GRAY CONSTRUCTION CORP., INC. 15445 Ventura Blvd. Sherman Oaks, California, 91403 BACKGROUND: The subject property, containing approximately 2.8 acres, is located at the northeast corner of the intersection of Gibralter Street and Jerez Court. With regard to previous history, the Planning Commission and City Council, in May and June of this year, did approve a Tentative Map on 1.6 acre portion of the subject parcel for a 24 unit condominium development. In July, the Planning Commission and City Council did approve a specific plan on a 1.2 acre portion of the subject property to be utilized for open space and recreational purposes. The applicant is now requesting to revise the previously approved tentative map to include the total property. REQUEST: That the Planning Commission recommend to the City Council, that a revised Tentative Map be approved to encompass the total 2.8 acre parcel known as Lots 370, 371, 372, and 373, La Costa South Unit No. 5 and a portion of east one-half Section 36, Township 12 South, Range 4 West, San Bernardino Meridian. No increase in density is contemplated. The original 24 unit condominium is still to be built and the additional 1.2 acres is to be utilized for open space and recreation as approved in the Specific Plan. In that the area being encompassed by the Tentative Map is being enlarged, a revised map has to be approved. ZONING AND GENERAL PLAN l. General Plan: The proposed condominium development and open space use are in conformance with the adopted La Costa Master Plan. STAFF RECOMMENDATION: That it be moved that the Planning Commission recommend to the City Council that the revised Tentative Map BE APPROVED subject to the original conditions of approval as outlined in City Council Resolution No. 3139 (see attached). Justification is based upon: l. Conformance of revised tentative map to La Costa Master Plan. 2. Conformance of revised tentative map to the State of California Subdivision Map Act and the Municipal Ordinance Code. With regards to the Parks Ordinance, it is recommended that in-lieu fees be required. Justification is based upon: No park site is indicated on the subject property as shown on the adopted La Costa Master Plan which indicated a parks program for the total La Costa area. PAUL A. FOR DEVELOPMENT OF A 24-UNIT C ffooMI M PROJECT ON 1. 6 ACRES OF LAND, ON PROPERTY LOCATED ON THE NORTH .SIDE OF JEREZ. COURT .BETWEEN .GIBRALTAR .... STREET ·AND THE 'WESTERLY TERMINUS ·oF JEREZ COURT. WHEREAS, on the 8th day of May, 1973, -the Carlsbad City Planning Commission adopted Resolution No. 900, recommending to the City Council that Tentative Subdivision Map (CT 73~12) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on the 5th day of June, 1973, considered the recommendation of the Planning Commission; and WHEREAS, said Tentative Map has complied with the requirements of the "City of Carlsbad Environmental Protection Ordinance of 197211 and has been declared to have a 11non- significant11 impact on the environment; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, that Tentative Map CT 73-12, is hereby approved, subject to the execution and/or fulfillment of the following conditions: l. All improvements shall be in conformance with the City of Carlsbad Design Criteria and Standards. 2. Improvement plans for water and sewer systems shall meet the requirements of the respective. service districts providing services. 3. All on-site fire protection appurtenances shall be constructed in accordance with fire department standards and requirements. 4. Park-in-lieu fees and/or park land dedication shall be granted to the City prior to recording of the Final Map. Parks and Recreation Depaitment shall make the determination as to which lands will be accepted as dedication. 5. The development shall meet all requirements of the Department of P~blic Health. The applicant shall be encouraged to work together with _the Encinitas and San Dieguito Union High School Districts to develop some mutual agreement regarding the impact on schools due to this development.
