A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT OF THE CITY OF CARLSBAD, CALIFORNIA,
APPROVING THE REVISED PLANS, SPECIFICATIONS AND CONTRACT
DOCUMENTS, ACCEPTING BIDS, DETERMINING THE BID SUBMITTED BY RRR
PIROOZ ENGINEERING TO BE NON-RESPONSIVE AND AWARDING A
CONSTRUCTION CONTRACT TO FORDYCE CONSTRUCTION, INC., FOR
CONSTRUCTION OF THE B-TAP RESERVOIR IMPROVEMENTS PROJECT IN AN
AMOUNT NOT TO EXCEED $209,345

WHEREAS, the Carlsbad Municipal Water District, or CMWD, Board of Directors has determined
it necessary, desirable and in the public interest to complete the B-TAP Reservoir Improvements
Project, Capital Improvement Program, or CIP, Project No. 5024-6; and
WHEREAS, on Nov. 19, 2024, the CMWD Board of Directors adopted CMWD Resolution No.
1752, approving plans, specifications, and contract documents and authorizing the Secretary to the
Board to advertise to receive bids for construction of the project; and
WHEREAS, one addendum to the contract documents was released during the bidding phase to
reflect changes in the plans and specifications; and
WHEREAS, Carlsbad Municipal Code, or CMC, Section 3.28.0B0(E) requires the CMWD Board to
approve plans and specifications for all construction projects that are to be formally bid upon when the
value exceeds $220,000; and
WHEREAS, the revised plans, specifications and contract documents are on file at the Office of
the Secretary to the CMWD Board and incorporated herein by reference; and
WHEREAS, on Jan. 15, 2025, staff received six bids in response to the bid advertisement; and
WHEREAS, the apparent lowest bid submitted by RRR Pirooz Engineering in an amount not to
exceed $208,620 did not include submission of the bid security and did not satisfy the technical
experience required by the contract specifications; and
WHEREAS, staff found the bid submitted by RRR Pirooz Engineering to be non-responsive and
recommend that the CMWD Board reject its bid; and
WHEREAS, staff recommend awarding the contract to Fordyce Construction, Inc., who was
determined to be responsible and submitted the next lowest responsive bid in an amount not to exceed
$209,345; and

WHEREAS, CMC Sections 3.28.040{C}{5) and 3.28.090{B) authorize the Executive Manager or
designee to approve change orders in an amount equal to the contingency set at the time of project
award, which is $41,869.
NOW, THEREFORE, BE IT RESOLVED by the CMWD Board of the City of Carlsbad, California, as
follows:

That the above recitations are true and correct.
That the project is exempt from the California Environmental Quality Act, or CEQA, per
CEQA Guidelines Section 15302{c), which applies to the replacement or reconstruction
of existing utility systems and/or facilities involving negligible or no expansion of
capacity, and no substantial changes to the project have occurred that would require
additional environmental review under CEQA Guidelines Section 15162.
3. That the bid in an amount not to exceed $208,620 submitted by RRR Pirooz Engineering
is determined to be non-responsive and is hereby rejected.
4. That the bid in an amount not to exceed $209,345 submitted by Fordyce Construction,
Inc. for construction of the B-TAP Reservoir Improvements Project, CIP Project No. 5024-
6, is accepted, and the CMWD Board President is hereby authorized to execute a
contract with Fordyce Construction, Inc.
5. That the Executive Manager, or designee, is hereby authorized to approve construction
change orders for the B-TAP Reservoir Improvements Project in an amount not to
exceed $41,869.
6. That the Executive Manager or designee is authorized to sign all other documents
necessary for regulatory compliance, to extend funding opportunities, or to otherwise
implement and finalize the project, subject to the review and approval as to form by the
Office of the General Counsel.
7. That the award of this contract is contingent upon Fordyce Construction, Inc. executing
the required contract and submitting the required bonds and insurance policies, as
described in the contract, within 20 calendar days after adoption of this Resolution. The
Executive Manager may grant reasonable extensions of time to execute the contract
and assemble the required bonds and insurance policies.

PASSED, APPROVED AND ADOPTED at a Special Meeting of the Board of Directors of
the Carlsbad Municipal Water District of the City of Carlsbad on the 25th day of March 2025, by
the following vote, to wit:
