REQUESTED ACTION: Establish the distance that a parked vehicle must move after the
allowed 72 hour maximum time duration on a public street has
expired.
BACKGROUND:
DATA:
Section 10.40.010 (Exhibit A, attached) of the Carlsbad Municipal Code states that
a vehicle may park on a public street for a maximum duration of 72 hours. Citations
are issued by the Carlsbad Police Department when a violation occurs, on a time
available basis for this type of enforcement. To circumvent the 72 hour requirement,
some drivers move the vehicle a very short distance, such as one to two feet, to start
the 72 hour cycle once again. As a result, vehicles are parked virtually in the same
location continuously. This type of driver behavior has resulted in frequent complaints
to staff and the Police Department, especially when a large vehicle such as an RV
or trailer is involved. However, most of the violators encountered by the Police
Department are passenger-type vehicles.
Unless specifically prohibited by proper signing, on-street parking is allowed on many
of the public streets in the City of Carlsbad. Depending upon the width of the street,
parking may be permitted on one side or on both sides of the street. In addition, the
City of Carlsbad owns public parking lots where a vehicle also can park for 72 hours.
On-street parking is a convenience in residential, commercial and other locations
throughout the City. Most drivers comply with the 72 hour requirement and
problems are held to a minimum. Chronic violators, however, become a nuisance in
the neighborhood and require continuous police enforcement monitoring of the
situation. Unfortunately, there is limited manpower available for parking
enforcement in Carlsbad.
One strategy for permitting a vehicle to park legally for 72 hours and then be
required to move the vehicle is to establish a certain distance that the vehicle must
move after the 72 hour period. The City of Long Beach, for instance, requires that
a vehicle be moved a minimum of one block after 72 consecutive hours. A minimum
established distance permits legal parking initially at the desired location without
becoming long term parking in the same location on the public street or in a public
parking lot.

Some inconvenience is associated with the minimum distance requirement in that the
vehicle owner/operator must move from his/her desired parking location. Long term
parking in one specific location is reduced, however. No significant increase in
parking enforcement manpower is necessary to monitor the movement of vehicles
since there are only a minimum of chronic offenders taking advantage of the current
City of Carlsbad ordinance.
Because the length of a city block varies in the City of Carlsbad, a minimum distance
to move the vehicle of one-tenth of a mile is recommended. Therefore, Section
10.40.010 is recommended to be re-written as shown on Exhibit B to specify one-
tenth of a mile feet as the minimum distance to move a vehicle after the vehicle is
parked for 72 consecutive hours.
RECOMMENDATION:
The Traffic Safety Coordinating Committee recommends that a minimum distance
of one-tenth of a mile (528 feet) be established in Carlsbad as the required distance
to move a parked vehicle after the 72 hour limit has expired.
NECESSARY CI'IY COUNCIL ACTION:
An ordinance will be required for adoption by the City Council to amend Section
10.40.010 of the Carlsbad Municipal Code to establish one-tenth of a mile as the
minimum distance to move a vehicle after the 72 hour time limit has expired.

10.40.005 Application of regulations.
(a) The provisions of this chapter prohibiting
the stopping, standing or parking of a vehicle
shall apply at all times or at those times specified
in this chapter, except when it is necessary to stop
a vehicle to avoid conflict with other traffic or in
compliance with the directions of a police officer
or official traffic-control device.
(b) The provisions of this chapter imposing a
time limit on standing or parking shall not relieve
any person from the duty to observe other and
more restrictive provisions of the state Vehicle
Code or the ordinances of the city, prohibiting or
limiting the standing or parking of vehicles in
specified places or at specified times. (Ord. 3005

10.40.010 Parking for seventy-two or more
consecutive hours prohibited-
Removal of vehicle.
(a) No person shall cause or allow any vehicle
owned by him or in his possession, custody or
control, to be parked upon any street. alley or
publicly owned parking lot for seventy-two or
more consecutive hours.
(b) Any member of the police department
may remove any vehicle parked upon any street.
alley or publicly owned parking lot for seventy-
two or more consecutive hours and shall, upon
such removal, deal with such vehicle as provided
in Sections 22650 through 22856 of the Vehicle

10.40.005
10.40.015 Prohibited purposes for parking on
roadway.
(a) No person shall stand or park any com-
mercial vehicle on any street for the purpose of
loading or unloading any merchandise or goods
except in authorized loading zones as provided in
Section 10.40.185.
(b) No person shall stand or park any vehicle
on any street while displaying such vehicle for
sale or selling merchandise therefrom unless
authorized by other provisions of this code. A
vehicle shall not be considered to be displayed for
sale when it is legally parked on a public street if
the vehicle contains a for sale sign not greater
than eight and one-half inches by eleven inches
and the sign is placed on a side window and
presents no impediment to the view of the driver
when the vehicle is in operation.
(c) No person shall stand or park any vehicle
on any street for the purpose of washing, greasing
or repairing the vehicle, except for repairs neces-

10.40.020 Parking parallel with curb.
(a) Subject to other and more restrictive lim-
itations. a vehicle may be stopped or parked
within eighteen inches of the lefthand curb facing
in the direction of traffic movement upon any
one-way street unless signs are in place prohibit-
ing such stopping or standing.
(b) In the event a highway includes two or
more separate roadways and traffic is restricted
to one direction upon any such roadway, no
person shall stand or park a vehicle upon the left-
hand side of such one-way roadway unless signs
are in place permitting such standing or parking.
( c) The city traffic engineer is authorized to
determine when standing or parking shall be pro-
hibited upon the left-hand side of any one-way
street or when standing or parking may be per-
mitted upon the left-hand side of any one-way
roadway of a highway having two or more sepa-
rate roadways and shall erect signs giving notice
thereof. (Ord. 3005 § 58)

Parking for seventy-two or more consecutive hours prohibited --Removal of
vehicle.
(a) No person shall cause or allow any vehicle owned by him or in his possession,
custody or control, to be parked upon any street, alley or publicly owned parking lot for
seventy-two or more consecutive hours.
(b) For the purpose of this section, a vehicle shall be deemed to be left standing
when such vehicle has not been moved more than one-tenth of a mile (528 feet) under its
own power from its original stopped position.
( c) Any member of the police department may remove any vehicle parked upon
any street, alley or publicly owned parking lot for seventy-two or more consecutive hours and
shall, upon such removal, deal with such vehicle as provided in Section 22650 through 22856
of the Vehicle Code of the state.

Dear Mr. Johnson:
It is our understanding that the City of Carlsbad will be
reviewing the laws restricting the parking of recreation?tl vehicles
and boats on public streets later this year. There are a number of
boats and R.V.'s that are parked in our development that have been
there for as many as four to five years. Under the current law,
the owner can move the boat or R.V. one or two feet and continue to
store it in front of their home. It becomes· a game.
We feel that R.V.'s and boats should be stored behind fences
or at a self-storage facility. When they remain "warehoused" on
our residential public streets they are not only unsightly but make
visibility difficult when. children are out playing.
