FOR REVISION OF SIDE YARD SETBACKS APPLICABLE TO THE R-A, R-1 AND R-2 ZONING DISTRICTS PURPOSE OF PROPOSED AMENDMENT - Recently the Planning Department Staff has been confronted with developmental proposals which ha~e attempted to provide storage facilities for recreational vehicles in the rear yards of single family dwellings. However, due :to a strict aoplication of the side yard setback requirements of the R-A, R-1 and R-2 Zoning Districts, as applied to minimum lot widths, adequate vehicular access to the rear yards was prohibited. The Planning Department recognizes that the contemporary recreational trends embrace the utilization of a variety of off-the-road vehicles. The storage of these vehicles is becoming a critical problem due to limited access to the rear yards of single-family dwellings. There- fore, the Planning Department is of the opinion that the side yard requirements of the R-A, R-1 and R-2 zoning districts should be .revised to the extent that under certain specified conditions suffi- cient flexibility is achieved to accommodate rear yard storage of recreational vehicles and appurten~nces. In addition, the proposed side yard revision would provide more flexibility in site plan design, whereby, garages could be placed in the rear yards, thus providing a more efficient use of land. EXISTING SETBACK REQUIREMENT - The Municipal Code currently requires that the side yard setback on each side of a lot be equal in width to ten percent of the lot front- age. However, the minimum width of the side yard must be five feet and it need not exceed ten feet. For example, if a lot has a width of 75 feet, each side yard must be a minimum of seven and one-half feet wide. This, of course, is not sufficient room to accom~odate vehicular access to the rear yard. PROPOSED SETBACK REVISION - The proposed setback revisipn will enable the Director of Planning to approve a site plan which attempts to provide rear yard access for vehicles, in the event that the plan meets the minimum yard require- ments. RECOMMENDATION - The Planning Department recommends that the Planninq Commission adopt Resolution Number • to a.mend THle .21 of the Planning Departmer Report January 9, 1973 Side Yard Setbacks Carlsbad Municipal Code ~roviding for rev1s1ons of the side yard setbacks in the R-A, R-1 and R-2 Zoning Districts. TO BE REVISED TO READ AS FOLLOWS: Side Yards. In the R-A, R-1 and R-2 Zone every lot shall have side yards as follows: (a) ( b ) DAA: le Interior lots shall have the following side yards: (1) A side yard shall be provided on each side of the lot which side yard has a width equal to ten percent of the lot width; provided, ·that such side yard shall not be less than five feet in width and need not exceed ten feet, (2) The Director of Planning may approve a reduction in width of one side yard provided that the opposite side yard is increased in width by an amount equal to the reduction. The reduced side yard shall not be less than five feet in width nor shall it abut a lot or parcel of land with an adjacent reduced side yard, nor shall the increased side yard have a width of less than ten feet. Corner lots and reversed corner lots shall have the following ~ide yards: (1) On the side lot line which adjoins another lot, the side yard shall be equal to ten percent of the lot width; provided that such side yard shall not be less than five feet in width and need not exceed ten feet, (2) On the side street side, the width of the required side yard shall be ten feet and such side yard shall extend the full length of the lot. ~\)J) 0_0~---· DONALD A. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDING THAT THE CITY COUNCIL ADOPT AN AMENDMENT TO TITLE 21, OF THE MUNICIPAL CODE, PRO- VIDING FOR REVISIONS OF THE SIDE YARD SETRACKS APPLICABLE TO THE R-A, R-1 AND R-2 ZONING DISTRICTS 5 11------------------------------------l 6 WHEREAS, the Planning Commission of the City of Carlsbad 7 adopted Resolution of Intention No. 88, declaring its intention to 8 hold a public hearing on January 23, 1973, relative to revision of 9 the side yard setbacks applicable to the R-A, R-1 and R-2 Zoning 10 District, and, 11 WHEREAS, pursuant to the provisions of Title 21 of the 12 Carlsbad Muni~ipal Code, the Planning Commission did on January 23, 13 1973, hold a duly noticed public hearing to consider the following 14 amendment to Title 21 of the Municipal Code: 15 1. Title 21, Chapter 21.08, Section 21.08.040 16 TO BE REVISED TO READ AS FOLLOWS: 17 21.08.040 Side Yards. In the R-A Zone every lot shall have side 18 yards as follows: 19 20 21 22 .23 .24 25 26 27 28 29 30 31 32 (a) Interior lots shall have the following side yards: (1) A side yard shall be provided on each side of the lot which side yard has a ~idth equal to ten percent of the lot width; provided, that such side yard shall not be less than five feet in width and need not exceed ten feet, (2) The Director of Planning may approve a reduction in width of one side yard provided that the opposite side yard is increased in width by an amount equal to the reduction. Title 21, Chapter 21.12, Section 21.12.040 12 TO BE REVISED TO READ AS FOLLOWS: 13 21.12.040 Side Yards. In the R-2 Zone the side yards shall be 14 the same as the R-A Zone as provided in Section 21.08.040. 15 WHEREAS, at said public hearing, upon hearing and considering 16 the testimony and arguments, (if any) of all persons who desired 17 to be heard, said Commission did find the following facts and 18 reasons to exist which make the approval of an amendment to Title 19 21, Sections 21.08.040, 21.10.040 and 21.12.040 necessary to carry 20 out the provisions mentioned above: 21 22 23 24 25 26 27 28 1. Access to rear yards of single family dwellings can be accommodated to facilitate off-street parking and storage of recreational vehicles. 2. The intent of providing vehicular access to the rear yard for the storage of recreational equioment is in con- formance with City goals and rolicies relative to single- family residential development. 3. The herein stated ordinance revision is in the best 29 interest of the citizens of Carlsbad. 30 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of 31 the City of Carlsbad that it does hereby recommend to the City 32 Council the adoption of the herein described amendment to the ( 3 ) 1 Carlsbad Municipal Code, Title 21. 2 AND FINALLY RESOLVED, that a copy of this Resolution .be 3 forwarded to the City Council for its attention in the manner 4 prescribed by law. 5 PASSED, APPROVED AND ADOPTED at a regular meeting 6f the 6 Carlsbad City Planning Commission held on the 23rd day of January, 7 1973, by the following vote, to wit: 8 AYES: 9 NOES: 10 11 12 ABSENT: 13 ATTEST: 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 EDMOND W.
