Existing Conditions & Project Description Existing Setting The subject site consists of a 26.65-acre (1,160,874- square-foot) lot, located at 5600-5630 Paseo del Norte. The lot is developed with an existing shopping center constructed in 1998. The topography of the site is flat. The subject site is bordered to the north by auto dealerships, to the south by the Carlsbad by the Sea Hotel, to the east by agriculture, and to the west by commercial uses. No public beach access or coastal resources are identified onsite. Site Map Dec. 4, 2024 Item #2 1 of 33 PLANNING COMMISSION Staff Report . The request proposes to amend the original pushcart program entitlements, SDP 96-03(A) and CDP 00-20, to implement the new pushcart/kiosk program. • There will be a total of seventeen (17) pushcarts of two different sizes. o Cart A, one (1) existing 5 feet by 5 feet cart proposed to be retroactively permitted. o Cart B, sixteen (16) new 5 feet by 8 feet carts. • There will be a total of five (5) different kiosk types. o One (1) existing 8 feet by 8 feet Wetzel’s Pretzels kiosk proposed to be retroactively permitted o One (1) existing 10 feet by 10 feet Exxiypop Shoppe kiosk proposed to be retroactively permitted o One (1) existing 10 feet by 12 feet Oasis Tacos kiosk proposed to be retroactively permitted o One (1) existing 11 feet by 16 feet Maria’s Convenience Store kiosk proposed to be retroactively permitted o One (1) 10 feet by 10 feet Buonissimo kiosk was approved by the City Planner, under a consistency determination (CD 2024-0022) to SDP 96-03(A)/CDP 00-20, replacing a 5 ½-feet wide and 10 ½- Dec. 4, 2024 Item #2 2 of 33 feet long pushcart from the original pushcart program and is also a part of the new pushcart/kiosk program. Background: In 1996 The City Council approved a Site Development Plan (SDP 96-03) for a 300,000-square-foot specialty retail center on the 26.65 acre site. In 2000, an amendment was proposed to the original site development plan (SDP 96-03A) along with a Coastal Development Permit (CDP 00-20) to allow 13 pushcarts to be located in the outdoor mall areas interior to the shopping center. A pushcart is a mobile retail-merchandising unit. The pushcarts and kiosks for the Carlsbad Premium Outlets are designed to complement the existing architecture of the shopping center. To meet parking requirements for the pushcarts, the original approval required the pushcart, and a five-foot perimeter surrounding each pushcart, to be included in the calculation for required parking. To accommodate the proposed additional 4 pushcarts (17 pushcarts proposed) and five additional kiosks (five kioks proposed), the applicant is proposing a 1% reduction in parking in accordance with Municipal Code (CMC) Section 21.44.090(B). Up to a 15% parking reduction may be approved by the decision making authority when any common parking facility for two or more buildings or uses occupies a site of 5,000 square feet or more. Staff has evaluated the details of the request and finds that a parking reduction can be substantiated for this particular use/activity. Refer to Exhibit 3 for detailed parking analysis. No grading or other improvements to the project site are necessary to accommodate the pushcarts and kiosks. Public Outreach & Comment Public notice of the proposed Project was mailed on March 12, 2024, to property owners within 600 feet of the subject property and all residents within 100 feet. A notice of project application sign was posted at the site on January 1, 2024. A CEQA Determination of Exemption was posted on the city’s website on Oct. 30, 2024, for a period of 10-days, and on Nov. 12, 2024, no comments were received. Additionally, the Project is not subject to the enhanced stakeholder outreach in City Council Policy No. 84 (Development Project Public Involvement Policy). Response to Public Comment & Project Issues No comments were received. Project Analysis General Plan Consistency The City of Carlsbad General Plan includes several goals and policies that guide development and land use within the city. A discussion of how the project is consistent with the applicable General Plan policies is summarized in Exhibit 3. Municipal Code Consistency The City of Carlsbad Municipal Code, most notably Tile 21 Zoning Code, includes requirements and provisions that guide development and land use within the city, consistent with the General Plan. Specific compliance with these relevant requirements is described in Exhibit 3. Local Coastal Program Consistency The project site is in the Coastal Zone and requires a Coastal Development Permit. The project complies with the Local Coastal Program (Mello II Segment), including all goals and policies of the General Plan and all zoning code standards, as referenced above. The city’s decision on the Coastal Development Permit is not appealable to the California Coastal Commission. Additional information on the Coastal Development Permit and Local Coastal Program findings is included in Exhibit 3. Dec. 4, 2024 Item #2 3 of 33 Specific Plan The subject property is located within the boundaries of the Carlsbad Ranch Specific Plan, SP 207(K), which provides specific development standards for new growth and development. Specific compliance with these relevant standards is described in Exhibit 3. Discretionary Actions & Findings The proposed Project requires approval of a Site Development Plan Amendment and a Coastal Development Permit Amendment which is discussed below. Site Development Plan Amendment (AMEND 2023-0014) Approval of a Site Development Permit (SDP) Amendment is required to ensure that the site layout, configuration, and site development standards comply with all relevant city standards. (CMC §21.06.030.) Staff finds that the required findings for this application can be met (Exhibit 3). Coastal Development Plan Amendment (AMEND 2023-0016) Approval of a Coastal Development Permit (CDP) Amendment is required to ensure that the project complies with Mello II Segment of the Local Coastal Program (CMC Chapter 21.201) and the Costal Resource Protection Overlay Zone (CMC Chapter 21.203). Staff finds that the required findings for this application can be met (Exhibit 3). Environmental Review In accordance with the California Environmental Quality Act (CEQA) and CEQA Guidelines, the City Planner has determined that the project qualified for an exemption pursuant to CEQA Guidelines section 15311 – Accessory Structures. A notice of intended decision regarding the environmental determination was advertised on October 30, 2024 and posted on the city’s website. No comment letters or appeal was received and consistent with Chapter 21.54 (Procedures, Hearings, Notices, and Fees) of the Zoning Ordinance the City Planner’s written decision is final. Refer to Exhibit 5 for additional support and justification. Conclusion Considering the information above and in the referenced Exhibits, staff has found that the proposed Project is consistent with all applicable policies of the General Plan, the Local Coastal Program, provisions of the Municipal Code, the Carlsbad Ranch Specific Plan, and Local Facility Management Zone. The Project would be required to comply with all applicable California Building Standards Codes and engineering standards through the standard building permit. After consideration of all evidence presented, and studies and investigations made by the city planner and on its behalf, the city planner determined that the project was exempt from further environmental review pursuant to State CEQA Guidelines sections 15311 - Accessory Structures. This exception is for the placement of 17 pushcarts and five kiosks. The project will not have a significant effect on the environment and all of the requirements of CEQA have been met; and WHEREAS, on Oct. 30, 2024, the city distributed a notice of intended decision to adopt the “New Construction or Conversion of Small Structures” exemption. The notice was circulated for a 10-day period, which began on Oct. 30, 2024, and ended on Nov. 12, 2024. The city did not receive any comment letters on the CEQA findings and determination. The effective date and order of the city planner CEQA determination was Nov. 13, 2024; and WHEREAS, the Planning Commission did, on Dec. 4, 2024, hold a duly noticed public hearing as prescribed by law to consider said request; WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Site Development Plan Amendment and Coastal Development Permit Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad, as follows: A) That the above recitations are true and correct. Dec. 4, 2024 Item #2 6 of 33 B) That based on the evidence presented at the public hearing, the Commission APPROVES AMEND 2023-0014/ AMEND 2023-0016 (DEV2023-0146) – CARLSBAD PREMIUM OUTLETS KIOSK PROGRAM, based on the following findings and subject to the following conditions: Findings: Site Development Plan Amendment 1. That the proposed development or use is consistent with the general plan and any applicable master plan or specific plan, complies with all applicable provisions of this chapter, and all other applicable provisions of this code, in that the proposal complies with the applicable requirements of the Carlsbad Ranch Specific Plan which was developed to provide an implementing program for the General Plan in this area. 2. That the requested use is properly related to the site, surroundings and environmental settings, is consistent with the various elements and objectives of the General Plan, will not be detrimental to existing uses or to uses specifically permitted in the area in which the proposed use is to be located, and will not adversely impact the site, surroundings or traffic circulation, in that sufficient parking is provided for the increase in retail space created by the additional pushcarts kiosks on the property. The pushcarts will not be located within any required setback or landscape areas. 3. That the site for the intended use is adequate in size and shape to accommodate the use, in that all applicable code requirements have been met such as building code separations. The pushcarts will be set back from the buildings a minimum of 12 feet. Adequate areas remain for pedestrian circulation once the pushcarts and kiosks are located in the outdoor mall. 4. That all yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained, in that no site improvements are necessary to accommodate the proposal. 5. That the street systems serving the proposed use is adequate to properly handle all traffic generated by the proposed use, in that the proposed use is expected to generate few new primary trips to the site. Instead, the pushcarts and kiosks will benefit from linked trips that occur when patrons of the shopping center stop at the pushcarts to shop. The total number of new daily trips is estimated to be 105 trips. 6. That the proposed development or use meets all other specific additional findings as required by Title 21 of the Carlsbad Municipal Code, in that the project complies with the General Plan, the Carlsbad Ranch Specific Plan, and Title 21 of the Municipal Code. The project properly relates to the site and surroundings and will not adversely impact traffic, nor will it have any impacts on coastal resources. Coastal Development Permit Amendment 7. That the proposed development is in conformance with the Certified Local Coastal Program and all applicable policies in that no site improvements are necessary for the proposed pushcarts resulting in no impacts to coastal resources. Dec. 4, 2024 Item #2 7 of 33 8. The proposal is in conformity with the public access and recreation policies of Chapter 3 of the Coastal Act in that the property is not located adjacent to the coastal shore; therefore, it will not interfere with the public’s right to physical access or water-oriented recreational activities. 9. The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone (Chapter 21.203 of the Zoning Ordinance) in that no coastal resources exist on the project site and no site improvements are necessary for the proposal. 10. The project is not between the sea and the first public road parallel to the sea and therefore, is not subject to the provisions of the Coastal Shoreline Development Overlay Zone (Chapter 21.204 of the Zoning Ordinance). General 11. The Planning Commission finds that the project, as conditioned herein, is in conformance with the Elements of the City’s General Plan, in that, the General Plan Land Use designation for the property is R, Regional Commercial. The R, Regional Commercial Land Use designation allows for retail uses. The project proposes an updated pushcart and kiosk program for the Carlsbad Premium Outlets to permit 17 pushcarts (including 16 new pushcarts and the retroactive approval of one (1) additional pushcart); and to permit 5 kiosks (including one (1) kiosk that was approved through consistency determination, CD 2024-0022, replacing a pushcart, and the retroactive approval of four (4) kiosks). 12. That the Planning Director has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15311, Accessory Structures, of the state CEQA Guidelines. In making this determination, the Planning Director has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. 13. The Planning Commission has reviewed each of the exactions imposed on the Developer contained in this resolution, and hereby finds, in this case, that the exactions are imposed to mitigate impacts caused by or reasonably related to the project, and the extent and the degree of the exaction is in rough proportionality to the impact caused by the project. Conditions: General NOTE: Unless otherwise specified herein, all conditions shall be satisfied prior to the placement of the pushcarts and kiosks within the mall. 1. If any of the following conditions fail to occur, or if they are, by their terms, to be implemented and maintained over time, if any of such conditions fail to be so implemented and maintained according to their terms, the city shall have the right to revoke or modify all approvals herein granted; deny or further condition issuance of all future building permits; deny, revoke, or further condition all certificates of occupancy issued under the authority of approvals herein granted; record a notice of violation on the property title; institute and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. No vested rights are gained Dec. 4, 2024 Item #2 8 of 33 by Developer or a successor in interest by the city’s approval of this Site Development Plan Amendment and Coastal Development Permit Amendment. 2. Staff is authorized and directed to make, or require the Developer to make, all corrections and modifications to the Site Development Plan Amendment and Coastal Development Permit Amendment documents, as necessary to make them internally consistent and in conformity with the final action on the project. Development shall occur substantially as shown on the approved Exhibits. Any proposed development, different from this approval, shall require an amendment to this approval. 3. Developer shall comply with all applicable provisions of federal, state, and local laws and regulations in effect at the time of building permit issuance. 4. If any condition for construction of any public improvements or facilities, or the payment of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project are challenged, this approval shall be suspended as provided in Government Code Section 66020. If any such condition is determined to be invalid, this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. 5. Developer/Operator shall and does hereby agree to indemnify, protect, defend, and hold harmless the City of Carlsbad, its Council members, officers, employees, agents, and representatives, from and against any and all liabilities, losses, damages, demands, claims and costs, including court costs and attorney’s fees incurred by the city arising, directly or indirectly, from (a) City’s approval and issuance of this Site Development Plan Amendment and Coastal Development Permit Amendment, (b) City’s approval or issuance of any permit or action, whether discretionary or nondiscretionary, in connection with the use contemplated herein, and (c) Developer/Operator’s installation and operation of the facility permitted hereby, including without limitation, any and all liabilities arising from the emission by the facility of electromagnetic fields or other energy waves or emissions. This obligation survives until all legal proceedings have been concluded and continues even if the city’s approval is not validated. 6. Prior to submittal of the building plans, improvement plans, grading plans, or final map, whichever occurs first, developer shall submit to the City Planner, a 24" x 36" copy of the Site Plan reflecting the conditions approved by the final decision making body. The copy shall be submitted to the City Planner, reviewed and, if found acceptable, signed by the city's project planner and project engineer. If no changes were required, the approved exhibits shall fulfill this condition. 8. Prior to placement of the pushcarts within the mall area, the Developer shall provide proof to the Building Division from the Carlsbad Unified School District that this project has satisfied its obligation to provide school facilities. 9. This project shall comply with all conditions and mitigation measures which are required as part of the Zone 13 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits. 10. This approval shall become null and void if building permits are not issued for this project within 24 months from the date of project approval. All kiosks and pushcarts must comply with building and accessibility codes. All kiosk doors shall open inward to main a clear path of travel and avoid opening into the 12 feet of separation between the kiosks and tenant storefronts. Dec. 4, 2024 Item #2 9 of 33 11. The pushcarts and kiosks or groups of pushcarts and kiosks shall be located so they are no closer than 20 feet to other pushcarts and kiosk or groups of pushcarts and kiosks. 12. Approval of AMEND 2023-0014/ AMEND 2023-0016 supplements the approval of SDP 96-03. All conditions of approval found in Planning Commission Resolution No. 3965 dated August 7, 1996 remain in full force and effect except as modified herein. 14. Prior to the placement of the pushcarts within the mall, Developer shall submit to the City a Notice of Restriction to be filed in the office of the County Recorder, subject to the satisfaction of the Planning Director, notifying all interested parties and successors in interest that the City of Carlsbad has issued a Site Development Plan Amendment and Coastal Development Permit Amendment by this Resolution on the real property owned by the Developer. Said Notice of Restriction shall note the property description, location of the file containing complete project details and all conditions of approval as well as any conditions or restrictions specified for inclusion in the Notice of Restriction. The Planning Director has the authority to execute and record an amendment to the notice which modifies or terminates said notice upon a showing of good cause by the Developer or successor in interest. 15. A sign program application for the kiosks and pushcarts shall be submitted to the Planning Division and approved by the City Planner. No existing or proposed pushcart or kiosk signage is part of this approval. Once a sign program is approved, each kiosk and pushcart will be required to obtain a sign permit for any proposed signage. Fire Department 16. Placement of Kiosks shall not impede access to Fire Department standpipe systems located within the outlet mall walkways. NOTICE TO APPLICANT An appeal of this decision to the City Council must be filed with the City Clerk at 1200 Carlsbad Village Drive, Carlsbad, California, 92008, within ten (10) calendar days of the date of the Planning Commission’s decision. Pursuant to Carlsbad Municipal Code Chapter 21.54, section 21.54.150, the appeal must be in writing and state the reason(s) for the appeal. The City Council must make a determination on the appeal prior to any judicial review. NOTICE Please take NOTICE that approval of your project includes the “imposition” of fees, dedications, reservations, or other exactions hereafter collectively referred to for convenience as “fees/exactions.” You have 90 days from date of final approval to protest imposition of these fees/exactions. If you protest them, you must follow the protest procedure set forth in Government Code Section 66020(a), and file the protest and any other required information with the City Manager for processing in accordance with Carlsbad Municipal Code Section 3.32.030. Failure to timely follow that procedure will bar any subsequent legal action to attack, review, set aside, void, or annul their imposition. Dec. 4, 2024 Item #2 10 of 33 You are hereby FURTHER NOTIFIED that your right to protest the specified fees/exactions DOES NOT APPLY to water and sewer connection fees and capacity charges, nor planning, zoning, grading, or other similar application processing or service fees in connection with this project; NOR DOES IT APPLY to any fees/exactions of which you have previously been given a NOTICE similar to this, or as to which the statute of limitations has previously otherwise expired. A.General Plan Regional Commercial (R) Land Use Designation The General Plan Land Use designations for the property consists of the Regional Commercial (R) land use designation. The R land use designation allows for shopping centers with anchor and secondary tenants that are region- serving, as well as mixed use (regional commercial uses and residential dwellings). The project also complies with the other Elements of the General Plan as outlined in Table “A” below: TABLE A – GENERAL PLAN COMPLIANCE ELEMENT USE, CLASSIFICATION, GOAL, OBJECTIVE, OR PROGRAM PROPOSED USES & IMPROVEMENTS COMPLY Land Use & Community Design Goal 2-G.2 – Promote a diversity of compatible land uses throughout the city, to enable people to live close to job locations, adequate and convenient commercial services, and public support systems such as transit, parks, schools, and utilities. The proposed pushcarts and kiosks that will be used for retail and food sales are permitted by both the General Plan and Zoning designations. The allowance of these commercial services provides convenient commercial services to persons visiting the shopping center. Yes B.General Commercial, Qualified Development Overlay (C-2-Q) Zone; Parking Ordinance (Chapters 21.28, 21.06, and 21.44) The project site is zoned General Commercial with a Qualified Development Overlay (C-2-Q). The zoning designation permits the use subject to the approval of a site development plan. The Carlsbad Ranch Specific Plan was established with the requirement that each site receive approval of a site development plan and the zoning reflects this criteria. In conclusion the proposed pushcarts and kiosks that will be used for retail and food sales are permitted by both the General Plan and Zoning designations. Dec. 4, 2024 Item #2 13 of 33 Page 2 The Qualified Development Overlay Zone (Q-Overlay) requires that a site development plan be approved for the proposed use prior to the issuance of any building permit. A site development plan, SDP 96-03, was approved for the Carlsbad Premium Outlets, formerly the Carlsbad Company Stores, in 1996. A site development plan amendment, SDP 96-03(A), was required in 2000 because the original site development plan did not include the proposed pushcarts or additional retail area they represented. The project proposes an update to the pushcart and kiosk program, requesting to increase the number of pushcarts to 17 (an increase of four pushcarts) and add 5 kiosks. The Q-Overlay Zone requires six findings. The required findings with justification for each are contained in the Planning Commission Resolution for the project. The necessary findings and support for each is summarized and discussed in Planning Commission Resolution 7530. The requested use is properly related to the site, surroundings and environmental settings as the project design complies with applicable requirements of the Carlsbad Ranch Specific Plan such as parking and setback standards. Sufficient parking is provided for the increase in retail space created by the placement of the pushcarts and kiosks on the property as described in great detail in Section C below. The pushcarts will not be located within any required setbacks or landscape areas. The site is also adequate in size and shape to accommodate the use as all applicable code requirements have been met such as building code separations. The pushcarts and kiosks will be set back from the buildings a minimum of 12 feet, unless a greater distance is required by applicable building and fire codes. Adequate areas remain for pedestrian circulation once the pushcarts and kiosks are located in the outdoor mall. The pushcarts and kiosks, or groups of pushcarts and kiosks, will also maintain 20 feet of separation from other pushcarts and kiosks or groups of pushcarts and kiosks as required by the building code. All features necessary to adjust the use to existing and permitted future uses exist on the site. Parking required for the proposal is available on the site. No site improvements are necessary to accommodate the proposal. The planned street system is adequate to handle all traffic generated by the use. The proposed use is expected to generate few, new primary trips to the site. Instead, the pushcarts and kiosks will benefit from linked trips that occur when patrons of the shopping center stop at the pushcarts and kiosks to shop. Six site development plan findings are required for the project. The required findings with justification for each are summarized below and contained in Planning Commission Resolution 7530. 1.That the proposed development or use is consistent with the General Plan and any applicable master plan or specific plan, complies with all applicable provisions of Chapter 21.06 of the Carlsbad Municipal Code, and all other applicable provisions of this code. The proposal complies with the applicable requirements of the Carlsbad Ranch Specific Plan which was developed to provide an implementing program for the General Plan in this area. 2.That the requested development or use is properly related to the site, surroundings, and environmental settings, will not be detrimental to existing development or uses or to development or uses specifically permitted in the area in which the proposed development or use is to be located, and will not adversely impact the site, surroundings, or traffic circulation. Sufficient parking is provided for the increase in retail space created by the additional pushcarts and kiosks Dec. 4, 2024 Item #2 14 of 33 Page 3 on the property. The pushcarts will not be located within any required setback or landscape areas. 3. That the site for the intended development or use is adequate in size and shape to accommodate the use. The project complies with all applicable code requirements including building code separations. The pushcarts and kiosks or groups of pushcarts and kiosks will have 20 feet of separation from other pushcarts and kiosks or groups of pushcarts and kiosks to comply with building code. Adequate areas remain for pedestrian circulation once the pushcarts are located in the outdoor mall. 4. That all yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested development or use to existing or permitted future development or use in the neighborhood will be provided and maintained. The project does not require any site improvements to accommodate the proposal. 5. That the street systems serving the proposed development or use is adequate to properly handle all traffic generated by the proposed use. The proposed use is expected to generate few new primary trips to the site. Instead, the pushcarts and kiosks will benefit from linked trips that occur when patrons of the shopping center stop at the pushcarts to shop. The total number of new daily trips is estimated to be 105 with 3 new afternoon peak hour trips being generated. 6. That the proposed development or use meets all other specific additional findings as required by this title. The project complies with the General Plan, the Carlsbad Ranch Specific Plan, and Title 21 of the Municipal Code. The project properly relates to the site and surroundings and will not adversely impact traffic, nor will it have any impacts on coastal resources. C. Parking Ordinance (CMC Chapter 21.44) The development currently provides 1,519 parking spaces and meets all parking standards for the existing development (1,500 parking spaces required). Additional parking is required for the pushcarts and kiosks because the outdoor mall area is not included in parking requirements for the development. This is in comparison to indoor malls where the entire enclosed space is included in the gross building area used for parking calculations. Parking calculations have been provided for the shopping center that include all interior tenant space and the proposed pushcarts and kiosks (refer to Table B). The shopping center parking rate of 1 space per 200 gross square feet has been applied to the pushcarts and perimeter around each. The addition of 17 pushcarts and 5 kiosks to the development site results in an additional 34 parking spaces needed. Parking calculations have been provided for the shopping center that include all interior tenant space and the proposed pushcarts and kiosks. The details of the request require 15 parking additional spaces (a total of 1,534 parking spaces are required with 1,519 parking spaces currently on site). To meet parking requirements, the applicant is proposing a 1% reduction in parking in accordance with Dec. 4, 2024 Item #2 15 of 33 Page 4 Municipal Code (CMC) Section 21.44.090(B). Up to a 15% reduction may be approved by the decision- making authority when any common parking facility for two or more buildings or uses occupies a site of 5,000 square feet or more. The applicant only needs a 1% reduction (rather than 15%) and is requesting the approval of a reduction of 15 parking spaces. For comparison, a 15% reduction reduces the required 1534 spaces to 1304 required spaces. Local Coastal Program (Mello II Segment) 1. Mello II Segment of the Certified Local Coastal Program and all applicable policies The proposed site is in the Mello II Segment of the Local Coastal Program (LCP) and is within the non- appealable jurisdiction of the California Coastal Commission. The project site has a LCP Land Use designation of Regional Commercial (R). A Coastal Development Permit Amendment to CDP 00-20 is required because the additional pushcarts and kiosks represent an increase in retail space. The Carlsbad Premium Outlets project is consistent with the relevant policies of the Mello II Segment of the Local Coastal Program and the Coastal Resource Protection Overlay Zone. Approval of the pushcart program was previously found to be consistent with coastal policies under CDP 00-20 and the proposed development remains consistent with coastal polices as stated within Exhibit 1. No impacts to coastal resources will occur, as no site improvements are necessary and no additional parking is required to accommodate the use. 2. Coastal Resource Protection Overlay Zone The development is subject to the Coastal Resource Protection Overlay Zone (CMC Chapter 21.203). The Coastal Resource Protection Overlay Zone identifies areas of protection: a) preservation of steep slopes and vegetation; b) drainage, erosion, sedimentation, habitat; c) seismic hazards, landslides, and slope instability; and d) floodplain development. The project’s compliance with each of these areas of concern is discussed below: a. Preservation of Steep Slopes and Vegetation. Slopes greater than 25% and possessing endangered plant/animal species and/or coastal sage scrub and chaparral plant communities are considered “dual criteria” slopes and are protected in the Coastal Zone. The project does not support any “dual criteria” slopes. Dec. 4, 2024 Item #2 16 of 33 Page 5 b. Drainage, Erosion, Sedimentation, Habitat. The project will adhere to the city’s Master Drainage Plan, Grading Ordinance, Storm Water Ordinance, BMP Design Manual and Jurisdictional Runoff Management Program (JRMP) as no site improvements are proposed or are necessary to accommodate the use. c. Seismic Hazards, Landslides and Slope Instability. No impacts to coastal resources will occur, as no site improvements are necessary to accommodate the use. Therefore, there will be no people or structures exposed to geotechnical-related hazards. d. Flood Plain Development. No structures or fill are being proposed within a one-hundred-year floodplain area as identified by the FEMA Flood Map Service Center. E. Carlsbad Ranch Specific Plan, SP 207(K) The Carlsbad Ranch Specific Plan establishes the permitted uses for the site as well as the development standards and design guidelines. The project plans comply with the requirements of the specific plan. The permitted uses for the site include retail business uses as well as others. The proposed pushcarts and kiosks will be used for retail and food sales which are uses permitted by the specific plan. F. GROWTH MANAGEMENT The proposed project is located within Local Facilities Management Zone 13 in the Southwest Quadrant of the city. The impacts on public facilities created by the project, and its compliance with the adopted performance standards, are summarized in Table “C” below.
