HomeMy WebLinkAboutPRE 2025-0014; ROOSEVELT 17 - SB 330; Admin Decision LetterApril 3, 2025 Chris McKellar McKellar McGowan LLC 5120 Shoreham Place, Suite 280 San Diego, CA 92122 {city of Carlsbad SUBJECT: PRE 2025-0014 (DEV2024-0120) -PRELIMINARY HOUSING DEVELOPMENT (SB-330) PRE-APPLICATION -ROOSEVELT 17 APN: 203-181-08-00, 203-181-09-00 Dear Mr. McKellar, The Planning Division is in receipt of a Senate Bill 330 (SB-330} preliminary housing development pre- application for the ROOSEVELT 17 project, application no. PRE 2025-0014, submitted on March 6, 2025. The project, consisting of 1} the demolition of an existing 2,430 sf restaurant (Hennessy's Tavern) and an approximately 1,500 sf office building; and 2) the development of a five-story, 35,127 sf mixed-use building, consisting of 17 for-sale condominium units (ranging two-to-four bedroom, 1,125-to-3,960 sf), 850 sf of street facing retail space, and 33 parking stalls within an at-grade parking garage, qualifies as a housing development project pursuant to paragraph (2) of subdivision (h) of Section 65589.5 of the Government Code. City staff has determined the items submitted with the subject SB-330 preliminary housing development pre-application satisfy the requirements pursuant to Government Code Section 65941.1. The preliminary application is therefore "deemed submitted" as of March 6, 2025. As such, pursuant to Government Code Section 65589.5, the ROOSEVELT 17 project shall be subject only to the ordinances, policies, and standards adopted and in effect as of March 6, 2025. Regardless of the information submitted as part of this application to indicate whether the property is located in any of the areas covered by Government Code Section 65941.1.(a)(6} through (9), the city reserves the right to require additional information and/or studies to determine compliance with applicable codes and policies (e .g. biological or cultural resources studies). Within 180 calendar days after submitting a preliminary application with all of the information required by Government Code Section 65941.(a), the development proponent shall submit a full development application. The preliminary application submittal was "deemed submitted" on March 6, 2025; therefore, the full development application must be filed no later than September 2, 2025.
