HomeMy WebLinkAboutCD 2025-0004; TIMM RESIDENCE; Admin Decision Letter Community Development Department Planning Division 1635 Faraday Avenue  Carlsbad, CA 92008-7314  442-339-2600 March 13, 2025 Don Looney 2945 Harding St. #211 Carlsbad, CA 92008 SUBJECT: CD 2025-0004 (DEV2023-0033) – TIMM RESIDENCE The City Planner has completed a review of your application for a Consistency Determination, CD 2025- 0004, which is a modification to CDP 2023-0011/SDP 2024-0010, a Coastal Development Permit and Site Development Plan to demolish a single-family dwelling and to construct three, one-family dwellings with three attached garages including one subterranean garage, a pool patio and a pool and spa at 314 Date Avenue (APN 206-080-24-00). The original project, CDP 2023-0011/SDP 2024-0010, was approved by the Planning Commission on June 19, 2024, pursuant to Planning Commission Resolution No. 7515. After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. The proposed modifications include: • Increase the height of Unit 2 by one foot (12 inches) from 21 feet, 10 inches to 22 feet, 10 inches. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project’s design, quality, safety or function in that no changes are proposed to the footprint of the building. The floor plans and proposed use, consisting of the pool cabana on the first floor and living area on the second floor, will remain the same. The proposed change are limited to the height. 2) The request represents an upgrade in overall design features and or materials and improves upon the project’s compatibility with the surrounding neighborhood in that the new height of 22 feet, 10 inches will not exceed the maximum building height of the Residential Density-Multiple and Beach Area Overlay Zone of 30 feet, and no changes to the design are proposed. Therefore, the structure will remain compatible with the other proposed units on site as well as with the surrounding neighborhood. 3) The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit. {city of Carlsbad CD 2025-0004 (DEV2023-0033)-TIMM RESIDENCE March 13, 2025 Pa e 2 5) The proposed revision does not rearrange the major land uses within the development in that no changes to the footprint of the building are proposed. 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that the increase in height form 21 feet, 10 inches to 22 feet, 10 inches will result in a 4.6% increase in height. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation. 8) The proposed change would not result in any health, safety or welfare impacts. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10} The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved in that the revisions to the height of Unit 2 are minor in nature. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35. This decision may be appealed by you or any other member of the public to the Planning Commission within ten days of the date of this letter. Appeals must be submitted in writing to the Planning Division at 1635 Faraday Avenue in Carlsbad, along with a payment of $930. The filing of such appeal within such time limit shall stay the effective date of the order of the City Planner until such time as a final decision on the appeal is reached.
