Recommended Action
Discuss and determine proposed state and federal budget priorities and state legislative proposals
to recommend to the City Council.
Discussion
This item will provide an opportunity to discuss Subcommittee recommendations and to provide
feedback to staff to prepare for future City Council consideration of these topics.
Budget Priorities
Staff is requesting Subcommittee input and feedback to help staff further develop potential 2025
state and federal budget requests. Project types that may be well-suited to receiving state and/or
federal support in the coming year include those that address homelessness, mobility, public
safety, climate protection/adaptation, and recreation.
Based upon preliminary discussions with city staff, and consistent with the priorities laid out in the
city’s Strategic Plan, the following projects (listed in order of City Council District and anticipated
year of expenditure) have been identified as potentially competitive opportunities to receive state
and/or federal funding in the coming year:
1.Village Decorative Lighting Projects

2.Barrio Street Lighting

3.ADA Beach Access Improvements – Pine Ave. to Tamarack Ave.

5.Electric Vehicle Charging Stations – Monroe Street Pool and Veterans Memorial Park

6.Kelley Dr. and Park Dr. Complete Street Improvements

7.La Posada de Guadalupe Homeless Shelter Expansion

Legislative Proposals
Staff is also requesting Subcommittee input and feedback to help develop potential 2025 legislative
proposals for the city to sponsor, if any. The following potential bill sponsorship ideas have been
identified by staff and support policy priorities identified in the Strategic Plan:
1. A proposal to authorize electronic filing and virtual appearance for workplace violence
restraining orders and workplace harassment restraining orders.
2. A proposal to expand the peace officer exception in California Vehicle Code Section
38025 to allow public safety officials to drive off-highway Utility-Terrain Vehicles (UTVs)
on city streets.
3. A proposal to disallow short-term vacation rental use of affordable and market-rate
ADU’s and units in projects receiving development standard waivers, concessions or
density bonus.
4. A proposal to amend the Government Code to clarify density bonus law regarding the
replacement of existing affordable housing and the application of local inclusionary
housing requirements.
5. A tort reform proposal to limit damages to be paid by cities except in cases of gross
negligence.
6. A proposal to clarify and streamline the process for obtaining a long-term
lease/operating agreement to allow a city to assume the cost and responsibility for
maintenance and operation of State Parks lands within its jurisdiction.

7. A proposal to enable a change in state funding sources from the Joe Serna. Jr.
Farmworker Housing Grant Program to a source that would allow La Posada Homeless
Shelter beds to be used by homeless individuals, rather than being limited to
farmworkers only.
8. A proposal to require occupants of permanent supportive housing units funded by
Behavioral Health Services Act or Mental Health Services Act programs to agree to
receive case management services.
At the Oct. 8, 2024, meeting of the Legislative Subcommittee, Councilmember Burkholder suggested
consideration of the following potential bill ideas:
1. A proposal to protect access to essential services (i.e., grocery, pharmacy, housing) for
senior residents.
2. A proposal to credit Metropolitan Planning Organizations for emissions reductions
associated with regional electric vehicle adoption.
Staff also identified the following potential bill ideas, which are recommended for referral to various
partner agencies and industry associations for consideration:
1. A proposal to modify the Public Records Act to disallow use as a marketing tool, or to deter
serial lawsuits.
- Staff recommends referral to the California State Association of Counties (CSAC)
Public Records Act Working Group and City Clerks Association of California (CCAC).
2. A proposal to clarify standards to allow records management systems to qualify as a “trusted
system”.
- Staff recommends referral to the City Clerks Association of California (CCAC).
3. A proposal to amend the Government Code to allow for the posting of legal advertising and
public noticing via electronic and digital media, rather than in newspapers, or to cap
advertising costs for public notices.
- Staff recommends referral to the City Clerks Association of California (CCAC).
4. Clean fleet exemption for non-safety emergency responder vehicles.
- Staff recommends referral to the American Public Works Association (APWA) or
the National Association of Fleet Administrators (NAFA).
5. A proposal to limit the Coastal Commission’s jurisdiction relative to housing development in
the Coastal Zone.
- Staff recommends referral to the League of California Cities (CalCities) Coastal
Cities Group.
Next Steps
Subcommittee recommendations regarding bill sponsorship proposals, referrals, and state and
federal budget priorities will be presented for City Council’s consideration and direction to staff on
January 14, 2025.
