Adopt a resolution authorizing the City Manager or designee to execute all necessary documents to apply for and receive funding through the California Department of Resources Recycling and Recovery payment programs. 2. Adopt a resolution authorizing the City Manager or designee to submit necessary forms and manage all California Department of Resources Recycling and Recovery grants for which the City of Carlsbad is eligible. Executive Summary The California Department of Resources Recycling and Recovery, or CalRecycle, administers statewide recycling and waste management initiatives and offers financial assistance to eligible local governments to promote beverage container recycling and other related waste diversion activities. These efforts align with California's sustainability goals by reducing landfill waste and encouraging responsible recycling practices. The City of Carlsbad has applied for and received funding from these payment programs in the past and staff recommend the city continue using these available funds to support important programs within the city. Cal Recycle also offers grants to local governnments to help them properly manage the flow of various types of waste. These grants support the development and expansion of recycling and waste reduction programs targeting specific waste streams. To expedite the administration of the Cal Recycle payments and grants, staff are requesting the City Council delegate authority to the City Manager or designee to execute the documents required to apply for and receive funding through CalRecycle's recycling and recovery payment programs (Exhibit 1) and to submit the necessary forms and manage the city's Cal Recycle recycling and recovery grants (Exhibit 2). March 25, 2025 Item #2 Page 1 of 7 Docusign Envelope ID: 6E848DDE-1605-4F59-A268-51F418FE8AFD Explanation & Analysis CalRecycle payment programs The City of Carlsbad has successfully applied for and used funding from CalRecycle's payment programs in previous years. These funds have been instrumental in supporting local recycling initiatives, enhancing waste management infrastructure and promoting public awareness programs. By securing additional funding, the city can: • Maintain and expand existing recycling programs • Improve waste collection and processing efficiencies • Enhance public education efforts on recycling best practices • Support compliance with state-mandated waste diversion and sustainability goals CalRecycle requires local governments participating in the payment program to adopt a resolution authorizing certain actions related to administering the program. With the City Council's approval, the City Manager or designee will be authorized to execute all required documents to apply for, accept and administer these payment program funds. This authorization will be effective until rescinded by the City Council. CalRecycle grant programs Cal Recycle provides a variety of grants, as authorized by state legislation, to support the safe and effective managmeent of waste streams. The City of Carlsbad has received funding fromm the two grants that are most applicable for the city: • Beverage Container Recycling Grants: Support establishing convenient beverage container recycling and litter abatement projects and development and expansion of beverage container educational materials. • SB 1383 Local Assistance Grant Program: Provides funding to assist local governments meet key requirements for organic waste management and recycling.1 These include providing organics collection services to all residents and businesses, conducting community education and outreach and ensuring access to recycling and edible food recovery capacity. With the City Council's approval, the City Manager or designee will be authorized to execute all necessary grant-related documents, including applications, agreements, amendments and payment requests, to secure and administer CalRecycle grant funds. The funding will be used on qualified expenditures in an effort to increase awareness through education and outreach to the community, increase availabilty of recycling opportunities and enhance existing recycling and trash programs. Fiscal Analysis Cal Recycle payment programs require that the funds be spent within the 24-month term of the program. Any unused funds must be returned to Cal Recycle within 45 days of the end of the term. If the city's applications are approved for payment by Cal Recycle, funds for the Beverage Container Recycling Payment Program are typically received annually in April. 1 Senate Bill 1383, signed into law in 2016, set targets to reduce organic waste disposal and recover edible food aims to reduce emissions of pollutants, particularly methane, from organic waste. March 25, 2025 Item #2 Page 2 of 7 Docusign Envelope ID: 6E848DDE-1605-4F59-A268-51F418FE8AFD The table below shows a summary of payments received by the city in the last four fiscal years from the CalRecycle Beverage Container Recycling Payment Program: Fiscal year Payment 2020-21 $28,327 2021-22 $28,804 2022-23 $29,043 2023-24 $28,963 All grant-related expenditures will be reimbursed under the terms of the Cal Recycle grant program. The table below shows a summary of payments received by the city in recent fiscal years from the SB 1383 Local Assistance Grant Program: Fiscal year Payment 2022-23 $163,804 2024-25 $304,687 No direct funding from the city is required to participate in Cal Recycle programs. Next Steps Staff will submit funding applications For Cal Recycle payment programs in accordance with the program deadlines. Once funds are received, staff will implement the approved programs, monitor progress and submit required reports to ensure compliance. Staff will submit applications for eligible Cal Recycle grants as they become available, implement projects and programs using awarded grant funds, monitor program effectiveness and ensure compliance with grant terms and provide updates to the City Council as warranted. Environmental Evaluation The proposed action is exempt from the California Environmental Quality Act pursuant to the commonsense exemption, Section 15061(b)(3) of the CEQA Guidelines, because there would be no possibility of a significant effect on the environment. Moreover, approval of the payment forms constitutes an administrative activity of the City of Carlsbad and is additionally exempt from CEQA on that basis. (CEQA Guidelines, Section 15378(b)(5).) City Council resolution -Cal Recycle grants March 25, 2025 Item #2 Page 3 of 7 Docusign Envelope ID: 6E848DDE-1605-4F59-A268-51F418FE8AFD RESOLUTION NO. 2025-069 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE ALL NECESSARY DOCUMENTS TO APPLY FOR AND RECEIVE FUNDING THROUGH THE CALIFORNIA DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY PAYMENT PROGRAMS Exhibit 1 WHEREAS, the City Council of the City of Carlsbad, California has determined that it is in the city's best interest to participate in the California Department of Resources Recycling, and Recovery, or CalRecycle, payment programs for assistance in implementing programs that facilitate beverage container recycling and other recycling activities, thereby supporting state recycling and waste diversion goals; and WHEREAS, the California Public Resources Code authorizes CalRecycle to administer various payment programs; and WHEREAS, in furtherance of this authority, CalRecycle is required to establish procedures governing the administration of the payment programs; and WHEREAS, CalRecycle's procedures for administering payment programs require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of the payment program. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the proposed project has been determined to be exempt pursuant to the California Environmental Quality Act, or CEQA, Guidelines Section 15061 (b){3), where the activity is covered by the commonsense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. The proposed action includes a resolution of the City Council authorizing the City Manager, or designee, to execute all necessary documents to apply for and receive funding through the Cal Recycle program. It has been found that there is no possibility that the activity in question may have a significant effect on the environment, and there is not subject to CEQA.
