The substantial conformance review consists of a minor modification to existing Conditional Use Permit, CUP-266(A)X2 CITY OF CARLSBAD (CALAVERA HILLS COMMUNITY PARK), a conditional use permit approved in 2000 for an approx. 16-acre community park located at 2997 Glasgow Dr., Carlsbad, CA 92010 (Assessor's Parcel Number: APN 167- 101-35) After careful consideration of the request, the City Planner has determined that the request meets the required findings of CMC Section 21.89.080 (effective outside the Coastal Zone on Aug. 20, 2024, by Ordinance CS-474) listed below and APPROVES this request. The proposed minor modifications include adding the following park amenities on approximately 15,000 sq. ft. of park area : • Four lighted regulation-size pickleball courts • Chain-link court fences • Sound attenuating barriers • Sports safety netting • Spectator bleachers {26 seats) • Shade structures • Walkways • Walkway bollard and pole lighting • Staircases and railings • ADA accessible ramp • Memorial Park benches, receptables and drinking fountains • Perimeter landscaping The proposed minor modifications also include removing the following: • Turf • Ornamental trees1 (each tree will be replaced with two new trees) 1 No sensitive habitat or heritage trees listed in the 2019 Community Forrest Plan will be removed. Community Development Department Planning Division / 1635 Fa raday Avenue I Carlsbad, CA 92008-7314 I 442-339-2600 CD 2025-0002 (PUB2025-0002)-CALAVERA HILLS COMMUNITY PARK PICKLEBALL COURTS February 26, 2025 Pa e 2 The following findings must be made for a project revision to be determined to be consistent with an approved discretionary action pursuant to CMC Section 21.89.080: 1) That the proposed revision provides an architectural style of development that is substantially consistent with the building forms, building colors, and building materials that were approved as part of the authorizing discretionary action, in that the proposed modifications to develop four pickleball courts and associated park improvements are substantially similar in the design to the existing tennis courts and other existing park amenities in terms of function, colors and materials. 2) That the proposed revision complies with all relevant development standards and design criteria and will not result in any health, safety, or welfare impacts, in that as discussed in Finding No. 3 and 4 below, the proposed revision will comply with all relevant development standards and design criteria and that the proposed pickleball courts and associated improvements will transform an underutilized portion of the park into active recreational space which would not result in any health, safety or welfare impacts. In fact, providing additional recreational activity courts may improve physical and mental health outcomes for the communities they serve. 3) That the proposed revision is consistent with the density, intensity, or use from what was approved as part of the authorizing discretionary action, in that the pickleball courts and associated improvements would not change the density or expand beyond the footprint of the established 16-acre community park. The proposed revision will occupy 15,000 sq. ft. of a previously unprogrammed portion of the park. The community park use was originally approved under the Calavera Hills Master Plan {MP- 150(A)) and corresponding Environmental Impact Report (EIR-403) in 1978. It allowed the community park to include recreational uses such as baseball/multipurpose fields, community center, play area, tennis courts and hard courts. The Calavera Community Park was approved Jan. 23, 1985, under Conditional Use Permit CUP 266 via Planning Commission Resolution No. 2409. Under both the EIR and CUP 266, no parking requirements were established. Moreover, based on the expertise of the Parks and Recreation Department staff, who manage the Calavera Hills Community Park as well as the existing pickleball courts at Poinsettia Park, the introduction of four new pickleball courts will result in only a minor increase in parking demand as compared to the other uses already on site. The parking analysis provided in Table 1 below is provided to articulate the parking demand for the existing uses and the proposed pickleball courts. These parking standards are derived from similar facilities and/or historical parking usage trends, but as mentioned above, are not adopted standards or minimums for Calavera Hills Community Park -they are presented here for evaluation purposes only. Parking spaces available following the -5 n/a completion of the four pickleball courts and associated park amenities Notes: 1Review of the most recently approved Poinsettia Community Park Pickleball Courts {CD 2023-0004}, which calculated the required parking for the community center, multi-sport fields with seating, tot lot and pickleball courts 2Per Carlsbad Municipal Code {CMC} section 21.44.030, where the parking requirements for a use are not specifically defined herein, the parking requirements for such use shall be determined by the city planner. 3Parks and Recreation Department's Community Park Inventory 4Parks and Recreation Department's proposal Using the above parking demand estimates, the community park could be considered under- parked by approximately five spaces (or meeting approximately 97% of parking demand) with the addition of the four pickleball courts and seating for 52 spectators. Under real world circumstances the parking demand would not likely reach capacity as the park is situated adjacent to residential development, and as such, many visitors will be residents that will walk or bike to the park. Parks and Recreation sports programming will also help to deconflict overlapping special events and ensure that visitors are only allowed at the park during park hours. lastly, in the event that the parking lot reaches full capacity, overflow parking is available on-street along both sides of Glasgow Drive. The park operator can manage the community park's programming, monitor real time parking impacts and can make adjustments as necessary if parking demand impacts the public road network. Based on this analysis, the addition of the four picklt::ball courts and associated improvements would be consistent in terms of density, intensity and use from what was approved as a part of the authorizing discretionary action. 4) That the proposed revision is minor and authorizes a deviation or deviations of no more than 10 percent, provided that it is consistent with the authorizing discretionary action and maintains compliance with all relevant development standards, in that the proposed pickleball courts are consistent in use and construction type to previously approved recreational facilities at the park and that the proposed project affects less than 10% of the park area {2.1% of the 16-acre Community Development Department Planning Division I 1635 Faraday Avenue I Carlsbad, CA 92008-7314 I 442-339-2600 CD 2025-0002 (PUB2025-0002) -CALAVERA HILLS COMMUNITY PARK PICKLEBALL COURTS February 26, 2025 Pa e 4 Calavera Community Park site), and therefore is consistent with the authorizing discretionary action and in compliance with all relevant development standards. 5) That the proposed revision maintains, in their entirety, all the project conditions required as part of the authorizing discretionary action as approved by Planning Commission Resolution No. 4849 dated November 1, 2000. 6) That the proposed revision is consistent with the previously evaluated environmental findings and will not result in any significant environmental impact, and/or require further environmental review in that on July 31, 1978, the City Council certified the Environmental Impact Report {EIR 403} for the Calavera Hills Community Park. The project is within the scope of the prior environmental document and no further environmental documentation is required per CEQA Guidelines Section 15162. All applicable mitigation measures contained in the prior environmental document have either been satisfied previously and/or were made conditions of approval of the project's approved conditional use permit {CUP 266Ax2}. The certified environmental impact report and mitigation measures are on file for review at the Planning Division. 7) That the. proposed revision is consistent with the standards set forth in the Village and Barrio Objective Design Standards or the Citywide Objective Design Standards, as applicable, in that the proposed project does not propose multifamily development and therefore the Village and Barrio ODS and Citywide ODS for multifamily development projects are not applicable to this substantial conformance review. Therefore, the City Planner has determined that the application qualifies for a substantial conformance with the approved permit and approves the changes to the project pursuant to CMC Section 21.89.060. You have 90 days from the date of final approval to protest imposition of these fees/exactions. If you protest them, you must follow the protest procedure set forth in Government Code Section 66020{a), and file the protest and any other required information with the City Manager for processing in accordance with Carlsbad Municipal Code Section 3.32.030. Failure to timely follow that procedure will bar any subsequent legal action to attack, review, set aside, void, or annul their imposition. This decision may be appealed to the Planning Commission within ten days of the date of this letter. Appeals must be submitted in writing to the Planning Division at 1635 Faraday Avenue in Carlsbad, along with a payment of $930. The filing of such appeal within such time limit shall stay the effective date of the order of the City Planner until such time as a final decision on the appeal is reached.
