REQUESTED ACTION: Study the subject intersection to determine remedial actions to
be initiated to prevent a vehicle from driving into private
property or private structures.
BACKGROUND:
DATA:
On December 13, 1991 at 2:10 A.M., a driver proceeding westbound on Cannon
Road failed to negotiate a turn onto Carlsbad Boulevard and continued westerly
across the intersection. According to the Police Department report the driver of the
vehicle drove through heavy vegetation and a cyclone fence/block wall on the westerly
side of Carlsbad Boulevard and into a two room cottage, heavily damaging two of the
walls. After the collision with the cottage the vehicle continued and collided with a
wooden fence before stopping approximately 50 feet from the initial point of impact.
The investigating police officer recommended that the District Attorney review the
case for violations of CVC Sections 23152(a) and 14601, driving under the influence
of an alcoholic beverage or any drug and driving when the driving privilege is
suspended or revoked for reckless driving.
On February 19, 1992 staff received a letter from Morna Bowman Rouse, the
attorney for Pasquale Buono, owner of the house damaged by the vehicle. Available
records indicate that Mr. Buono purchased the house in 1990. Ms. Bowman has
requested that remedial actions be initiated by the City of Carlsbad so as to prevent
this type of collision from occurring in the future.
Both Carlsbad Boulevard and Cannon Road are designated as major arterials on the
Circulation Element of the General Plan of the City of Carlsbad. Cannon Road has
three lanes at the intersection of Carlsbad Boulevard. Carlsbad Boulevard at this
location is a two lane roadway with a southbound left-tum lane provided.
Intersection geometrics are indicated on Exhibit 1, attached. This intersection is a
"T" intersection controlled by a traffic signal. For westbound vehicles, two traffic
signal indications are visible to the driver.

A recent traffic count indicates a daily volume entering the intersection of 15,562
vehicles, as shown on Table A. In comparison to the total entering volume, Cannon
Road traffic volumes represent approximately 13 % of the total number of vehicles
entering the intersection.
The requested action was initiated as a result of a collision from a driver operating a
vehicle . while under the influence. Staff researched the collision history for this
intersection from data contained in the files of the Transportation Division. Collision
diagrams for the time period January 1, 1983 to December 31 , 1991 are provided. A
review of these diagrams indicate that no similar collisions occurred during the past nine
years at the intersection although several vehicles on Carlsbad Boulevard have been
involved in run off the road collisions involving bushes or parked vehicles. No other run
off the road collisions into a dwelling structure were reported in the vicinity of the
Carlsbad Boulevard/Cannon Road intersection.
A hazardous location, or a problem location, can be characterized as one that presents
a risk to the driver in terms of the high probability of a collision occurring or one having
high accident severity. Collision records alone may not be an indication of the risk. A
review of the intersection itself must be undertaken to determine the high collision
potential, in absence of collision records.
In general, a high collision location is defined as a location that experiences abnormal
frequencies, rates or severities of collisions. The collision experience may be a result
of:
• random occurrence
• high traffic volumes
• high collision rate
• high accident severity
The Engineering Department compiles a list of high collision intersections on an annual
basis. Fortunately, the Carlsbad Boulevard/Cannon Road intersection had a very low
number of collisions in 1991 and was not on the high collision list for intersections.

A collision may be expected to occur if an intersection has poor design features or
other types of hazards exist at the intersection, such as:
• poor sight distance
• substandard horizontal curve
• bad intersection angle
• intersection on curve
• roadside obstacles
A review of the intersection indicates a standard "T" intersection with no sight
distance deficiencies. A traffic signal at the intersection provides good visibility to the
driver to indicate the assignment of right of way. A W41 sign (Intersection Ahead
Symbol Sign) and SIGNAL AHEAD pavement legend has been placed on each leg
of the intersection in advance of the intersection to warn drivers of the signalized
intersection.
Existing objects near a road, or objects placed near the roadway, can be hazardous
for the following reasons:
• fixed objects of sufficient mass can cause injury when struck by an out-
of-control vehicle
• sight distance may be blocked at an intersection
Attempts are made to keep areas adjacent to a road clear of fixed objects. For
instance, power poles along Carlsbad Boulevard in the Cannon Road vicinity have
recently been undergrounded. If an object cannot be removed or relocated, the only
other practical alternative may be to shield the object, such as by installing some type
of crash attenuator or guardrail.
The subject house currently is shielded to a limited degree by dense vegetation
growing along Carlsbad Boulevard. A block wall/cyclone fence installed on private
property also has provided a limited amount of protection.

Guardrails and/or other barriers are, in themselves, a roadside hazard and should
only be used to shield an out-of-control vehicle from an even more hazardous
location. Some damage is expected when a vehicle strikes the guardrail or barrier.
A longitudinal barrier, such as a guardrail, is placed parallel to a roadway and is
designed under the assumption that a vehicle will strike the guardrail at an angle of
25 degrees or less. It is intended to be struck from one side only and not at an angle
close to 90 degrees.
Crash cushions are designed to be struck at close to a 90 degree angle and bring a
vehicle to a slow, gradual stop. A crash cushion generally shields a specific object
such as a bridge abutment or pole.
Staff has investigated other solutions to minimize future problems at the intersection.
However, it is not expected that this location will result in a high number of vehicles
proceeding westbound through the intersection to collide with a dwelling structure.
Proper notification to the driver of the "T" intersection will help minimize drivers
failing to negotiate a turning movement at the intersection. It is a known fact,
however, that a percentage of drivers do drive in an impaired state ( drugs, alcohol,
fatigue, etc.) and a collision cannot be guaranteed not to occur. A balance between
damage to the vehicle and injury to the vehicle occupants and the damage to a
structure and possible injury to the occupants of the dwelling unit must be achieved.
RECOMMENDATION:
The Traffic Safety Coordinating Committee recommends that additional Type N-1
object markers (yellow in color) be installed on the west side of Carlsbad Boulevard
opposite Cannon Road. Additionally, the Committee recommends that pavement
tum arrows be striped at the crosswalk location on Cannon Road.
NECESSARY CI'IY COUNCIL ACTION:
No City Council action required.

Dear Mr. Johnson :
As you prob ably Know, on December 13, 1991 at approximately
2:00 a.m., a car driving west on Carinon Road failed to stop or
turn at the T-in tersection of Carlsbad Blvd. and drove through a
house located a t 5036 Tierra del Oro. This house is backed by
Carlsbad Blvd. The owner of the house, Pasquale Buono has
retained me to l ook into this situation for him.
One of Mr. Buono's main concerns, is finding some remedial
measures so that this type of incident does not happen again.
The city has app arently added a sign depicting two arrows on top
of the existing blank reflector diamond sign since this incident.
Although Mr. Buo no appreciates the added signage, he does not
feel that it is adequate to protect his family and/or visitors to
his home. Fortu nately, on the night of this incident no one was
asleep in the a r ea where the car flew through the house.
However, it was purely providential that my client was out of
town and not asl eep in the room affected. In fact, as it stands
now the family i s unwilling to use the area of his property and
house that is i n jeopardy of being hit again without additional
safeguards.
Mr. Buono r equests that a more thorough review of this
intersection be conducted and the findings, as well as some
suggestions for remedial measures, be submitted co Lhe Tcarfic
Safety Commission. I understand from Mr. Ball, the acting City
Attorney, that t he Traffic Safety commission meets the first
Monday of each month. Since this is a very serious issue
involving the e x isting known danger to the safety of residents of
Carlsbad, I woul d request a response as soon as possible from the
Engineering Depa rtment and submission to the Traffic Safety
Commission for t he next meeting on March 2, 1992.
