On October 26, 1971, a Conditional Use Permit was granted to allow a
nursing home to be built on the southwest corner of Carlsbad Blvd. and
Grand Avenue. The C.U.P. expired on October 26, 1972 and the applicant,
California Lutheran Homes, has reapplied for a C.U.P. in order to re-
activate the permit. The proposal is identical to the one approved
in 1971.
The property is presently zoned C-2 with a C.U.P. required for the pro-
posed facility per Section 21.42.010 of the Carlsbad Municipal Code.
The proposed structure will be an adjunct to the California Lutheran
Home facility across the street to the north. It is proposed to be one-
story and have the capability of providing for 59 long-term patients.
Parking accommodations will be provided on-site with the entrance to the
parking area off Garfield Street to the west,and off Grand Ave.to the north.
The applicant proposes to landscape and design the proposed facility so
that it will not be in conflict with the development of the adjacent
properties and neighborhoods.
The applicant has complied with the requirements of the "City of Carlsbad
Environmental Protection Ordinance of 1972" and the project has been
determined to have a "non-significant" impact on the environment.
It should be noted that the area is sewered by the Ocean Street sewer
which is inadequate. The addition of this higher density development
could severely overload the existing system. Water supply in this area
is adequate.
Recommendations:
The staff recommends approval of the subject application for the following
reasons and subject to the 'following conditions:

1. The proposed development will not be detrimental to the surrounding
properties.

2. The proposed structure will add appreciably to the aesthetic
character of the neighborhood and serve a definite need in the ~om-
munity.
3. All requirements set by City Ordinances have been satisfied.
Conditions of Approval:
1. All fire protection procedures shall be developed in accordance
with Title 19 and U.F.C., Section 1330.
2. Fire hydrants shall be placed as required by the City Fire Chief.
3. A landscape and irrigation plan shall be submitted to the Parks &
Recreation Director for approval.
4. The proposed facility shall be constructed in general conformance

5. Full street improvements in accordance with the subdivision ordi-
nance shall be constructed on all street frontages except on Carlsbad
Blvd.; pavement is not required. •
6. Street improvement plans ·shall be prepared by a registered civil
engineer and shall be approved by the City Engineer.
7. Street lights shall be installed in accordance with requirements
set by the City Engineer.
8. The applicant shall enter into an agreement with· the City to provide
increased sewer capacity in Ocean Street or establish an alternative
system.
9. No occupancy shall be permitted until adequate sewer capacity, as
determined by the City Engineer, is available.
