HomeMy WebLinkAbout2025-03-25; City Council; Resolution 2025-069Docusign Envelope ID: 6E848DDE-1605-4F59-A268-51F418FE8AFD RESOLUTION NO. 2025-069 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE ALL NECESSARY DOCUMENTS TO APPLY FOR AND RECEIVE FUNDING THROUGH THE CALIFORNIA DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY PAYMENT PROGRAMS Exhibit 1 WHEREAS, the City Council of the City of Carlsbad, California has determined that it is in the city's best interest to participate in the California Department of Resources Recycling, and Recovery, or CalRecycle, payment programs for assistance in implementing programs that facilitate beverage container recycling and other recycling activities, thereby supporting state recycling and waste diversion goals; and WHEREAS, the California Public Resources Code authorizes CalRecycle to administer various payment programs; and WHEREAS, in furtherance of this authority, CalRecycle is required to establish procedures governing the administration of the payment programs; and WHEREAS, CalRecycle's procedures for administering payment programs require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of the payment program. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the proposed project has been determined to be exempt pursuant to the California Environmental Quality Act, or CEQA, Guidelines Section 15061 (b){3), where the activity is covered by the commonsense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. The proposed action includes a resolution of the City Council authorizing the City Manager, or designee, to execute all necessary documents to apply for and receive funding through the Cal Recycle program. It has been found that there is no possibility that the activity in question may have a significant effect on the environment, and there is not subject to CEQA. That the City of Carlsbad is authorized to submit an application to CalRecycle for all payment programs offered. 4. That the City Manager, or designee, is hereby authorized as Signature Authority to execute all documents necessary to secure and reconcile payment. 5. That this authorization is effective until rescinded by this governing body.
