SUBJECT: REASONABLE ACCOMMODATION REQUEST RA 2024-0001 -1768 FOREST AVE
REMODEL
The City Planner has completed a review of your Reasonable Accommodation request submitted on
October 1, 2024, for the approval of additional lot coverage over the ·maximum allowed in the zone for
the purpose of constructing an attached patio cover at 1768 Forest Av:enue, APN 156-270-44-00. The
7,865-square-foot lot is in the R-1 zone and subject to a maximum lot coverage of 40% or 3,146 square
feet (7,865 x 0.40 = 3,146 square feet) pursuant to Carlsbad Municipal Code (CMC) Section 21.10,110. The
applicant is requesting to increase the size of the covered patio by 296 square feet, thus increasing the
existing lot coverage from 39.97% to 42.8% or 3,366 square feet.
After careful consideration of the request, the City Planner has determined that the request meets the
findings below and APPROVES this request.
Pursuant to CMC Chapter 21.87, for a Reasonable Accommodation request to be approved, the following
findings must be made:
A. The housing, which is the subject of the request for the reasonable accommodation, will be
occupied by an individual with a disability protected under fair housing laws in that an
assessment from a medical doctor was submitted to substantiate the request.
B. The requested accommodation is necessary to make housing available to an individual with a
disability protected under fair housing Jaws in that the additional covered patio area allows
the individual to utilize their outdoor living area.
C. The requested accommodation would not if!lpose an undue financial or administrative burden
on the city in that there are no financial or administrative burdens created by the proposed
reasonable accommodation.
D. The requested accommodation would not require a fundamental alteration in the nature of
the city's land use and zoning and building regulations, policies, practices, and procedures,
and for housing in the coastal zone, the city's local coastal program in that the request to
exceed the 40% lot coverage standard does not require fundamental changes in the nature
of the zoning regulations and the lot is not located in the coastal zone.
Therefore, the City Planner has determined that the application qualifies for the Reasonable
Accommodation and approves the request for additional lot coverage over the maximum allowed in the
zone for the purpose of constructing an attached patio cover pursuant to CMC Chapter 21.87.

NOTICE
This decision may be appealed by you or any other member of the public to the Planning Commission
within ten days of the date of this letter. Appeals must be submitted in writing to the Planning Division
at 1635 Faraday Avenue in Carlsbad, along with a payment of $930. The filing of such appeal within such
time limit shall stay the effective date of the order of the City Planner until such time as a final decision
