Newly enacted legislation (AB 163 [Goee1n]), which became 11;1,w on July 29,
1983, provides builders new options and additional flexibility in canplying with
the energy conservation standards for new residential buildings. The princiJ:0,1
features of the bill are described below:
• GROUP AVERAGING fuilders may comply with the standards by averaging the
performance of groups of buildings. All buildings in an averaged group must be
in the same subdivision, and all must be based on the same model. Reverse plans
and different elevations of' a model are regarded as the same model. fuildings
based on the model and with the same fl.oorplan (including reverse plans) but
with different conservation features, such as shading, insulation levels, thennal
mass, etc, are still regarded as the same model. Different models may not be
grouped together for averaging.
fuilders who elect to average must apply for permits for all buildings in an
averaged group on the same day, and each application must indicate the group to
which the averaging approach is applied. The builder demonstrates compliance
by using either the Point System or any other approved calculation method, such
as CALPAS 1 A or CALPAS 3, to show that a siulple arithmetic average of the enerfY
performance of all buildings in the group meets the standards' energy budget.
\1111 . .-n the b1,,;.ildings are offered for sale, builders must also notify JX)tential
buyers that coopliance with the energy standards used averaging and that the
perforuance of a P3,rticular home relative to the performance standard is available
UJX)n request.
• NEW PACKAGES fuilders may also use new p:1.ckat;es enacted by AB 163, i n
place of Packaees A, B, and C in the standards. The new packages for each
climate zone are summarized in the TABLE attached to this notice. Notes explaining
the J:Bckages appear on i:ege 2 of this notice.
• ALTERNATIVE PACKAGES AB 163 also allows builders to develop and use their
owu }lick.ages of measures, provided such pi.ck.ages result in the same energy
performance as the new pi.ckages in AB 163. To use this approach, builders may
use either the Point System or another approved calculation method (e.g., CALPAS
1A or 3) and follow these steps:
1. Calculate the energy consumption or p::,int system total of the building
floorplan including all of the comJX)nents in an AB 163 pack.age ( see attached
TABLE). Assume the building has the maximum amount of glazing allowed in that
JliC~e and that this glazing is equally distributed north, east, south, and
west. '!his calculation sets the energy goal or standard that the proJX)sed
buildir,e must ceet.
Hote: If the p::,int system is used, this goal will not necessarily be zero
points.

• OTHm PROVISIONS OF AB 163
. 1. Regardless of the method of compliance, every building must still comply
with th~ mandatory features and devices requirements of the standards. The
requirements appear in Section 2-5352 of Title 24, CAli£0rni~ A@imb~r~~~vo Ot-A~~,
2. Any application for a building permit pending on or after July 29, 1983, may
use any of the compliance methods in AB 163 to meet the new energy standards.
3. If a fireµlace is not located near an exterior wall, outside ccmbustion air
is not required in climate zones 5, 6, 7, 8, 9, 10, 14, and 15. Note that this
provision of the bill is an express exe.option for those cli:nate zones frcxn the
outside ccxnbustion air requireo1ent in the stan:lards. (The requirement in the
standards appears in Section 2-5352(d) of Title 24, Ca.liforraid. Administrative
Code.)
• EXPLANATIONS OF THE ~UIREMEUTS IN THE ID.."W AB 163 PACKAGIB (See 'l'ABLE) The
following requirements apply if builders elect to use the _FB.ckages in AB 163.
(For requirer.uents of other packaees or ca11pliance methods, consult the standards
or the .Ene rgJ Conservation Manual. )
1. All concrete slab floor buildings are required to have 25 percent of the
floor area directly exposed to the conditioned space. To determine the floor
area, count only the first floor in conditioned areas. Uncarpeted first floor
areas, such as linoleum or tiled entry ways, kitchens, bathrooms, and utility
closets may all be counted towards this require1JJent.
2. In some climate zones, a building wi.th raised fl.oars ( rather than concrete
slab) must also include thermal mass with an area exposed to the conditioned space
,_equal to a certain percentage of the ground floor floor area. . The percentage for
each zone is listed in the attached TABLE. To qualify for thermal wass, the
material used must have a performance equivalent to masonry two inches thick, with
a volur.ietric heat capacity of 28 Btu per cubic foot per degree }'a.hrenheit per
hour, a theroal conductivity of one Btu per foot per foot per degree Fahrenheit
per hour, and a surface area directly exposed to the roa:1 air of the required
percentage of the ground floor floor space. A list of materials that meet these
requirements is being developed by the Commission.
3. The attic requirement means that an attic is installed under not less than
75 percent of the roof that is over any conditioned space.
4. The air conditioner efficiencies must be cet if an air conditioner is
installed, ·out AB 1t3 does not require that an air conditioner be installed.
5. If a teat puop is used, an automatic setback thermostat is required in
cli:.aate zones 1, 3, 5, 7, 15, and 16 if building permits are applied for on or
afte-r Aub'"l..lst 1 , 1983. In all zones, an automatic setback thermostat is required
for permits ~Hlied for on or after July 1, 1984.
6. Infil traticn barriers and air-to-air heat excha.ngers are not required in any
cli!r.ate zor.e by these pa.ck,aees.

This is to report the results of tests to determine the moisture contents of the soils in the upper
three feet below finished grade in the proposed building area at the subject site in Carlsbad,
Col ifomia.
The soil samples were obtained on September 18, 1984 and the results of the moisture determinations
are presented as follows:

It is concluded from the field observations of the various soil types and the final results of the
moisture determinations that the soils in the upper three feet below finished grade at the locations
sampled have been sufficiently moistened to minimize the potential expansion of the soils, as
recommended In our report under Project No. 70-10-28D doted October 12, 1971.
It is recommended that positive drainage, 6 inches of vertical fall in 6 feet horizontally, should
be provided around the perimeter of the house in landscaped areas •. Drainage systems should
also be provided to collect all runoff from roofs a:1d conduct the water in watertight pipes either
into the streets or storm drains.

All surface drainage should be prevented from ponding adjacent to or run"l ing over the tops
of slopes. Inlet boxes and watertight pipes should be installed when necessary to comply with
the d,ove.

The application must be signed by the owner (or his authorized representative) of
the property to be served. The total charges must be paid to the District at the
time the application is submitted.
If a service lateral is required, it will be install ed by the Leucadia County Water
District. The service lateral is that part of the sewer system that extends from
the main collection line in the street (or easement) to the point in the street (at
or near the applicant's prop erty line) where the service lateral is co nnected to
the applicant's building sewer. The applicant is respon sible for the construction,
at the applicant's expense, of the sewer pipeline (building sewer) from the appli-
cant's plumbing to the point in the street (or easement) where a connection is made
to the service lateral.
The co nnection of the applicant's building sewer to the service lateral shall be
made by the applicant at his expense. The connection must be made in conformity
with the District's specifications, rules and regulations; and IT MUST BE INSPECTED
AND APPROVED BY THE DISTRICT BEFORE THE SEWER SYSTEM MAY BE USED BY THE APPLICANT.
THE APPLICANT, OR HIS AUTHORIZED REPRESENTATIVE, MUST NOTIFY THE DISTRICT AT THE
TIME INSPECTION IS DESIRED. ANY CONNECTION MADE TO THE SERVICE LATERAL OR COLLEC-
TION LINE WITHOUT PRIOR APPROVAL AND INSPECTION BY THE DISTRICT WILL BE CONSIDERED
INVALID AND WILL NOT BE ACKNOWLEDGED.
The prorated sewer service fee is based upon the date the District estimates that
service will begin and covers t he balance of the fiscal year. There will be no
additional fee or refund if service actually corrmences on a different date. For
succeeding fiscal years, the sewer service fee will be collected on the tax roll
