This matter was continued from the Planning Commission meeting
of July 24, 1973 at the request of the applicant. Based upon recent
discussions with the applicant, proposed revisions to the potential
development is to occur in the very near future. In that these revistons
have not occurred and would effect the content of all three\ parts of
the request, staff would recommend an additional continuance to the
Planning Commission meeting of September 25, 1973 to permit said revisions
to be completed and adequately reviewed by staff.

I. GENERAL INFORMATION: This item was continued at th_e request of tf1_e applicant
from the Planning Commission meeting of July, 24, 1973. NQ cftanges haye occurred
during the continuance. •
A. Request: -That the Planning Commission recommend approval to the City
Council of an E.I .R., a Specifi'c Plan for a 4 lot condominium development wi.th a
total of 727 d.u. and a Tentative Map wi'th 6 lots on a portton of SectiQn
35 & 36 T.l2S, R4W and Sec. 2, Tl3S, R4W, San Bernardtno Meridian .
B. Background: As Tentative Map No. 72-24, the Planning Commission and
City Council did, in late 1972 and early 1973, approve the development of a
140 acre parcel in the La Costa area. As a part of that approval, a 36
acre single-family development known as Spanish Village Unit No. l was approved,
that project is presently being developed. The applicant is now requesting to
develop the second unit of the overall development which is to be 100 acre
parcel located southerly of and adjacent to La Costa Avenue, westerly of the
present westerly most extension of Levante Street. Said property, some -
what irregular in shape, does have a small frontage of approximately 606 ft.
on El Camino Real.

2. General Plan: The La Costa Master Plan as approved by Planning
Commission Resolution 808 and City Council Resolution 2058 and Ordinance No. 9322,

indicates a majority of the property to be potential medium high density
residential with 14 d.u./acre. Another small portion adjacent to El
Camino Real is indicated to be potential high density residential ~•1ith 20
d.u./acre. In addition, an elementary school site and park site is indicated
on the subject parcel. The proposed density of 12.08 d.u./net acre in the
medium high density area and the 15.00 d.u./net acre in the high density area
does conform to the La Costa Master Plan.
D. Public Notification: The required public notices have been published
and mailed regarding these items.
II. CONSIDERATION OF E.I.R. NO. 167
A. Surrrnary: The draft E.I.R. v1as received on May 8, 1973. ·A letter v1as
sent by staff to the Applicant's consultant indicating certain deficiencies.
An amendment letter providing additional information was presented in June.
The final draft E.I.R. should be considered to include both these items. In
that the immediate indicated development is the preparation of the land for
sale as condominium lots with the potential number of units, staff can not
evaluate the ultimate project in terms of the total effects on the environment.
Therefore, it is recommended that the environmental consideration be divided
into two stages. At this time, as many environmental considerations as possible
should be completed. As each lot developes in the future, the specific impacts
of the precise development be presented as an amendment at that time.
The draft E.I.R., as amended, does adequately express the full range
of environmental impacts as can be possibly known at this stage. Any concern
expressed by staff in the specific discussion will be with regard to the
matter of emphasis or further elaboration rather than completely rewriting the
draft E.I.R. In reviewing the draft E.I.R., the relevant issues that should
be kept in mind are:
l. The impacts of the development in terms of grading and drainage.
2. The mitigating measures proposed to preserve the sites between
its initial preparation and the specific development.
3. The development, in terms ~f street and pad locations, did
receive an approval as a part of the consideration of Spanish Village Unit
No. l (CT 72-24). Therefore, in terms of drainage and public utilities, the
two developments are dependent upon each other.·
B. Acceptability of Draft Report: The draft, as amended, titled 11 Spanish
Village Hest 11 , proposed by the La Costa Land Company and prepared by Rick
Engineering Co., was acdepted by the Planning Director as a preliminary E.I.R.
This report was forv1arded to the following agencies for comments:
l. Department of Agriculture.
2. L.A.F.C.O.
3. County of San Diego Parks and Recreation Dept.
4. Comprehensive Planning Organization
5. State of California, Dept. of Fish and Game
6. San Diego County Air Pollution Control District
7. San Diego County Sanitation and Flood Control
At this time, no written response has been received. Any late responses will
)
be included in the mailing.
C. Final E.I.R.: The final E.I.R. will include the draft E.I.R. as
amended and the staff comments below. Rather than repeating the information
contained in the draft E.I.R., staff will only comment to enlarge upon or to
correct the draft E.I.R. as amended.
l. Corrections: The total number of condominium units proposed in the
project is 727 on a total of 100 gross acres, not the indicated 816 d.u. and
the 106 acres in the draft E.I.R., as amended. The overall gross density is
7.27 d.u./acre, not the 7.7 d.u.indicated.
2. The Environmental Setting: The environmental survey for the total
La Costa Area should be utilized as a part of this consideration. This survey
is included in the Planning Commission packets as an information item.
3. Mitigation Measures: The mitigating measures should have included ·
the immediate landscaping and irrigation of all slopes created, to guarantee
their preservation. In addition, wherever possible, all slopes of 25% or
greater could have been preserved.
4. Alternatives: The po ten ti al a, lternq tty ES are 1 imited far the parcel in
that a previous commitment for the extension of Levante Street and Anillo Way,
require that a majority of the grading proposed to be done whether the
indicated unit 2 is developed or not. Therefore, the potential lot layout is
limited. However, this does not limit the range of densities within the
established lot pattern. In that the previously approved La Costa Master Plan
has further invited the land use alternatives to residential and specific
densities, even the densities possible .are limited.
D. Staff Recommendation on the E.I.R.
l. That the Planning Commission recommend to the City Council that
the Final E.I.R. BE APPROVED to include:
a. the draft E.I.R.
b. The amendment letter dated June 7, 1973
c. Any response received from those agencies notified.
d. any publit input received as a part of the public hearing held
regarding this E.I.R.
Justification is based upon:
a. In that a land sales program is proposed, the development
to occur is only estimated, these materials do adequately express the total
effect of the proposed development on the environment.
2. That the Planning Commission require that an amendment to this
final E.I.R. be provided for each lot when the precise development has been
determined ..
III. CONSIDERATION OF SPECIFIC PLAN NO. SP-119:
A. Description of Project: The applicant is proposing to develop the

subject property into a six lot subdivision with the lots to be sold for future
development. The subdivision will contain a total of 74.70 net acres and will
consist of 4 residential lots, an 11.8 acre site to be reserved for a school
site and a 4.9 acre park site. In addition, easements consisting of an 16.8 acre
open space easement to the City and a 2;5 acre easement to S.D.G. & E. are
proposed.
Access is proposed to be provided by extending Anillo Way and levante
Street through the property to intersect with El Cami no Real. Ani 11 o
Way is proposed to have a 60 ft. right of way and Levante Street a 60 ft.
right of way until it intersects with Anillo Way, when it will widen to 84 ft.
right of way to El Camino Real.

B. Staff Recommendation·: That the Planning Commission recommend to the
City Council that the Specific Plan BE APPROVED. Justification is based upon:
1. Conformance of the plan to the General Plan commitment as
established by the La Costa Master Plan. •
2. Conformance of plan to zoning ordinance considerations for
property located in the P-C Zone District.
3. The size and location of the subject property is considered to
be sufficient for the proposed development.
C. Conditions of Approval: Any approval should be subject to the
following conditions:
1. The approval of Specific Plan is granted for the land described
in the application and any attachments thereto, and as shown on the
plot plan submitted labeled Final Revised Exhibit A. The location

of all buildings, fen~es, signs, roadways, parking areas, landscaping
and other facilitie~ or features shall be located substantially as
shown on the plot plan labeled Final Revised Exhibit A., except
or unless indicated otherwise herein.
2. Prior to the development of lots 133-138, a specific plan
of the proposed development shall be submitted to the Planning
Commission and City Council for consideration and approval.
3. Prior to the issuance of any permits on lots 135-138, a tentative
map shall be submitted to the City for consideration and approval.
4. Any minor change may be approved by the Planning Dir~ctor. Any
substantial change will require the filing of an application for an
amendment to be considered ~Y the Planning Commission.
5. All requirements of any law, ordinance or regulation of the
State of California, City of Carlsbad, and any other governmental entity
shall be complied with.
6. No .signs or advertising of any type whatsoever shall be erected
or installed until plans therefore have been approved by -the
City of Carlsbad.
7. Prior to obtaining any permits, and within 30 days hereof, the
applicant sha 11 file with the Sec re ta ry of the Planning Commission
written acceptance of the conditions stated herein.
-8. Compliance with and execution of all conditions listed hereon
shall be necessary, unless otherwise specified, prior to obtaining
final building inspection clearance. Deviation from this requirement
shall be permitted onJy by written consent of the Planning Director.
9. A detailed landscape and sprinkler plan prepared by a landscape
architect shall be submitted to the Planning Director for consideration
and approval. Said plan shall be for all slope areas within the
development.
10. Prior to inspection clearance, all la~dscaping shall be installed.
Said landscaping shall, at all times, be maintained in a manner
~cceptable to ~he Planning Director. •
11. All utilities, including electrical, telephone and cable
television, shall be installed underground and/or shall be completely
concealed from view.
12. -All public improvements shall be made in conformity with the
subdivision ordinance and other city standards, to the satisfaction
of the City Engineer, without cost to the City of Carlsbad and free
of all liens and encumbrances.
13. Prior to the issuance of any permits, the applicant shall enter
into a mutually acceptable agreement with the Encinitas Union and San
Dieguito Union High School Districts to provide for future school re-
quirements that will result from the proposed development.

IV. CONSIDERATION OF TENTATIVE MAP NO. CT 73-20
A. Staff Recommendation: That the Planning Comnission recommend to the
City Council that the Tentative Map BE APPROVED, subject to the following
conditions:
1. The applicant shall install a fully actuated traffic signal
at the proposed intersection of Levante Street and El Camino Real, in a
manner acceptable to · the City Engineer.
2. El Camino Real shall be dedicated and improved on the basis of
126 ft. right-of-way to City standards and specifications. · ..... , ... , .. ,.,
3. Prior to the issuance of any permits, the total property shall
be annexed to the Leucadia County ll/ater District.
4. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in addition to
all the requirements, limitations and restrictions of all municipal ordinances
and State and Federal statutes now in force, or which, hereafter, may be in
force for the purpose of preserving the residential characteristics of adjacent
properties.
5. The C. C. & R's for this development shall be submitted to the
Planning Director for review and -approval prior to the issuance of any building
permits.
6. The Developer shall enter into a mutually acceptable agreement
with the Encinitas Union and San Dieguito Union School District to provide
for future school requirements that will result from the proposed development.
7. All public improvements shall be made in conformity to the
City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision
Ordinance and other City standards to the satisfaction of the City Engineer, with-
out cost to the City of Carlsbad, and free of all liens and encumbrances. Im-
provement plans for water and sewer system shall meet the requirements of the
respective service districts.
8. All utilities, including provisions for cable TV, shall be
placed underground and/or shall be completely concealed from view.
9. Ornamental stre~t lighting shall be provided for as required by
Municipal Ordinance Code. The Developer shall post a bond in the amount necessary .

to permit the incorporation of the subdivision into a maintenance district.
10. Complete plans and specifications shall be submitted as required
for checking and approval, before construction of any improvements is commenced.
The subdivider shall submit the original drawings revised to reflect as-built
conditions, prior to acceptance of the subdivision improvements by the City.
11. All land/or easements required by this Ordinance shall be granted
to the City of Carlsbad without cost to the City, and free of all liens and
encumbrances.

12. All facilities provided to adequately control dr.ainage on the
subject property shall be maintained by the property owner(s) in
perpetuity.
13. The Subdivider shall dedicate to the public, all rights of ingress
and egress from lots abutting upon restricted access streets and roads
over and across the lines of said lots abutting said streets and roads.
This dedication shall be so designated on the certificate sheet of tbe
Final Map with the intent that the owners of said lots will have no
rights of access whatsoever to said streets and roads. The words

adjacent to the lots affected on the map proper. This requirement
shall apply to Lot 138 along El Camino Real.
14 . Street names shall be subject to approval and shall be de -
signated in accordance with the standards and policies adopted by the
Planning Commission on file in the Planning Department. Said names shall
be approved by the Planning Director prior to recordation of the Final
Map.
15. If requried by the City Engineering Office, the improvement
plans shall include a report of a geological investigation and a complete
grading plan of the entire site. The report and plan shall be prepared
by Civil Engineers licensed by the State of California, and experienced
in erosion control, who shall be acceptable to the City Engineer, and they
shall certify that they have investigated the site and prepared data with
full consideration of the consequences to the included and neighboring
properties.
16 . Prior to the approval of the Final Map, lot No. 133 and the open
space easement on lot 136 shall be dedicated to the City of Carlsbad.
17. In addition to the proposed publtc improvements shown to be completed
the developer shall install improvements along the full frontage of the
subject property along La Costa Avenue,to Ctty standards.

1. The northern half of CT73-20 is within the boundaries
of Leucadia County Water District. Sewer service will
be avaiiable upon payment of applicable connection
fees, surcharge fees, lateral connection fees, engineering
and inspection fees, and monthly sewer service
charges.
2o The southern half of CT-73-20 is not within boundaries
of LCWD. Sewer service will be available upon :=.-.

This subdivision would be acceptable to the Department of Public Health
provided:
1. All domestic water supplied to this subdivision comes from the 0livenhain
Municipal Water District.
-2. All buildings constructed in this subdivision are connected to the
Leucadia County Water District public sewer system.
3. The sewer and water lines are not laid in the same trench in any
part of this subdivision.
4. Proper drainage is maintained throughout the subdivision so as .to
prevent ponding and/or storage of surface water.

I have been asked to comment on the following maps -CT 73-25, CT 73-19, SP-lli -
CT 73-20 relative to the impact that the proposed developments may have on the San
Dieguito Union High School District. As has been explained by this office before,
school facilities of the San Dieguito High School District are operating on an
extended day basis with double sessions being a distinct possibility sometime during
the next school year. The district is currently building a second high school,
however, current information would indicate that the present rate of building in
the district will make even these facilities overcrowded as ear~y as the fall of 1975.
•. At present there is no high school site in the portion of the San Dieguito Union High
School District that is .located within the boundaries of the city limits of Carlsbad.
A study is currently-underway to determine the number and location of additional sites
to accommodate the anticipated influx of new students from housing developments
·currently under construction or proposed. The absence of sites or written agreements
by which to acquire them in the Carlsbad area compels us to oppose any additional
dwelling units within that area of our district that is within the city limits of
Carlsbad.
I would like to have the opportunity to present additional information to the city of
