HomeMy WebLinkAboutCD 2024-0025; HIGHLAND VIEW HOMES; Admin Decision LetterJanuary 22, 2025 Jon Hurley 14583 Cherry St. Brighton, CO 80602 SUBJECT: CD 2024-0025 (DEV11036) -HIGHLAND VIEW HOMES {cityof Carlsbad The City Planner has completed a review of your application for a Consistency Determination, CD 2024-0025, which is a request to modify the design of the single-family home currently under construction for Lot 8 of CT 16-04/PUD 16-03/CDP 16-21/HDP 16-01. The modifications in the design include the addition of a 411-square-foot rooftop deck, exterior spiral stairs to access the deck and the conversion of an interior vaulted ceiling into an expanded loft on the upper floor, resulting in a 170-square-foot addition of habitable area to the home. The footprint of the home will not be changing as the addition is interior to the house. After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1} No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the site plan for CT 16-04 substantially conforms to the original approval and the design is consistent with a subsequent approved building permit entailing modifications to the elevations in design to the home approved on the subject lot. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that the improvements are consistent with the design of the home. 3) The proposed revision does not change the density or boundary of the subject property in that no units are proposed to be added or eliminated and the lot size has not changed; therefore, the density remains the same. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit. 5) The proposed revision does not rearrange the major land uses within the development in that the single-family use approved on Lot 8 is not changing. 6} The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that the maximum height of the single-family home remains Community Development Department Planning Division I 1635 Faraday Avenue I Carlsbad, CA 92008-7314 I 442-339-2600 CD 2024-0025 (DEV11036)-HIGHLAND VIEW HOMES January 22, 2025 Pa e 2 unchanged, the rooftop deck complies with the 24-foot maximum height for flat roofs, the addition of the roof deck represents a 1/8% change in roof area approved for the B- lot subdivision, and the interior addition represents a 4.4% increase in habitable living area for the 3,810-square-foot home. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation. 8} The proposed change would not result in any health, safety or welfare impacts. 9} There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change in that there were not any major issues or controversies with the eight-lot subdivision, CT 16-04/PUD 16-03/CDP 16- 21/HDP 16-01. 10} The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved in that the roof deck faces the private road for the development and the design complements the design of the home. Further, the addition will not be visible since it entails the conversion of an interior vaulted ceiling. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35. This decision may be appealed by you or any other member of the public to the Planning Commission within ten (10) days of the date of this letter. Appeals must be submitted in writing to the Planning Division at 1635 Faraday Avenue in Carlsbad, along with a payment of $930. The filing of such appeal within such time limit shall stay the effective date of the order of the City Planner until such time as a final decision on the appeal is reached.
