HomeMy WebLinkAbout2025-03-25; City Council; Resolution 2025-070Docusign Envelope ID: 6E848DDE-1605-4F59-A268-51F418FE8AFD RESOLUTION NO. 2025-070 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING THE CITY MANAGER OR DESIGNEE TO SUBMIT NECESSARY FORMS AND MANAGE ALL CALIFORNIA DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY GRANTS FOR WHICH THE CITY OF CARLSBAD IS ELIGIBLE Exhibit 2 WHEREAS, the City Council of the City of Carlsbad, California, has determined that it is in the city's best interest to apply for the California Department of Resources Recycling and Recovery, or CalRecycle, competitive and non-competitive grants that support the development and expansion of recycling and waste reduction programs targeting specific waste streams; and WHEREAS, the California Public Resources Code authorizes CalRecycle to administer various grant programs; and WHEREAS, in furtherance of this authority, CalRecycle is required to establish procedures governing the administration of the grant programs; and WHEREAS, Cal Recycle grant application procedures require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of CalRecycle grants; and WHEREAS, in furtherance of this authority, CalRecycle is required to establish procedures governing the administration of the grant programs. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the proposed project has been determined to be exempt pursuant to the California Environmental Quality Act, or CEQA, Guidelines Section 15061 (b){3), where the activity is covered by the commonsense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. The proposed action includes a resolution of the City Council authorizing the City Manager, or designee, to execute all necessary documents to apply for and receive funding through the Cal Recycle program. It has been found that there is no possibility that the activity in March 25, 2025 Item #2 Page 6 of 7 Docusign Envelope ID: 6E848DDE-1605-4F59-A268-51 F41 BFEBAFD question may have a significant effect on the environment, and there is not subject to CEQA. 3. That the City of Carlsbad is authorized to submit an application to Cal Recycle for all grant programs offered for which the City of Carlsbad is eligible. 4. That the City Manager, or designee, is hereby authorized as Signature Authority to execute in the name of the City of Carlsbad all grant documents, including but not limited to, applications, agreements, amendments, and requests for payment, necessary to secure grant funds and implement the approved grant project. 5. That these authorizations are effective for a period of five years.
