CONTRACTOR SHALL VERIFY WITH THE CITY THAT PLANS ARE CURRENT ANO APPROVED. THE CONTRACTOR SHALL OBTAIN ANO REVIEW THE PERTINENT ENGINEERING PLANS BEFORE BEGINNING WORK. THE CONTRACTOR SHALL VISIT THE SITE ANO VERIFY ALL DIMENSIONS PRIOR TO SUBMITTING A BID. PERMITS FOR ANY CONSTRUCTION DEPICTED IN THESE PLANS SHALL BE OBTAINED BY THE CONTRACTOR. 2. ALL LOCAL, MUNICIPAL, COUNTY AND STATE LAWS, RULES AND REGULATIONS GOVERNING OR RELATING TO ANY PORTION OF THIS WORK ARE HEREBY INCORPORATED INTO AND MADE A PART OF THE PROJECT SPECIFICATIONS ANO THEIR PROVISIONS SHALL BE CARRIED OUT BY THE CONTRACTOR. THE CONTRACTOR IS RESPONSIBLE FOR THE ENFORCEMENT OF FEDERAL AND STATE OF CALIFORNIA OCCUPATIONAL SAFETY AND HEALTH REGULATIONS AND REQUIREMENTS. 3. A SEPARATE CITY REVIEW AND APPROVAL IS REQUIRED FOR ANY PORTIONS OF THESE PLANS REQUIRING A BUILDING PERMIT. CITY APPROVAL OF THESE PLANS IS FOR LANDSCAPE PLANTING AND IRRIGATION ONLY. 4. THESE LANDSCAPE PLANS ARE BASED ON CIVIL IMPROVEMENTS BY THE PROJECT CIVIL ENGINEERING. 5. THE CONTRACTOR SHALL COMPLY WITH THE ENGINEERING SOILS REPORT RECOMMENDATIONS AS THEY RELATE TO HIS WORK. 6. THE CONTRACTOR SHALL OBTAIN ALL NECESSARY AND/OR REQUIRED PERMITS AND PAY ALL RELATED FEES AND/OR TAXES REQUIRED TO INSTALL THE WORK ON THESE PLANS. 7. CONTRACTOR SHALL HAVE A VALID CONTRACTOR'S LICENSE REQUIRED FOR THE PARTICULAR WORK BEING DONE AND A BUSINESS LICENSE FOR THE JURISDICTION IN WHICH THE WORK IS LOCATED. CONTRACTOR SHALL NOT ALLOW LICENSES TO LAPSE DURING THE CONTRACT PERIOD. 8. CONTRACTORS ON THE JOB SHALL CARRY INSURANCE SATISFACTORY TO THE OWNER, AND SHALL PROVIDE CERTIFICATION OF COVERAGE UPON REQUEST. CONTRACTOR SHALL NOT CAUSE THIS POLICY TO BE CANCELED OR PERMIT IT TO LAPSE, AND THE INSURANCE POLICY SHALL INCLUDE A CLAUSE TO THE EFFECT THAT THE POLICY SHALL NOT, AT ANY TIME DURING THE CONSTRUCTION PERIOD, BE CANCELED, REDUCED, RESTRICTED, OR LIMITED UNTIL FIFTEEN (15) DAYS AFTER ALL ADDITIONAL INSURED HAVE RECEIVED WRITTEN NOTICE AS EVIDENCED BY RETURNED RECEIPTS OF REGISTERED OR CERTIFIED LETTERS. 9. THE CONTRACTOR SHALL NOTIFY THE OWNER'S REPRESENTATIVE IMMEDIATELY OF ANY ERRORS, OMISSIONS OR DISCREPANCIES IN EXISTING CONDITIONS OR WITH THE PLANS PRIOR TO BEGINNING THE WORK. 10. UNIT PRICES FOR ALL IMPROVEMENTS SHALL BE ESTABLISHED AS PART OF THE CONTRACT WITH THE PROJECT OWNER, PRIOR TO BEGINNING WORK, TO ACCOMMODATE ADDITIONS AND/OR DELETIONS OF MATERIAL AND/OR LABOR. 11. NO REVISIONS OR CHANGES SHALL BE MADE TO THESE PLANS WITHOUT REVIEW AND WRITTEN APPROVAL OF THE OWNER OR HIS APPOINTED REPRESENTATIVE THROUGH A RFI 'REQUEST FOR INFORMATION' SUBMITTED BY THE CONTRACTOR. DETERMINATION OF "EQUAL" SUBSTITUTIONS SHALL BE MADE ONLY BY THE LANDSCAPE ARCHITECT OF RECORD. ALL WORK RELATED TO THE PROBLEM AREA SHALL CEASE UNTIL THE DISCREPANCIES HAVE BEEN RESOLVED BY THE OWNER OR HIS REPRESENTATIVE IN WRITING. ANY CONTINUATIONI OF WORK PRIOR TO THE RESOLUTION OF DISCREPANCIES IS AT THE CONTRACTORS RISK AND EXPENSE. 12. THE LANDSCAPE ARCHITECT OF RECORD, AND CITY REPRESENTATIVES SHALL BE NOTIFIED NO LESS THAN 48 HOURS IN ADVANCE OF THE START OF CONSTRUCTION, ANY SITE OBSERVATION, OR MEETINGS. A. PRE-CONSTRUCTION MEETING B. IRRIGATION PRESSURE AND COVERAGE TEST C PRE-FINAL COMPLETION D. FINAL COMPLETION 12. SITE OBSERVATIONS BY THE LANDSCAPE ARCHITECT OF RECORD DURING ANY PHASE OF THIS PROJECT DO NOT RELIEVE CONTRACTOR OF HIS PRIMARY RESPONSIBILITY TO PERFORM ALL WORK IN ACCORDANCE WITH THE PLANS, SPECIFICATIONS AND GOVERNING CODES. 13. THE CONTRACTOR SHALL PROVIDE FULL WARRANTY AND MAINTENANCE OF ALL LANDSCAPE AREAS FOR A MINIMUM OF 90 DAYS AFTER INITIAL WRITTEN CITY APPROVAL. REFER TO PROJECT SPECIFICATIONS SECTIONS FOR OTHER PROJECT WARRANTIES AND GUARANTEES. 14. IF ANY REQUIRED LANDSCAPE INDICATED ON THE APPROVED CONSTRUCTION DOCUMENT PLANS IS DAMAGED OR REMOVED, IT SHALL BE REPAIRED AND/OR REPLACED IN KINF AND EQUIVALENT SIZE PER THE APPROVED DOCUMENTS TO THE SATISFACTION OF THE CITY OF CARLSBAD WITHIN 30 DAYS OF DAMAGE. 15. CONTRACTOR AGREES THAT HE SHALL ASSUME SOLE RESPONSIBILITY FOR JOB SITE CONDITIONS DURING THE COURSE OF CONSTRUCTION OF THIS PROJECT, INCLUDING :SAFETY OF ALL PERSONS AND PROPERTY THAT THIS REQUIREMENT SHALL APPLY CONTINUOUSLY AND NOT BE LIMITED TO NORMAL WORKING HOURS AND THAT THE CONTRACTOR SHALL DEFEND, INDEMNIFY, AND HOLD THE OWNER AND THE LANDSCAPE ARCHITECT HARMLESS FROlv1 ANY AND ALL LIABILITY REAL OR ALLEGED, IN CONNECTION WITH THE PERFORMANCE OF WORK ON THIS PROJECT, EXCEPTING FOR LIABILITY ARISING FROM THE SOLE NEGLIGENCE OF THE OWNER OR THE LANDSCAPE ARCHITECT. 16. THE CONTRACTOR AGREES TO HOLD THE LANDSCAPE ARCHITECT HARMLESS FROM ANY CLAIMS ARISING OUT OF HIS OPERATIONS OR THE OPERATIONS OF ANY OF HIS SUBCONTRACTORS, MATERIALS SUPPLIERS, OR AGENTS. 17. THE CONTRACT DRAWINGS REPRESENT THE FINISHED CONSTRUCTION AND DO NOT INDICATE METHODS, PROCEDURES, OR SEQUENCE OF CONSTRUCTION. THE CONTRACTOR SHALL TAKE THE NECESSARY PRECAUTIONS TO MAINTAIN THE INTEGRITY OF STRUCTURES DURING C:\DRAl'l1~G rlLES\TITLE SHEETS\XXXX.OWG 7/20/2019 CONSTRUCTION. THE CONTRACTOR IS RESPONSIBLE FOR THE DESIGN, CONSTRUCTION, AND MAINTENANCE OF ALL SAFETY DEVICES, INCLUDING SHORING AND BRACING. 18. THE CONTRACTOR SHALL VERIFY THE LOCATIONS OF ALL-EXISTING AND NEW UTILITIES, STRUCTURES, AND SERVICES BEFORE WORK. NOT ALL UTILITIES MAY BE SHOWN. THE LOCATIONS OF UTILITIES, STRUCTURES AND SERVICES SHOWN IN THESE PLANS ARE APPROXIMATE ONLY ANY DISCREPANCIES BETWEEN THESE PLANS AND ACTUAL FIELD CONDITIONS SHALL BE IMMEDIATELY REPORTED TO THE LANDSCAPE ARCHITECT AND OWNER'S REPRESENTATIVE. 19. THE CONTRACTOR SHALL PROTECT ALL EXISTING UTILITIES, LANDSCAPING, AND FEATURES TO REMAIN ON AND ADJACENT TO THE PROJECT SITE DURING CONSTRUCTION. CONTRACTOR SHALL REPAIR, AT HIS OWN EXPENSE, ALL DAMAGE RESULTING FROM HIS OPERATIONS OR NEGLIGENCE. 20. DO NOT SCALE ANY DRAWING IN THIS SET. ALL WRITTEN DIMENSIONS SHALL TAKE PRECEDENCE OVER THE SCALE SHOWN ON THE PLANS, SECTIONS, AND DETAILS. 21. CONTRACTOR SHALL NOTIFY UNDERGROUND SERVICE ALERT BY CONTACTING 'DIG ALERT' AT 811, BEFORE START OF CONSTRUCTION (14 CALENDAR DAYS PRIOR TO DIGGING). 22. CONTRACTOR SHALL VERIFY EXISTING LOCATION OF UTILITIES AS NECESSARY TO IDENTIFY LOCATION. 23. THE CONTRACTOR IS REQUIRED TO SUBMIT ITEMS LISTED IN THE SPECIFICATIONS SUBMITTAL SUBSECTIONS TO THE LANDSCAPE ARCHITECT AND OBTAIN HIS APPROVAL PRIOR TO DELIVERY TO THE SITE AND PROCEEDING WITH CONSTRUCTION. 24. ANY AND ALL CHANGES TO THE LANDSCAPE CONSTRUCTION, IRRIGATION AND PLANTING PLANS AS A RESULT OF CONSTRUCTION OR VALUE ENGINEERING SHALL BE DOCUMENTED AND SUBMITTED BY THE CONTRACTOR TO THE OWNER FOR REVIEW AND APPROVAL. ONCE ACCEPTED, THE CONTRACTOR IS REQUIRED TO DOCUMENT THE APPROVED CHANGES ON AN AS-BUILT SET OF DRAWINGS TO BE MAINTAINED ON-SITE DURING CONSTRUCTION AND SUBMITTED TO THE LANDSCAPE ARCHITECT AT THE COMPLETION OF THE PROJECT. 25. IF ANY ARCHEOLOGICAL ITEMS ARE UNEARTHED IN THE PROCESS OF CONSTRUCTION, THE CONTRACTOR SHALL IMMEDIATELY CEASE WORK AND NOTIFY THE OWNER'S REPRESENTATIVE AND THE LANDSCAPE ARCHITECT. CONTRACTOR SHALL NOT RESUME WORK UNTIL RECEIVING WRITTEN PERMISSION TO DO SO BY THE OWNER'S REPRESENTATIVE. 26. ALL DRAWINGS AND MATERIALS APPEARING HEREIN CONSTITUTE THE ORIGINAL AND UNPUBLISHED WORK OF THE LANDSCAPE ARCHITECT AND THE SAME MAY NOT BE DUPLICATED USED OR DISCLOSED WITHOUT WRITTEN CONSENT OF STUDIO WEST LANDSCAPE ARCHITECTURE & PLANNING. 27. MAINTENANCE. ALL REQUIRED LANDSCAPE AREAS SHALL BE MAINTAINED BY THE OWNER. LANDSCAPE AND IRRIGATION AREAS IN THE PUBLIC RIGHT-OF-WAY SHALL BE MAINTAINED BY THE OvVNER. LANDSCAPE AREAS SHALL BE MAINTAINED FREE OF DEBRIS ANO LITTER, AND ALL PLANT MATERIAL SHALL BE MAINTAINED IN A HEALTHY GROWING CONDITION. DISEASED OR DEAD PLANT MATERIAL SHALL BE SATISFACTORILY TREATED OR REPLACED PER THE CONDITIONS OF THE PERMIT. 28. THE OWNER SHALL ENSURE LANDSCAPE MAINTENANCE PROVIDERS USE INTEGRATED PEST MANAGEMENT PRACTICES TO PREVENT FERTILIZERS, PESTICIDES, YARD WASTE, AND OTHER POLLUTANTS FROM ENTERING STORM DRAINAGE. 29. IN AN EMERGENCY THREATENING THE SAFETY OF LIFE, WORK OR ADJOINING PROPERTY. THE CONTRACTOR IS HEREBY INSTRUCTED TO ACT AT HIS DISCRETION TO PREVENT SUCH LOSS OR INJURY. 30.
