HomeMy WebLinkAboutV 2024-0001; OHNSTAD RV VARIANCE; Admin Decision Letter Community Development Department Planning Division 1635 Faraday Avenue  Carlsbad, CA 92008-7314  442-339-2600 January 16, 2025 Luci Guthey Hoffman Planning Associates 5900 Pasteur Court, Suite 200A Carlsbad, CA 92008 SUBJECT: V 2024-0001 (DEV2024-0042) – OHNSTAD RV VARIANCE The City Planner has completed a review of your application for Ohnstad RV Variance, V 2024-0001, a Minor Variance located at 7323 Muslo Lane. After careful consideration of the circumstances surrounding this request, the City Planner has determined that the findings required for granting a Minor Variance to park a recreational vehicle (RV) in the front yard of private property can be made and therefore, APPROVES this request based on the following findings and conditions. Findings: 1. That parking in, or access to, the side or rear yard will require structural alteration to the existing residence in that requiring the RV to be parked in the side or rear yard pursuant to Carlsbad Municipal Code (CMC) Section 21.44.060, Table E, is not possible as it would require significant structural alterations to the residence. The dimensions of the RV are 7.5 feet wide by 24.83 feet long. Although the existing side yard setback is 10 feet to the northerly property line and 10 feet to the southerly property line, the two-foot eaves further reduce these dimensions. Additionally, solid masonry walls on both the north and south sides of the property would need to be removed. Therefore, it is not feasible to locate the RV in the side yard without significant structural and/or landscape alterations. 2. That parking in, or access to, the side or rear yard would require extensive grading to the side or rear yard in that it is not feasible to fit the 7.5-foot-wide RV in the side yards given the limited space between the existing single-family residence and the property lines or the significant amount of grading that would be required. The southerly side yard has a significant grade difference from the street and is thus not accessible unless significant grading is performed, and a new driveway is added. Therefore, it is not feasible to locate the RV on either of the side yards without significant structural and/or grading alterations. 3. That parking the recreational vehicle in the front yard will not interfere with visibility to or from Muslo Lane in that the subject property’s physical characteristics do not create inherent sight distance issues along the street. Additionally, the subject property’s existing driveway can adequately accommodate the 24.83-foot-long RV without encroaching into the sidewalk and public right-of- way. 4. That the recreational vehicle in the front yard will not interfere with traffic on the street or sidewalk or encroach into the street and utility right-of-way in that the driveway is of sufficient depth and {city of Carlsbad V 2024-0001 (DEV2024-0042) – OHNSTAD RV VARIANCE January 16, 2025 Page 2 Community Development Department Planning Division 1635 Faraday Avenue  Carlsbad, CA 92008-7314  442-339-2600 length to accommodate the RV without extending into the sidewalk or public right-of-way. As a result, street and sidewalk traffic will remain unobstructed. 5.That the City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15061(b)(3) of the state CEQA Guidelines – Common-Sense Exemption. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. Conditions: 1.The RV shall be parked in the front yard and completely within the private property at all times. 2.The RV is not considered a habitable structure when parked on the property and shall not be used in such a manner at any time. 3.When parked on the property, all “slide-outs,” “pop-ups,” awnings or similar features shall not be deployed and shall be kept in the “in” or “down” position in order to minimize the mass of the RV when parked on the property. 4.Approval is granted for V 2024-0001 as shown on Exhibit “A”, dated January 16, 2025, on file in the Planning Division and incorporated herein by reference. Development shall occur substantially as shown unless otherwise noted in these conditions. This decision may be appealed by you or any member of the public to the Planning Commission within ten days of receipt of this letter. Appeals must be submitted in writing to the Planning Division at 1635 Faraday Avenue in Carlsbad, along with a payment of $930.00. The filing of such appeal within such time limit shall stay the effective date of the order of the City Planner until such time as a final decision on the appeal is reached.
