F. PR0PERTY OWNER AFFIDAVIT. Before the application can be accepted. the owner of each property involved must provide a
signature to verify the 5B330 Streamline Application is being filed with their knowledge. Staff will confirm ownership
based on the records of the city or county assessor. In the case of partnerships, corporations, LLCs or trusts the agent
for service of process or an officer of the ownership entity so authorized may sign as stipulated below.
• Ownership Dlsclosure. Include current signature authorization for the person or persons signing the appicaUon.
For a corporation, a chairman, president or vice.president ANO a secretary, assistant secretary, CFO or assistant
treasurer must sign. Otherwise, the corporation must attach a resolution certified by the secretary or assistant
secretary under corporate seal empowering the offlc:er(s) signing to bind the corporation. For an LLC, attach an
official paper listing the individual as a Member of the LLC with sole authority to bind the organization. For a
partnership, attach an official document identifying the individual as a general partner with sole authority to execute
documents on behalf of the limited partnership. A letter of authorization, as described below, may be submitted
provided the signatory of the letter is included in the Ownership Disclosure. Include a copy of the current partnership
agreement, corporate articles, or trust document as applicable.
■ Letter of Authorization (LOA). A LOA from a property owner granting someone else permission to sign the SB 330
Streamline Application form may be provided if the property is owned by a partnership, corporation, LLC or trust or
in rare circumstances when an individual property owner Is unable to sign the SB 330 Streamline Application form.
To be considered for acceptance, the LOA must indicate the name of the person being authorized to file, their
relationship to the owner or project, the site address, a general description of the type of application being filed and
must also include the language in Items a--c below. In the case of partnerships, corporations, LLCs or trusts the LOA
must be signed by the authorized signatory as shown on the ownership Disclosure or, in the case of private
ownership, by the property owner. Proof of Ownership foe the signatory of the LOA must be submitted with said letter.
■ Grant Deed. Provide a copy of the Grant Deed if the ownership of the property does not match city or county assessor
records. The Deed must correspond exactly with the ownership listed on the application.
■ Multiple owners. If the property is owned by more than one individual (e.g. John and Jane Doe or Mary Smith and
Mark Jones) signatures are required of all owners.

on behalf of a partnership, corporation, LLC or trust as evidenced by the documents attached hereto.
b. I hereby consent to the filing of this SB 330 StreamUne Application on my property for processing by the City of
Carlsbad Planning Division for the sole purpose of vesting the proposed housing project subject to the zoning
ordinances, policies, and standards adopted and in effect on the date that this SB 330 Streamline Application
is deemed complete. Further, I understand that this SB 330 Streamline Application wm be terminated and vesting
will be forfeited If the housing development project is revised such that the number of residential units or square
footage of construction Ina-eases or decreases by 20 percent or more, exclusive of any increase resulting from
the receipt of a density bonus, incentive, concession, waiver, or similar provision, and/or an application
requesting approval of an entitlement is not filed with the City of Cartsbad Planning Division within 180 days of
the date that this SB 330 Streamline Application is deemed oomplete.

Department of Forestry and Fire Protection. ·1 his map demonstrates the geographical relationship of the
Very High Fire Ha;,ard Severity Zone to the location of the 4K Apartments property.
This map demonstrates that the Very High rire Ha/.ard Severity Zone overlaps the prope1ty boundary on
the edge of the north and east. This area is proposed to remain in mostly open space. The proposed
apartment housing will occur primarily within the area not identified as Very High Fire Hazard Severity
?one.

SB 330 Streamline Application

BIOLOGICAL REPORT
A Biological Report has been conducted for the property. This report (Planning Systems, April 2021)
included a a general biological resources reconnaissance survey, vegetation mapping, focused survey, and
a jurisdictional delineation.
This report concludes the following:
Species of Special Concern. Vegetation communities on the property include Diegan coastal sage scrub
and Southern mixed chaparral, both considered important habitats regulated by the Carlsbad I-IMP. No
~pccial-status plants were identified on-site during the vegetation mapping conducted in 20 l 6. Two
specimens ofNutall's scrub oak (Qucrcus dumosa) were identified offsitc (north of the site) within the
Southern mixed chaparral habitat. No special status ,vildlife species were observed.
Stream~ Creeks or Wetlands. A jurisdictional determination was performed for the extension of College
!1oulevard l\orth Segment. This ephemeral stream (Little Encinas Creek) exhibits clear bed and bank
characteristics and is tributary to <1 navigable body of water (Calavera Creek to Aguc1 1-ledionda Creek to
Agua Hedionda Lagoon), and thus is not "isolated". l\o hydrophytic vegetation, hydric soil or wetland
hydrology was observed within this streambed, and thus no jurisdictional wetlands arc present in this
location. Impacts to this non-wetland jurisdictional stream bed ,viii occur due to construction of the north
segment of College Boulevard. The babnce of the project does not impact any wetlands or waters of the
U.S. or State.
The jurisdictional delineation determined that a total of 0.12 acres of jurisdictional non-wetland waters of
the L.S. and State exist within the College Boulevard extension to Cannon Road and will thus be directly
impacted by construction of College Boulevard. These jurisdictional waters are associated with the
installation of a culvert under the roadway to accommodate drainage within existing Little Encinas Creek,
an ephemeral stream flowing from east to west, north of the apartment development site. No other
jurisdictional aquatic resources exist within the project area.
Attached is the Biological Report with attachments, including the plant and wildlife species observed on
the property, and the jurisdictional delineation.
