INITIATED BY: City Councilmember Larson REQUESTED ACTION: Establish a prima facie speed limit on northbound Carlsbad Boulevard between a point one-thousand feet south of Manzano Drive northerly to Manzano Drive. BACKGROUND: At the April 18, 1989 City Council meeting Councilmember Larson requested that staff investigate and establish a prima facie speed limit upon Carlsbad Boulevard in the northbound curved segment located under Palomar Airport Road. Ordinance No. 3115 adopted by the City Council on October 2, 1979 establishes a 35 mile per hour prima facie speed limit for both directions on Carlsbad Boulevard between Manzano Drive and a point 1,000 feet south of Manzano Drive. The subject segment of Carlsbad Boulevard is included within the designated limit established in Ordinance No. 3115. In addition, Ordinance No. 3115 established a prima facie speed limit of 45 miles per hour upon Carlsbad Boulevard from 1,000 feet south of Manzano Drive to the south boundary of the City of Carlsbad. DATA: A ball bank study was conducted for northbound Carlsbad Boulevard in the curve under the Palomar Airport Road overcrossing. The results determined a comfortable driving speed of 44 miles per hour. A speed survey found northbound traffic at a point 200 feet south of the PAR overcrossing had a critical speed of 55 miles per hour and for southbound traffic the critical speed 200 feet south of PAR was determined to be 45 miles per hour. In the past, there have been several collisions due to excessive speed and the vehicle not being able to negotiate the curves when travelling northbound on Carlsbad Boulevard under Palomar Airport Road. At this location, the road begins to transition from two northbound lanes to one lane, with proper signing installed. The Traffic Safety Coordinating Committee (TSCC) recommended that the 35 mile per hour zone be extended southerly an additional 400 feet from the limits established by Ordinance No. 3115. Reasons cited by the Committee were the lane reduction, the 35 mile per hour zone on Carlsbad Boulevard northerly of Palomar Airport Road, the reversing curve on northbound Carlsbad Boulevard and the merging condition of northbound Palomar Airport Road and Carlsbad Boulevard. During research of this issue staff discovered a discrepancy between the posted speed limit for Carlsbad Boulevard beginning 1,000 feet south of Manzano Drive and continuing to the south City limit and the prima facie speed limit established by Ordinance No. 3115. The speed limit established by ordinance is 45 miles per hour yet the speed limit that has been posted for a number of years is 55 miles per hour. Realistic speed zoning is necessary to facilitate the orderly movement of traffic volumes and satisfy the requirements of the California Vehicle Code. CITY OF CARLSBAD TRAFFIC SAFETY COMMISSION STAFF REPORT COMMISSION REPORT OF: August 7, 1989 (Continued) ITEM NO._@_ Although Carlsbad Boulevard is posted at the maximum speed limit of 55 miles per hour, Section 22350 of the California Vehicle Code, Basic Speed Law, states "No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property." This section would apply to vehicles travelling at a high rate of speed as well as those vehicles travelling at a slower rate, such as in adverse weather conditions or stop and go traffic. The law establishes prima facie speed limits under certain conditions, as indicated in CVC Section 22352. A mechanism to increase or decrease the prima facie speed limit is proved in Sections 22357 and 22358 of the California Vehicle Code. Each of these sections require that an engineering and traffic survey be conducted. A prima facie speed limit is the maximum speed that is deemed lawful unless competent evidence is presented that shows that a higher rate of speed is safe. Carlsbad Boulevard is designated as a Major Arterial in the Circulation Element of the General Plan. This designation provides for a design speed of 50 miles per hour and is a roadway classification expected to carry traffic volumes in the range of 20,000 to 40,000 vehicles. The existing roadway south of Manzano Drive is a four-lane divided facility with access at various locations. On-street parking is not allowed except on the westerly side of the southbound lanes near Palomar Airport Road and near La Costa Avenue. Bicycle lanes have been striped on the roadway for northbound and southbound bicycle traffic as a result of Carlsbad Boulevard being designated as a bike route in the Circulation Element of the General Plan. This coastal route is heavily used by bicyclists. From Manzano Drive to the south City limit Carlsbad Boulevard follows a relatively straight alignment, except for northbound Carlsbad Boulevard under the Palomar Airport Road overcrossing. At this location, the curve for Carlsbad Boulevard is constructed with a radius of approximately 590 feet. Traffic signals have been installed at the intersecting streets of Poinsettia Lane and La Costa Avenue, although La Costa Avenue is several hundred feet southerly of the Carlsbad south City limit boundary. The collision history on Carlsbad Boulevard south of Manzano Drive is indicated on the attached summary sheets. This information is for the time period of January 1, 1986 through May 1, 1989. Of the 63 intersection and midblock collisions that occurred during this time period, 28 have a contributing factor of exceeding the safe speed for the roadway. Two-way traffic volumes on Carlsbad Boulevard are higher on the northerly segment of the road, with the highest volumes in the vicinity of Elm Avenue. A February 1989 count on Carlsbad Boulevard south of Poinsettia Lane indicated a 24 hour A.D.T. of 10,300 vehicles total, for both directions. Speed surveys were conducted on Carlsbad Boulevard in May 1989 and are summarized below. Although sight distance is good, many other factors not apparent to the driver could be cited to justify a prima facie speed limit lower than 55 mile per hour. The vicinity of the beach to Carlsbad Boulevard generates pedestrian activity, heavy bicycle use and vehicles that park along various segments of the roadway. The State Parks and Recreation camping facility at Poinsettia Lane generates tourist visits and consequently individuals not familiar with the area or circulation system. Access to Carlsbad Boulevard is permitted in many locations with some illegal turn occurring from the median area. As stated earlier, speed is a factor in many collisions and when combined with driver inattention due to the scenic nature of this coastal route and other reasons the potential for traffic collisions can increase. Based upon the above factors, the TSCC can recommend that a prima facie speed limit of 50 miles per hour be established on Carlsbad Boulevard from a point 1,400 feet south of Manzano Drive and continuing to the south City limit. This would be an increase of 5 miles per hour over the existing 45 mile per hour prima facie speed limit established by Ordinance No. 3115. The existing prima facie speed limit is not supported by the results of the traffic and engineering survey. RECOMMENDATION: By a 4-1 vote the Traffic Safety Coordinating Committee recommends that the existing 35 mile per hour prima facie speed limit be extended 400 feet southerly to a distance 1,400 feet southerly of Manzano Drive and that the existing 45 mile per hour prima facie speed limit on the southerly segment of Carlsbad Boulevard be raised to 50 miles per hour beginning 1,400 feet south of Manzano Drive and continuing to the south City limits. NECESSARY CITY COUNCIL ACTION: A new ordinance will need to be adopted by the City Council to revise the existing prima facie speed limits established by Ordinance No. 3115.
