would increase the third-year payment to $966,252.37, which includes the original annual amount of $670,888.07, annual adjustment costs of $14,701.80 and $280,662.50 for the enhanced cybersecurity products. Funding for this purchase is available in the Information Technology Department’s fiscal year 2024-25 operating budget and the Strategic Digital Transformation Investment Program. The City Council’s approval is required under Carlsbad Municipal Code Section 3.28.060 - Procurement of Professional Services and Services because the additional purchase will cost the city more than $100,000 per agreement year. Dec. 3, 2024 Item #7 Page 1 of 9 With this purchase, staff will consolidate and replace existing security tools that are no longer needed or effective. The cost savings generated by phasing out these tools will fully offset the expense of the new Microsoft security projects in future fiscal years. Explanation & Analysis Microsoft software products are used by over 1,400 city staff, volunteers and contractors and are installed on over 1,500 computers and servers, including those used by library patrons. The products include desktop, laptop and server operating systems, database systems and the cloud-based office productivity tool known as Microsoft 365. All of these products are potentially vulnerable to continually evolving cybersecurity threats and need to be made as secure as possible. The city purchases these Microsoft products under a three-year volume purchasing agreement with CDW-G. The current agreement, approved by the City Council on Dec. 13, 2022, expires on Dec. 31, 2025. The agreement allows for the ability to upgrade some product licenses to higher tiers that include additional features, a process known as a step-up. CDW-G was selected as the vendor of choice in 2022 based on their experience and capability to add value to purchases and are qualified for bidding under the Microsoft Enterprise Agreement. The purchase of cybersecurity products under this agreement from CDW-G represents the best value to the city by purchasing through a cooperative purchasing agreement, in compliance with Carlsbad Municipal Code, Chapter 3.28.100 - Cooperative Purchasing. CDW-G is an authorized Enterprise Agreement reseller and provides products and technology services under the County of Riverside’s Cooperative Purchasing Enterprise Agreement No. 8084445 (PSA - 0001522). The current agreement allows the city to add new products within the scope of the agreement without additional bidding, contract amendments or new agreements. Making this additional purchase under the current Microsoft agreement with CDW-G leverages the pricing levels already agreed upon in the existing agreement. Staff recommend the city purchase additional features to protect against the ongoing risk of a cyberattack to digital systems, which would significantly impact city operations if taken offline. These features will improve threat detection, protect sensitive data and defend against phishing and malware to keep city systems secure and operational. Fiscal Analysis Cost of cybersecurity purchase With this additional step-up purchase cost of $280,662.50, as well as for increased use of Microsoft products beyond what is included the original agreement added during the year, known as the true-up costs, the new third-year cost of the Microsoft EA with CDW-G is not to exceed $966,252.37. Funding for the revised third year is in the fiscal year 2024-25 Information Technology Department’s Operating Budget and the Strategic Digital Transformation Investment Program. Due to the addition of the Microsoft cybersecurity products, the Strategic Digital Transformation Investment Program – Cyber Security Program Development Project budget will be used as a one-time disbursement in fiscal year 2024-25. The IT Operating Budget already included the annual costs for the third year of the agreement. Dec. 3, 2024 Item #7 Page 2 of 9 As noted above, as the IT Department will phase out current but no longer needed security products in fiscal year 2024-25 and fiscal year 2025-26 the budgets allocated to these products will be reallocated to cover the increased expenses of a new Microsoft enterprise agreement that will begin in January 2026. Total Microsoft enterprise agreement costs The total adjusted not-to-exceed amount for the three years of the 2022 Microsoft enterprise agreement is $2,321,015.51, which includes the original cost, the true-up costs and the cost of the recommended cybersecurity products to be purchased. Environmental Evaluation This action does not require environmental review because it does not constitute a project within the meaning of the California Environmental Quality Act under California Public Resources Code Section 21065 in that it has no potential to cause either a direct physical change or a reasonably foreseeable indirect physical change in the environment.
