I. GENERAL INFORMATION
A. Request: The applicant is requesting approval of a tentative map
to create 39 single-family lots on 11.7 acres of land located on a portion
of Lot 11 I11 of Rancho Agua Hedionda per Map 823, in the City of Carlsbad.
B. Background: Zoning, Precise Plan and Tentative Map for the entire
Laguna Riviera subdivision were approved by the City Council in 1966. The
area of this tentative map was designated as Unit #8 and is back before the
City to assure that it conforms to the original approvals.
C. Zoning and General Plan:
l. Zani ng: Existing: R-l-8000
Proposed: R-1-8000
Adjacent: R-1-8000
2. General Plan: The adopted General Plan designates the area
as low density residential (3-7 dwelling units per acre). The applicant is
proposing 4.4 dwelling units per net acre.
D. Environmental Impact Considerations: The applicant has submitted an
Environmental Impact Assessment per City requirements and the Planning Director
has declared that the proposed project would have a 11 non-significant11 impact
on the environment. The Coastal Commission has granted an exemption to this
development because they considered it to be an on-going project.
II. CONSIDERATION OF TENTATIVE MAP NO. CT 73~5
A. DEscription of Project: The proposed tentative map is in basic
conformity to the conditions established by the original tentative map and the
precise plan. Two basic points are:

l. The precise plan established a m1n1mum lot size of 8,000
square ft. on some of the lots and 10,000 sq. ft. on the others. These
should be retained.
2. The original tentative map, provided for a 60 ft. road stubbing
to the westerly boundary line near the vicinity of this tentative
map. Engineering feels that this road is still necessary and will have to
be provided in this subdivision.
B. Staff Recommendation: Staff recommends that the Planning Commission
recommend to the City Council that Tentative Map No. CT 73-5 BE APPROVED.
C. CONDITIONS OF APPROVAL-Any approval should be subject to the following
conditions:
l. Lots 228-237, 239,241, 243, 245-247, 250-251, 254-256, and
258-263, as shown on the map labeled Exhibit A, shall maintain a
minimum lot size of 10,000 sq. ft. All other lots shall be a
minimum of 8,000 sq. ft.
2. A 60 ft. stub-street shall be provided to the westerly property
line as required by,the City Engineer.
3. All of the conditions of approval of the original tentative
map (C.C. Res. No. 1292) shall still be in effect.(Resolution attached)
4. The development of the property described herein shall be
subject to the restrictions and limitations set forth herein which
are in addition to all the requirements, limitations and restrictions
of all municipal ordinances and State and Federal statutes now in
force, or which, hereafter, may be in force for the purpose of preserving
the residential characteristics of adjacent properties.
5. The Developer shall enter into a mutually acceptable agreement
with the Carlsbad Unified School District to provide for future
school requirements that will result from the proposed development.
6. If requested by the City Engineer, an amended Tentative Map
shall be submitted for approval by the City Engineer prior to
preparation of the Final Map to assure compliance to all conditions
of approva 1 .
7. In order to provide for reasonable fire protection during the
construction period, the subdivider shall maintain passable
vehicular access to all buildings and adequate fire hydrants with
required fire flows shall be installed as recommended by the Fire
Deaprtment.
8. If required by the City Engineering Office, the improvement
plans shall include a report of a geological investigation and a
complete grading plan of the entire site. The report and plan shall
be prepared by civil engineers licensed by the State of California,
and experienced in erosion control who shall be acceptable to the
City Engineer, and they shall certify that they have investigated
the site and prepared data with full consideration of the consequences
to the included and neighboring properties.

1 9. A grading plan shall be submitted as required by ordinance

6 acceptance as submitted.
7 11. The subdivision shall be developed in the indicated units
8 and sequence of units, unless· otherwise approved. Lot #300 shall be

.13. Street paving on local and minor streets shall consist of
two (2) inches of asphaltic concrete with stone chip seal coat laid
upon four (4J inches of decomposed granite bas material, all on
approved subgrade.
Street paving on Hillside Drive and Park Drive shall con-
sist of two and one-half ( ·2 1/2} inch~~ of asphaltic concret~ with
stone chip seal coat laid upon six {6) inches of decomposed granite
base, all on approved subgrade.
Street paving on Kelly Drive shall be ~esigned based on
subgrade tests made after the right-of-way is graded, but shall not
be less than the pavement placed on Pilrk Drive.

4 BE IT FURTHER RESOLVED that the City Clerk is hereby directed
