GRADING VIOLATION AT 2434 UNICORNIO STREET
Dear Mr. And Mrs. St. Austin,
I have recently observed the remedial work performed by the property owners of
2434 Unicornio Street and have found their efforts satisfactory. The slope
adjacent to your property substantially conforms to the City's 2: 1 (horizontal:
vertical) requirement. The slope at the rear of their property has been pulled back
to match the existing slopes on either side of their property. They were in the
process of landscaping all slopes, ahead of the deadline that I had established
with them.
It is my conclusion that the grading issues associated with 2434 Unicornio Street
have been satisfactorily been resolved, and no further action is required on their
part.

This letter is a follow-up to our first written oornplaint to the Oty of carlsbad, dated June 2,
2000.
As a brief explanation of the history of the situation, we began speaking to the owners at 2434
Uniromio in mid-1999, regarding the undermining of our block wall between the tv-o properties
by erosion and neglect of their hill.
December 1999, we met with Pete Dreibelbis, and the owner of the property to disruss our
roncems about the rontinuing erosion and removal of soil from the owner's hill. At that time, the
owner assured us that this would be taken care of during the landscaping phase.
In May of 2000, we noted landscaping OCOJrring. Soil that had existed on their hill was moved to
the rear (west view) of their property for lot enlargement and view enhancement
On June 2, 2000, we filed a written oornplaint to the Oty of carlsbad, regarding improper grading
on their property. On June 6, 2000, we met with you and Pete Dreibelbis to see the improper
grading existing at 2434 Uniromlo. On June 14, 2000, you sent a letter to the Radojevic's at
2434 Uniromio that they were in rode violation.
In our telephone conversation with you on June 29, we were assured the Gty v«>uld be doing a
physical inspection regarding rorrecting the rode violations.
To date, violatlons rontinue, scraping of soil from the adjoining hill rontinues and further, no soil
oornpaction has taken place.
Also, we are extremely roncemecl that eventual failure of our block wall adjoining the properties
will "beoorne a hazard to life and limb or to endanger property or to adversely affect the safe use
or stability or' our property.
When can we expect written ronfirmatlon from the Oty of cartsbad that oode violations will be

GRADING ORDINANCE VIOLATION OF PROPERTY LOCATED AT: 2434 UNICORNIO.
APN #215-250-0400.
It recently came to my attention that unapproved grading activity has occurred at the above referenced
property. I visited the site and determined that the grading of your property was conducted in violation of
the City's Grading Ordinance. I request that you contact me within the next two weeks to schedule a
meeting to work out a program to resolve the apparent violation.
Your work program will most likely require that you obtain a grading permit through normal City
procedures, or return your property's topography to its pre-existing condition. This may require the
processing of grading plans prepared by a Registered Civil Engineer as well as preparation of soils
reports. Frequently, this process will take in excess of three months. During the interim, your work
program may require temporary erosion control measures to protect the health, safety and welfare of the
public. You may be required to pay normal plancheck fees and to submit the regular security bonds.
However, since a violation has occurred, the grading permit fees may be twice the normal fee in
accordance with the requirements of the Grading Ordinance.
Please take note, failure to contact me within two weeks or to satisfactorily establish a program to mitigate
the violation within a reasonable period of time will result in the filing of a Notice of Grading Violation
against your property and in possible proceedings of nuisance abatement or misdemeanor violation or
both.
If you have questions regarding this matter or to schedule a meeting to establish a work program to
