BACKGROUND: DATA: The Carlsbad Police Department, City of Carlsbad staff in various departments and the City Council often receive complaints about speeding vehicles on Carlsbad Boulevard, especially the segment from Tamarack Avenue to Pine Avenue. Various methods of reducing the prevailing speed on Carlsbad Boulevard are being investigated by the Traffic Division of the Police Department and staff in the Traffic Operations Section of the Engineering Department. This segment has a posted speed limit of 35 miles per hour. Carlsbad Boulevard is classified as a major arterial on the Circulation Element of the General Plan. Except for a short portion of the roadway north of Mountain View Drive to the northerly City limits and between Palomar Airport Road and Cannon Road, the roadway has two lanes in each direction divided by a striped or raised median. A bicycle lane has been provided on each side of Carlsbad Boulevard for the entire length of the road from La Costa Avenue to the northerly City limits. The segment of Carlsbad Boulevard from Tamarack Avenue to Walnut Avenue is 0.53 miles in length and from Walnut Avenue to Mountain View Drive the segment is 0.73 miles in length. Sidewalks and street lights are provided on both sides of the street. A total of 18 intersections are located in the segment from Tamarack Avenue to Mountain View Drive, plus numerous driveways. The intersections of Tamarack Avenue, Pine Avenue, Carlsbad Village Drive and Grand Avenue are signalized. No controls have been established on Carlsbad Boulevard at the other intersections. Striped crosswalks have been painted on Carlsbad Boulevard at the uncontrolled intersections of Juniper Avenue, Cherry Avenue, Maple Avenue and Sycamore Avenue. In addition, a painted crosswalk across Carlsbad Boulevard is provided in front of the Army and Navy Academy. TRAFFIC SAFElY COMMISSION Staff Report COMMISSION MEETING OF: June 7, 1993 ITEM NO. 6A (Continued) The California Vehicle Code (CVC) provides that a portion of a highway, if qualified, may be designated as a Business District, and therefore, have a prima fade speed limit of 25 miles per hour. Section 235 of the CVC defines a Business District as: A "business district" is that portion of a highway and the property contiguous thereto (a) one side of which highway, for a distance of 600 feet, 50 percent or more of the contiguous property fronting thereon is occupied by buildings in use for business, or (b) upon both sides of which highway, collectively, for a distance of 300 feet, 50 percent or more of the contiguous property fronting thereon is so occupied. A business district may be longer than the distance specified in this section if the above ratio of buildings in use for business to the length of the highway exists. The California Vehicle Code further provides the criteria for determining whether a highway is within a Business District in CVC Section 240 that reads as follows : In determining whether a highway is within a business or residence district, the fallowing limitations shall apply and shall qualify the definitions in Sections 235 and 515: (a) No building shall be regarded unless its entrance faces the highway and the front of the building is within 75 feet of the roadway. (b) Where a highway is physically divided into two or more roadways only those buildings facing each roadway separately shall be regarded for the purpose of determining whether the roadway is within a district. ( c) All churches, apartments, hotels, multiple dwelling houses, clubs, and public buildings, other than schools, shall be deemed to be business structures. ( d) A highway or portion of a highway shall not be deemed to be within a district regardless of the number of buildings upon the contiguous property if there is no right of access to the highway by vehicles from the contiguous property. Staff has analyzed the subject section of Carlsbad Boulevard to determine if the portion of the highway lies within a Business District. Results are tabulated below on Table 1. TRAFFIC SAFE1Y COMMISSION Staff Report COMMISSION MEETING OF: June 7, 1993 (Continued) TABLE 1 ITEM NO. 6A CARLSBAD BOULEVARD BUSINESS DISfRICT DETERMINATION Tamarack Avenue to Walnut Avenue Walnut Avenue to Mountain View Drive 38 41 11 28.9 21 51.2 Carlsbad Boulevard does not qualify as a Business District when evaluating the segment between Tamarack Avenue and Walnut Avenue, a road segment having a number of pedestrians crossing the street to access the beach, bluff top, sidewalk and sea wall. Therefore, a prirna facie 25 mile per hour speed limit does not exist on this segment of Carlsbad Boulevard. Additionally, the low number of residential units in this segment do not qualify as a Residence District per the California Vehicle Code. The segment of Carlsbad Boulevard from Walnut Avenue to Mountain View Drive does qualify as a Business District and would have a prirna facie 25 mile per hour prima facie speed limit. Pedestrian crossings also occur in this segment between Walnut Avenue and Mountain View Drive to access the various businesses, Army and Navy Academy, and Magee Park. Prevailing speeds on Carlsbad Boulevard are slightly higher than the posted 35 mile per hour speed limit. Speed surveys previously conducted on Carlsbad Boulevard are shown on Table 2. In the five year period 1988 through 1992, inclusive, there have been a total of 63 collisions at midblock or intersection locations between Tamarack and Walnut. Of this total, the primary collision factor in 25 of the collisions was exceeding the safe speed (ESS) of the road. Seven of the collisions involved a pedestrian. Because of the collision history and conflicts on Carlsbad Boulevard between vehicles and pedestrians, driver inattention in this segment, higher prevailing speeds, significant business, residential and recreational activity adjacent to the roadway, a lowering of the speed limit on Carlsbad Boulevard from Tamarack Avenue northerly to Mountain View Drive would be justified. RECOMMENDATION: The Traffic Safety Coordinating Committee recommends that a prirna fade 30 mile per hour speed limit be established upon Carlsbad Boulevard from Tamarack Avenue to Walnut Avenue. The Committee further recommends that a prima fade 25 mile per hour speed limit be established upon Carlsbad Boulevard from Walnut Avenue to Mountain View Drive, the portion of the roadway qualifying as a Business District per the California Vehicle Code. NECESSARY CI1Y COUNCIL ACTION: An ordinance will be required to be adopted by the City Council to establish a prirna fade 30 mile per hour speed limit upon Carlsbad Boulevard from Tamarack Avenue to Walnut Avenue and a 25 mile per hour speed limit upon Carlsbad Boulevard from Walnut Avenue to Mountain View Drive.
