BACKGROUND: DATA: The City of Carlsbad currently contracts with a commercial street sweeping firm to sweep all City streets twice monthly. It is in the City's best interest to periodically sweep streets for several reasons. First, the visual benefit of keeping streets clean of trash provides an aesthetic improvement to the neighborhood. Secondly, street sweeping helps to keep the storm drain system clear and it reduces the amount of pollutants and debris that ends up in the lagoons and ocean. Approximately one to three complaints are received each month by the City Council, City Manager's office and/or staff regarding problems with street sweeping. Problems exist because vehicles are parked and left on streets scheduled for sweeping. The complaints primarily originate from residents in the Bristol Cove Development and the area west of Interstate 5 between the Agua Hedionda Lagoon and Buena Vista Lagoon. The proposed Street Sweeping Ordinance (Exhibit 1) will allow staff to determine locations where signs will be posted to notify drivers and residents that parking will be prohibited during certain hours on the day when the street is swept. Enforcement of the parking restriction will be required. Therefor, several options exist for enforcement. A Police Department patrol officer may issue citations. Otherwise, a Police Services Aide (PSA) may follow the street sweeper in posted areas and issue citations to vehicles parked on those streets during street sweeping hours. The proposed ordinance would not apply to commercial vehicles on residential streets if they are making pickups or deliveries. Staff estimates that it will cost approximately $13,000 to fabricate and install signs in the two areas currently identified for signing. Adequate funds exist in the Utilities and Maintenance Department budget for this expenditure. Other locations in the City of Carlsbad will be posted as the need for street sweeping signs becomes apparent. NECESSARY CITY COUNCIL ACTION: An ordinance will be required to be adopted by the City Council to amend Title 10 of the Carlsbad Municipal Code to add a section on street sweeping. EXHIBIT 1 "10.40.150 Parking Restricted at Certain Times to Facilitate Street Sweeping : • (a) Any other limitation on, or regulation concerning, parking contained in this Title to the contrary notwithstanding, it is unlawful to park or leave parked any vehicle on any street or portion thereof during the hours and on the day or days of the month indicated on signs containing the words "NO PARKING," which signs have been placed in appropriate locations designating said parking restriction pursuant to the provisions of this section. (b) When said markings or signs are in place, no person shall stop, stand or park a vehicle upon any street or highway in violation of the restrictions contained on said signs or markings. (c) The City Traffic Engineer is authorized to determir.ie the locations of and to place and maintain, or cause to be placed and maintained , signs designating the hours during which, and day or days of the month on which, parking is prohibited in order to ·sweep City streets. In the event temporary signs are employed to prohibit parking on any street or highway or portion thereof pursuant to the foregoing, no vehicle parked in violation of the directions set forth on the temporary signs shall be removed unless such signs have been erected or placed on the street or portion thereof at least seventy-two hours prior to such removal. (d) Section 10.40.1 S0(a) shall not apply to the parking or standing of commercial vehicles in a residential district with respect to any commercial vehicles making pickups or deliveries of goods, wares or merchandise from or to any building or structure located on the restricted street or highway, or for the purpose of delivering materials to be used in the repair, alteration, re- modeling or reconstruction of any building or structure for which a building permit has previously been obtained."
