Recommended Action
Consider staff’s recommendation to the City Council to introduce an ordinance restricting
overnight parking on both sides of Garfield Street from the 2600 to 2800 blocks between the
hours of 11 p.m. and 5 a.m. and provide a recommendation to the City Council.
Executive Summary
Community members who live along the 2600 to 2800 blocks of Garfield Street, from Cypress
Avenue on the north to Christiansen Way on the south, have expressed concerns about people
who appear to be illegally camping in their vehicles overnight using marked stalls. These
concerns include trash and human and animal waste being left behind.
These community members have asked the city to prohibit overnight parking on this stretch of
Garfield Street. This will affect 64 parking spaces in the area.
Staff are recommending the City Council address the issue and amend the Carlsbad Municipal
Code – amending Title 10, Chapter 10.40 of the Carlsbad Municipal Code by adding Section
10.40.304 – to prohibit parking on both sides of the 2600 to 2800 blocks of Garfield Street
between the hours of 11 p.m. and 5 a.m.
Staff are asking the Commission to consider the issue and provide its recommendation to the
City Council.
Explanation & Analysis
The 2600 to 2800 blocks of Garfield Street, from Cypress Avenue on the north to Christiansen
Way on the south, include a residential area, Magee Park, St. Michael’s Church and a parking lot
close to the Beech Avenue public beach access. There are currently no overnight parking
restrictions on Garfield Street.
The City Council amended Carlsbad Municipal Code Section 10.40.145 in 2017 to authorize the
city to install and maintain parking space markings to indicate parking spaces adjacent to curbs

where authorized parking is permitted, and to indicate those locations where the parking of
vehicles beyond the marked parking space is prohibited.
While the municipal code currently restricts parking in marked spaces, it has not prevented
people from camping in their vehicles within marked parking spaces, leaving behind trash and
human and animal waste and creating unsanitary conditions for community members and
visitors to the area.
Parking in a single space for more than 72-hours is prohibited under Carlsbad Municipal Code
10.40.010, but enforcing this ordinance has been challenging because drivers can move their
vehicles a short distance and then return, resetting the 72-hour limit.

The Police Department has responded to 80 calls for service on this stretch of Garfield from
January 2023 through September 2024. This number of calls is not high for an area this close to
the beach that tends to attract visitors throughout the year.

Community Engagement
The Police Department held a community meeting on Dec. 17, 2024, to gather feedback on
community support or opposition to the proposed parking restrictions. The proposal did not
receive general support. More than thirty residents and individuals living in their vehicles
attended the community meeting. The predominant sentiment was a desire for additional
options, including exploring a citywide ban on individuals sleeping in vehicles, implementing
permit parking for residents and guests, and considering alternative long-term solutions to the
issues. The attendees felt that this ordinance amendment did not offer a long-term solution to
the problem and would only cause displacement in other areas of the city.
Fiscal Analysis
The preliminary cost estimate of implementing an overnight parking ban covers the production
and installation of signs with the new restrictions along both sides of Garfield Street, spanning
the 2600, 2700 and 2800 blocks. Staff estimate 24 signs will be needed, which will cost
approximately $5,400 to install, including labor and materials.
The Public Works Department would require an additional $5,400 in its operating budget for
Fiscal Year 2024-25 to cover the labor and materials needed for production and installation of
these signs.
Options
Staff recommend the City Council consider the following options to the community’s concerns
about overnight parking on Garfield Street:
Option 1
Add Section 10.40.304 to the Carlsbad Municipal Code restricting overnight parking on both
sides of Garfield Street from the 2600 to 2800 blocks between 11 p.m. and 5 a.m.
Pros
• Would eliminate overnight parking in the area of the concerns raised by
community members
• Will likely reduce trash and waste being left behind
Cons
• Will likely displace overnight parking to streets without overnight parking
restrictions.
• Will likely impact resident and guest parking in the area
Option 2
Make no amendments to the Municipal Code that would restrict overnight parking.

Environmental Evaluation
The project is exempt from the California Environmental Quality Act under CEQA Guidelines

involving negligible or no expansion of use.

a pest but it was very disheartening what we have seen the last 3 days! Vehicles have their doors open obstructing

Thank you for your consideration on overnight parking on Garfield St. I live in the neighborhood for the last 9 years
and know of at least one modified ambulance that has been parked and lived in for that entire time. This is
unacceptable. There are anywhere from 5-10 vehicles taking up valuable spaces for visitors and beach access.
The other area that should be reviewed is Carlsbad Blvd. between Tamarack and cannon. There are between 5-14
oversized SUVs parked and lived in every day. One vehicle has been parked for over a year.

My wife and I are the owners of 2651 Garfield St. This was previously my families full time
residence. Before we moved out of the neighborhood several years ago, we requested and

were granted meetings with the City Counsel regarding the ongoing problems associated with
overnight parking of RV’s, homeless encampments at Magee Park and the over utilization of
Heritage Hall by the Park & Rec department in the City of Carlsbad. In recent years, since our
neighborhood met with the city, there have been some improvements in the homeless
situation at the park. The large RV’s have been eliminated by parking space size restrictions,
although there are now multiple camper vans, pick up trucks with campers and larger SUV’s
that reside on Garfield street which do happen to meet the parking space size restrictions.
There is also a roofing contractor that parks his oversized dump truck on Garfield, Cypress and
Beech streets. The park still has much transient activity that includes smoking pot, sleeping in
bushes, living on the Gazebo and Magee House Museum porch and disorderly
conduct/domestic violence incidents between the homeless.
We now use the property as a short term rental for young families to bring their kids to the
beach. We’ve received calls from our rental guest families that they fear for their safety due to
the continuation of the transient problem within the city of Carlsbad on Garfield Street, Magee
Park and the adjacent streets.
Current City and PD policy is to wait for a resident to call and complain about a violation before
taking action. Violators know that if no one complains, they are allowed to continue the
violation. Consistent enforcement is important.
We believe the problems on Garfield Street can be eliminated by the following:
1. Recommend changing the proposed overnight parking prohibition hours of 11pm to 3am to
be consistent with other parking restrictions in the city of 11pm to 5am and posting signs to
indicate the restrictions.
2. Ticket oversized vehicles, such as the illegally parked roofing commercial truck, that is an
eyesore to the neighborhood.
3. Post signs in Magee Park to prohibit loitering and allow Carlsbad Police to enforce loitering
laws.
4. Park & Rec revisions to raise the rental rates and reduce the capacity for use of Heritage Hall
and Magee Park to events that require no more parking than is available in the designated
parking lot or a private parking lot, such as St. Michaels. Garfield St. cannot handle the parking
requirements of the ongoing large events hosted at Heritage Hall and Magee Park.
5. Increased and consistent Carlsbad Police patrols and enforcement in the area.

In closing, I want to thank the Carlsbad PD Homelss Outreach division. They have done a great
job and I want to acknowledge the improvements to the area. More work needs to be done by
the City and Carlsbad PD to consistently enforce the law and rules

Thank you for the informaƟve meeƟng and frank discussion. It was great seeing the community turnout and to hear the
frustraƟon residents are experiencing. Let’s face it…Carlsbad will never solve the homeless issue even with the $9.1
million dollar upcoming budget! As surrounding jurisdicƟons ban encampments and start enforcing camping bans we can
only hope Carlsbad will be prepared for the influx of individuals coming here. Spend any Ɵme in the Village and you will
see many new faces.
My fear is the bigger picture. Last month the Housing and Homeless Commission received the Homeless report that will
be presented to Council in February. There are opƟons under specified categories…Enforcement or Service. Just those
terms alone are divisive. Enforcement sounds so heartless and Service sounds so caring. There is also wording relaƟng to
the exploraƟon of a Safe Parking Lot and Safe Camping Area. Would those choosing to live on Garfield want to relocate
to a Safe Parking Lot with rules? I highly doubt it. Would the gentlemen who voiced it is his preference to live in his
converted ambulance want to live in a Safe Parking Lot? I don’t know.
Whatever is presented to Commissioners and Council Members I hope that you can relay what the overwhelming
consensus of those in aƩendance was.

Hi Melanie, I have some concerns about the proposed restrictions on Garfield because of the likely
spillover effect into more residential areas like our own.
In addition, I am especially concerned about the way this is being handled by the City. I'msensing some "hidden hand(s)" in the background.
Specifically, why is this moving to the Traffic and Mobility Commission and then to Council
so soon after getting community input - during a holiday period when resident attention islower? And who the heck is the "staff" making a recommendation and limiting "options" even
before hearing from the community? And then sticking to their own option even after gettingconcerns by other residents? And Why is a solution not incorporated into a more
comprehensive city/village wide approach, especially after the US Supreme Court's GrantsPass decision.
As you know, I'm a great supporter of our city and their efforts to gather all community
perspectives and then try to balance all interests. And I empathize with the residents onGarfield (who occupy only 25% of the 2 - not 3 block - area in question.)
But something stinks and I believe the city's approach has the potential to create another
Windsor Pointe fiasco.
After the Community meeting on 12/17, I submitted a CA Public Record Request seekingmore info about the nature of the complaints received about Garfield; and will probably follow
up with a second request attempting to figure out who was involved in the "staff"recommendation and why options were so limited. Hopefully, production will occur in time to
assess before Council makes a final decision.
I am providing a copy of this email to the Commission and hope to be able to attend the 1/6/25Commission meeting, but would welcome any opportunity to discuss with you prior to
Monday's meeting in case I'm missing something in my preliminary assessment.

The overnight parking situation along Garfield Street in Carlsbad Village is slightly impacting my bike club. The North County Cycle
Club occasionally meets near Magee Park for a bicycle ride, and our preferred location is the block of Garfield St. just south of Magee
Park. This way we don't take up parking for groups meeting at the church. However things have gotten a bit busy lately:
All of the cars in this photo were occupied, as far as we could tell. This was a little after 8:00 am on New Yea r's day.
There were still some parking spots left, but it meant parking next to or between people camping out. It's hard for us to gauge whether
this is a safe situation or not, but at a minimum it does feel awkward. Parking a car and camping are different uses of a parking spot,
even though they might look the same at first glance.
I do wonder if this busy recreational area, a block from the beach, is the best location for the city to provide free camping. I would
support a targeted ban on overnight camping along Garfield St., or really anywhere outside of a purpose built facility.

I recently attended the community meeting at Magee Park to discuss overnight parking on Garfield St. This issue is
just the tip of the iceberg as Carlsbad (especially the Village) faces growth, lack of parking requirements for new
growth and higher population density.
There are two Carlsbad parking laws that need to be diligently enforced.
1. It is unlawful to park a vehicle on any street in excess of 72 hours.
2. Overnight parking of RVs & oversized vehicles prohibited on city streets between 2 AM - 5 AM.
I walk almost daily from the Buena Vista Lagoon to Cannon Rd. There is a converted ambulance on Garfield St.
with someone living in it that has been parked for 9 years. There is a >25 ft. motorhome with pushed out sides and a
small vehicle that has been parked on Carlsbad Blvd. (ocean front) just north of Cannon for >2 years. These folks
are breaking the law and in some cases taking 3-4 parking paces away from families visiting our beautiful beaches.
I suggest hiring parking enforcement personnel, lining car sized spaces on Carlsbad Blvd. and enforce our parking
laws.
Let’s keep Carlsbad beautiful and accessible for visitors on a daily basis not those illegally living on our streets.

Garfield, and for their taking the time to hold a community discussion on theissues involved, I must respectfully disagree with the limited pair of options forthe Traffic commission and city council to consider on this topic.
Homelessness is a multifaceted problem; it brings with it safety (involving drugsand other crimes), health concerns (human and animal waste)– asdemonstrated in the slides of CPD’s presentation pointing out the calls to themfor service, and the moral issue of actually caring about the dignity of humanlife rather than embracing the false compassion of permitting and fundingindividuals living in the prisons of their drug addictions and mental healthcrises. We also know, from the town hall, that some members of thecommunity just stopped calling out of frustration and because of the dearthof change.
However, the countless issues cannot be addressed here, only the issue ofovernight parking on Garfield.
One problem is immediately visible when viewing the map provided (slide p 2of 15). The neighborhood is boxed in on three sides and with the prohibition ofparking on Garfield it is likely that the vehicles will simply move toward thehomes in the area, parking in front of the neighborhood homes, bringing theexisting problems closer to the residents and creating new problems for thehomeowners – like lack of parking for themselves and guests. Option 1 pointsthis out in the ‘cons’ and as it would exacerbate the problem, Option 1 shouldbe rejected.
Option 2 is inertia. That should also be rejected.
What might other options be? It is helpful to review and learn from policiesalready tried and the results. Some other options that may come up:
Another option – let’s call it Option 3 - that should also be rejected: so-called“Safe Parking” (SP) such as the Encinitas program run by Jewish FamilyServices (JFS). Reasons to reject: SP’s are magnet for attracting homeless to anarea – making the problem larger; they perpetuate the Leviathan that is taxpayer funding of NGO’s and corruption – see charts (10% of millions of dollars
goes to services!?) and funding study of JFS.
Parallels can be drawn with the disastrous Windsor Pointe project. As a friendsaid, “JFS is much like Windsor Point as a profit center for outreach programswho see the enormous income potential to be derived by skimming millionsfrom state and local funding.” “Safe parking” should be rejected.
What is a practical and viable option?
Option 4 – Amend the ordinance to ban overnight parking anywhere in thecity of Carlsbad. That option should be presented to the council forconsideration.
