Dear Adam Kooienga,
Thank you for submitting a preliminary review application for a proposed land use change to allow:
1. "Educational facilities, other" within Area 1 of the Carlsbad Airport Centre Specific Plan (SP 181)
without an age restriction and where the facility is located exclusively within Safety Zone 6 and
entirely outside of the 60 decibel (dB) Community Noise Equivalent Level (CNEL) noise contour as
shown in the McClellan Palomar Airport Land Use Compatibility Plan; and
2. To allow for an "Educational facilities, other" without an age restriction at 5838 Edison Place (APN
212-092-24-00).
Currently, the Carlsbad Airport Center Specific Plan (SP 181) permits "Educational facilities, other," as
defined in Section 21.04.137 of the Zoning Ordinance, subject to a Minor Conditional Use Permit, and
where the facility is for adult students (18 years and older) exclusively, and is located entirely outside of
the Flight Activity Zone and entirely outside of the 65 dB CNEL noise contour (as shown in the
Comprehensive Land Use Plan for the McClellan Palomar Airport, dated October 2004), or where the use
is located partially or entirely between the 60 dB CNEL and the 65 dB CNEL noise contours if interior noise
levels are attenuated to 45 dB CNEL (as verified through a site specific acoustical study).
The project site, an approximately 1.47-acre lot, is currently developed with a 19,143-square-foot
building. Access would be provided via Edison Place. The project is located outside of the Coastal Zone .
The property is located within Safety Zone 6 of the McClellan Palomar Airport Land Use Compatibility Plan .
In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose of a preliminary review is to provide you with direction and comments on the overall concept
of your project. This preliminary review does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in your submittal.
This review is based upon the plans, policies, and standards in effect as of the date of this review. Please

be aware that at the time of a formal application submittal, new plans, policies, and standards may be
in effect and additional issues of concern may be raised through a more specific and detailed review.
Planning:
General
1. General Plan and zoning designations for the property are as follows:
a. General Plan : Planned Industrial (Pl).
b. Zoning: Planned Industrial (P-M).
c. Specific Plan: Carlsbad Research Center Specific Plan, SP 181(H)
2. The project would require the following permits:
a. Specific Plan Amendment
i. The exact origins of the requirement to restrict education uses by age in 2007 (SP
181(F)) is unclear. However, it seems consistent with the intent of regulations
promulgated in the McClellan-Palomar Airport Land Use Compatibility Plan that
restrict certain types of uses. Children's Schools are prohibited in Safety Zones 1, 2 and
5. While the Specific Plan contains zones 1, 2, 3, 5, and 6, and the site is within Safety
Zone 6, staff would require substantial evidence as well as formal approval from the
San Diego County Regional Airport Authority in order to consider support for the
proposed Specific Plan Amendment.
ii. Alternatively, if an application for an amendment to the Specific Plan is submitted, it
could be processed accordingly and presented to the decision maker. City Council will
be the decision-making authority on the Specific Plan Amendment.
b. Minor Conditional Use Permit
i. Pursuant to SP 181, "Educational facilities, other" require approval of a Minor
Conditional Use Permit.
3. McClellan-Palomar Airport Land Use Compatibility Plan (ALUCP). The Carlsbad Airport Specific Plan
(SP 181) is in the McClellan-Palomar Airport Influence Area (AIA). The ALUCP identifies four types of
airport impacts that must be considered for each land use action: Noise, Safety, Airspace Protection,
and Overflight. Please include an analysis of the proposal's compatibility with the ALUCP for each of
the impacts above with the formal submittal to determine if the proposed amendment complies with
the ALUCP. The ALUCP is available at the following address:

4. SB 18 Tribal Consultation. Prior to the adoption or any amendment of a General Plan or Specific Plan,
a local government must notify the appropriate California Native American tribes of the opportunity
to conduct consultations for the purpose of preserving, or mitigating impacts to, cultural places that
may be affected by the proposed plan adoption or amendment. The City will provide the notification
and conduct any requested con sultations. Tribes have 90 days from the date on which they receive
notification to request consultation. Consultation must be concluded before final action can be taken
by the decision-maker (City Council).
5. Development Project Public Involvement Policy (Policy 84): The project is subject to both Early Public
Notification and Enhanced Public Engagement, which applies to development projects that require a
Major Amendment t o a Specific Plan. The Development Project Public Involvement Policy (Policy 84)

6. Plans: Please refer to the Legislative Permits (P-3) form to determine the required forms and
information that must be included with your application submission. The P-3 form can be found on
the city's website at:

7. Climate Action Plan (CAP): New requirements related to the city's goals to reduce greenhouse gas
(GHG) emissions will likely impact development requirements of this project. A formal application
submittal will need to include a completed Climate Action Plan Checklist (Form P-30) to determine
what requirements will apply to the project. New GHG reduction requirements are related to energy
efficiency, photovoltaic, electric vehicle charging, water heating and traffic demand management
requirements, as set forth in the California Green Building Standards Code and in CMC Chapters 18.21,
18.30 and 18.51 which is available on the city's website at the following address:

To the extent that new GHG reduction requirements are in effect at the time of application for grading
or building permits, the project will be required to comply with the effective requirements even if
different than what is proposed in the project's planning approvals. GHG reduction requirements may
impact, but are not limited to, site design and local building code requirements. If incorporating new
GHG reduction requirements results in substantial modifications to the project after planning
approvals are obtained, then prior to issuance of grading or building permits, the applicant may be
required to submit and receive approval of a Consistency Determination or an Amendment
application for the project through the Planning Division.
All necessary application forms, submittal requirements, and fee information are available at the Planning
counter located in the Faraday Building at 1635 Faraday Avenue or online at
https://www.carlsbadca.gov/departments/commu ni ty-development/planning. You may also access the
General Plan Land Use Element and the Zoning Ordinance online at the website address shown. Please
review all information carefully before submitting.
Land Development Engineering:
1. For the specific development project (not the Specific Plan Amendment), contact Nick Gorman in the
Transportation Division at Nick.Gorman@carlsbadca.gov, a division of the Public Works Department,
to determine if a Scoping Agreement is required. Scoping Agreements are used to determine if a
Local Mobility Analysis (LMA) is required and the scope of analysis. If an LMA is deemed necessary,
first, work with Transportation Division staff to obtain an approved scoping agreement. After the
scoping agreement has been approved, submit the approved Scoping Agreement as an appendix
within the LMA that is to be prepared per the most recent Transportation Impact Analysis Guidelines.
2. After the scoping agreement has been approved or deemed not necessary by the Transportation
Division, submit a completed Transportation Analysis Need Statement Form P-42 to Land
Development Engineering at LandDev@carlsbadca .gov prior to discretionary application submittal.

City staff will mark whet her a LMA and/or TDM plan is required and sign the P-42 form. Submit this
competed P-42 form with city signature and marked plan requirements with your application for
discretionary permits.
3. A Transportation Demand Management (TOM) plan may be required depending on the number of
employee vehicle trips the project will generate. Calculate the gross employee ADT using the
generation rates from Table 2-2 of the TOM Handbook at:

Show calculations on the Climate Action Plan checklist, Form P-30. If applicable, submit a TDM plan
with your application for discretionary permits.
4. Depending on the CEQA determination, which is determined after the application for discretionary
permits is submitted, a Vehicle Miles Traveled (VMT) analysis may be required per the Vehicles
Miles Traveled Analysis Guidelines available at:

5. Complete a Stormwater Standards Questionnaire Form E-34. This questionnaire will guide you and
the city in determining what type of reports and storm water mitigation must be completed to satisfy
state and City storm water quality requirements. The questionnaire is located on the City of Carlsbad
website.
6. Provide a Preliminary Title Report (current within the last six (6) months.
7. Annotate and delineate all existing easements and encumbrances listed in the Preliminary Title Report
on the site plan. If any vacations or quitclaims are planned with this development annotate on the
site plan.
8. Show all existing utilities and callout size for: water, sewer, storm drain, underground dry utilities,
overhead lines, streetlights in Camino Vida Roble and Owens Avenue and laterals affecting the
property.
9. Locate fire service, backflows, potable and recycled water services, meters, landscape irrigation
services, and sewer laterals for the new development in compliance with City of Carlsbad Engineering
Standards requirements.
10. Please be advised that a more in-depth review of the proposed development will occur with the
discretionary permit application.
