REQUESTED ACTION: Establish a prima facie speed limit on Palomar Airport Road
from El Camino Real easterly to the City limits.
BACKGROUND:
Palomar Airport Road is designated as a prime arterial on the City of Carlsbad
Circulation Element. No prima facie speed limit has been established on the subject
segment of Palomar Airport Road. A traffic and engineering survey is required to
establish a prima facie speed limit. In the absence of a posted speed limit, Section
22349 of the California Vehicle Code (CVC), Maximum Speed Limit, prevails. In
the existing situation this would be a maximum speed limit of 55 miles per hour.
Section 22350 of the California Vehicle Code, Basic Speed Law, states "No person
shall drive a vehicle upon a highway at a speed greater than is reasonable or
prudent having due regard for weather, visibility, the traffic on, and the surface and
width of, the highwa>7, and in no event at a speed which endangers the safety of
persons or property.' This section would apply to vehicles travelling at a high rate
of s2eed as well as those vehicles travelling at a slower rate, sucli as in adverse
weather conditions or stop and go traffic.
The law establishes prima facie speed limits under certain conditions, as indicated
in CVC Section 22352. A mechanism to increase or decrease the prima facie SQeed
limit is provided in Sections 22357 and 22358 of the California Vehicle Code. Each
of these sections require that an engineering and traffic survey be conducted. A
prima facie speed limit is the maximum speed that is deemed lawful unless
competent eviaence is presented that shows that a higher rate of speed is safe.
DATA:
From El Camino Real to the easterly City limits, a distance of approximately 2.2
miles, Palomar Airport Road follows a curvilinear alignment with limited sight
distance in some locations. One lane is constructed in the eastbound direction. For
westbound traffic, there is one lane from the easterly City limit boundary for a
distance of approximately one mile where two westbound lanes are then provided.
At this point and continuing westbound there is a wide, painted median island.
Three streets intersect Palomar Airport Road within the subject limits, all on the
northerly side. Loker Avenue West located approximately 0.25 miles easterly of
El Cammo Real, is a right tum in, right tum out only "T" intersection and controlled
QY a STOP sign. El Fuerte Street is a signalized intersection 0.80 miles easterly of
El Camino Real. Loker Avenue East, a "T" intersection approximately 1.1. miles
easterly of El Camino Real has not been opened to public travel at this time and
will be controlled by a STOP sign. Streets hghts are installed on the northerly side
of PAR from El Camino Real to Loker Avenue East.
The Average Daily Traffic (A.D.T.) on Palomar Airport Road easterly of El Camino
Real is 23,000 veliicles total for both directions. A recent speed survey on Palomar
Airport Road found the critical speed at Loker Avenue West and Loker Avenue
East to be 55 and 54 miles per hour, respectively.

In the past three years 1986 -1988, there have been 48 reported collisions on PAR,
with 26 of the collisions being attributed to exceeding the safe speed. Of the five
intersection collisions in the past three years, two were a result of exceeding the safe
speed.
RECOMMENDATION:
As a result of the existing roadway features and geometric~ traffic volumes, collision
history and the critical speed, the Traffic Safety coordinating Committee
recommends that a prima facie s_peed limit of 45 miles per hour be established on
Palomar Airport Road from El Camino Real to the easterly City limits.
NECESSARY CITY COUNCIL ACTION:
An ordinance will be required to be adopted by the City Council to establish the
prima facie speed limit, as recommended:
