The provisions of UBC, Section 106.4.4 as amended by the Carlsbad Municipal Code state: "EXPIRATION. I am cerwn that our bud wa wm payoff'by creating more informed - August 17, 1999 TO: MIKE PETERSON, BUILDING DEPARTMENT FROM; Mike Smith, Fire Department WHITTET BUILDING PERMIT APPLICATION I have attached Mr. Pete Whittet's construction plans depicting a rear yard deck at 1517 Turquoise Drive, Lot 175 of the Marbrisa Development. When they are compared to the Marbrisa landscape plan, it is apparent that the proposed balcony encroaches into the fire protection zone significantly. The Marbrisa landscape plan provides a 60' zone of defensible space between undisturbed hazardous vegetation and all the homes located on Mr. Whittet's street. Mr. Whittet's proposal would reduce the defensible space between his home and the undisturbed hazardous vegetation by 13 to 16%. Furthermore, large horizontal projections, such as the one proposed, create an additional risk to the home, since they tend to trap convective heat from emerging brush fires, and direct it into the structure through adjacent glazed openings. Mr. Whittet stated he thought that the concept had been approved in the past, and that the builder had constructed similar improvements for new home buyers as an upgrade. I explained that the Fire Department did approve the concept of a small balcony projection from the second floor of certain units when the materials used were protected by 7/8 inch stucco for fire resistance purposes, and the encroachment was not significant ( one foot or less). Mr. Whittet' s proposal is clearly an expansion of that concept. After reviewing the plans once more, I explained to the applicant that a five foot projection, similar to what the builder is providing, would not present a significant risk to Mr. Whittet's home, since it will result in only a one foot encroachment into the defensible space, thus conforming to the balcony concept described above. I also explained that the balcony could extend the length of the structure. He stated he would amend the plans to conform to what was previously approved.
