' .... -. ~ ., C - ' . . . .. . , '- July 31, 1989 Community Development City of Carlsbad 2075 Las Palmas Drive Carlsbad, CA 92009 Dear Sir or Madam: We are requesting a Variance from the Building Cade ta allow completion of our pool. The pool was excavated, steeled and plumbed before it was discovered that one corner is 4 feet from the property line. The following describes the circumstances under which this occurred: The plans for the pool were designed according to the Plot Plan, and showed the pool 4 feet from a previously constructed framed stucco wall, which itself was 2 feet inside the property line. A visual inspection from the southwest corner of our property verified this location of the wall. Because there is a slope downward outside this wall, the plans and steel schedule submitted and approved on May 15, 1989 provide for a pool which could be essentially free standing. At the time of inspection of the gas and electric lines, our inspector Mike Peterson requested that we stake and string the property line far the next inspection to verify the proper setback. Because it was difficult to string a line between the two corner markers, our neighbor Lee Sawh, who is an experienced surveyor, surveyed the property line and determined that the wall actually bisects the property line (see attached drawing). Whereas the majority of the pool is 5 feet or greater from the property line, the eastern most corner of the pool is 4 feet from the property line (marked by star on drawing>. We have discussed the location of the pool with our neighbors the Sawhs, who own the adjacent lot (#61). They approve the location of the pool and support this application for a Variance. Because of the extenuating circumstances described above, we hereby request a Variance from the Building Code regarding pool setbacks to allow completion of our pool.
