REQUESTED ACTION:
BACKGROUND:
Establish a 45 mile per hour prima fade speed limit upon
College Boulevard from Palomar Airport Road to El Camino
Real.
College Boulevard is designated as a major arterial on the Circulation Element of
the City of Carlsbad. No prima fade speed limit has been established on College
Boulevard and an engineering and traffic survey is required to establish the prima
fade speed limit. In the absence of a posted speed limit, Section 22349 of the
California Vehicle Code (CVC), Maximum Speed Limit, prevails. In the existing
situation this would be a maximum speed limit of 55 miles per hour.
Section 22350 of the California Vehicle Code, Basic Speed Law, states "No person
shall drive a vehicle upon a highway at a speed greater than is reasonable or
prudent having due regard for weather, visibility, the traffic on and the surface and
width of, the highway, and in no event at a speed which endangers the safety of
persons or property." This section would apply to vehicles traveling at a high rate
of speed as well as those vehicles traveling at a slower rate, such as in adverse
weather conditions or stop and go traffic.
The law establishes prima fade speed limits under certain conditions, as indicated
in CVC Section 22352. A mechanism to increase or decrease the prima fade speed
limit is provided in Sections 22357 and 22358 of the California Vehicle Code. Each
of these sections require that an engineering and traffic survey be conducted. A
prima fade speed limit is the maximum speed that is deemed lawful unless
competent evidence is presented that shows that a higher rate of speed is safe.

DATA:
College Boulevard is a four-lane, divided roadway approximately one and one-half
miles in length that follows a curvilinear alignment between Palomar Airport Road
and El Camino Real. Concrete sidewalks, a raised landscape median and street
lights were constructed as part of the project. The design speed for a major
arterial is SO miles per hour. Although construction of the roadway was completed
several years ago and traffic was permitted to travel between Aston Avenue and
El Camino Real, the portion of College Boulevard between Palomar Airport Road
and Aston Avenue was only opened to traffic in October 1989 when Palomar
Airport Road improvements were completed.
College Boulevard is controlled by traffic signals at Palomar Airport Road and El
Camino Real. At this time, Faraday Avenue and Aston Avenue are the only two
streets intersecting College Boulevard and both are controlled by STOP signs. A
traffic signal will be installed at the intersection of Faraday Avenue and College
Boulevard by March 1990.
A traffic count was counted on College Boulevard on November 15, 1989 with the
results shown below on Table 1.

indicated on Table 2.

No traffic collisions have been reported on College Boulevard in the short amount
of time that it has been opened to traffic between Aston Avenue and El Camino
Real and between Palomar Airport Road and Aston Avenue.
RECOMMENDATION:
Based upon the results of the engineering and traffic survey, the Traffic Safety
Coordinating Committee recommends a prima fade speed limit of 45 miles per
hour upon College Boulevard.
NECESSARY CilY COUNCIL ACTION:
An ordinance will need to be adopted by the City Council to establish the
recommended prima fade speed limit.
