This section of the code conflicts with the recently approved Planned Development Ordinance which restricts parking to one side on streets thirty-two (32) feet wide. Section 10.40.035 of the Carlsbad Municipal Code reads as follows: 10.40.035 Parking prohibited on narrow streets. (a) The city traffic engineer is authorized to place signs or markings indicating no parking upon any street when the width of the roadway does not exceed twenty feet, or upon one side of a street as indicated by such signs or markings when the width of the roadway does not exceed thirty feet. (b) When official signs or marking prohibiting parking are erected upon narrow streets as authorized herein, no person shall park a vehicle upon any such street in violation of any such sign or marking. (Ord. 3005 §62). Ordinance No. 9823, an ordinance of the city Council of the City of Carlsbad, California amending Title 21, Chapter 21.45 of the Carlsbad Municipal Code to amend various provisions of the Planned Development regulations was passed and adopted on January 6, 1987 by the city Council. One of the provisions of the PD Ordinance is to restrict street parking to one side only for streets having a minimum width of thirty-two (32) feet. COMMISSION REPORT OF: (Continued) August 3·, 1987 ITEM NO. 6E City standards require public streets to have a minimum curb to curb width of forty (40) feet for local streets, thirty-six (36) feet for cul-de-sac streets and thirty- two (32) feet for hillside streets. No streets are currently being approved with a curb to curb width of thirty (30) feet. The Fire Department requires a minimum clear width of twenty (20) feet on the road for their fire fighting needs. A minimum parking lane width of eight (8) feet would necessitate a minimum street width of twenty-eight (28) feet to allow parking on one side of the roadway. Two side parking is not allowed unless the curb to curb width of a roadway is a minimum of thirty-six (36) feet wide. To clearly define parking requirements and to be consistent with City Standards and the PD Ordinance, Section 10.40.035 (a) should be changed to indicate one side parking for streets having a curb to curb width between twenty-eight (28) and thirty-five (35) feet. RECOMMENDATION: The Traffic Safety Coordinating Committee recommends that Section 10.40.035 (a) be amended to designate one side parking for streets having a width of twenty-eight (28) to thirty-five (35) feet. NECESSARY CITY COUNCIL ACTION: The city Council must approve an Ordinance amending Section 10.40.035 (a) of the Carlsbad Municipal Code to designate one side parking on streets between twenty- eight (28) and thirty-five (35) feet wide.
