The proposed paint improvements will create a more cohesive, modern aesthetic experience across the property and are consistent with the approved Pavilion Site Development Plan (SDP-00-10) and requirements of Chapter VI of the Green Valley Master Plan. Compliance with Policy 35 -Consistency Determination Criteria -Paint Improvements . In order for the proposed paint improvements to be considered consistent with the original approval of SDP 00-10, the following findings must be made: (1) No project condition, feature, facility, or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function; Response: The proposed paint improvements do not impact any facilities or amenities associated with the quality, safety, or function of the existing shopping center. No physical changes are proposed. The current paint scheme was not essential to the design of the project. Further, the intent of the approved SDP was to "allow for creative design flexibility for each tenant within general parameters ... " (2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood. Response: As the center has evolved with new tenants, a variety of applications for individual tenant paint and material improvements have been presented to the City of ) Carlsbad. This application facilitates aesthetic cohesion and modernization across all existing tenants and the creation of a cohesive, complementary style throughout the center. The proposed improvements increase compatibility with. the surrounding "La Costa Glen" neighborhood which contains a similar color palette. (3) The proposed revision does not change the density (i.e., the addition of units) or boundary of the subject property; Response: The proposed paint improvements do not change the density, ·intensity, or bounqary of the subject property. (4) The proposed revision does not involve the addition of a new land use not shown on the original permit (e.g., adding a commercial use to a residential project, replacing single family units with attached residential units, vice versa for each example, etc.); Response: The revision does not involve the addition of a new land use. (5) The proposed revision does not rearrange the major land uses within the development (e.g., it does not exchange the locations of single-family units with attached units); Response: The revision does not rearrange major land uses within the development . . (6) The proposed revision does not create changes of greater than ten percent (10%), provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code as follows: Per individual lot or structure -yards, setbacks, coverage, or height (height reductions of >10% are permitted); • On an aggregate project basis -parking, open space, common area or landscaping; Response: The proposed improvements do not create changes greater than 10%. The project continues to comply with all applicable development standards. No modifications to development standards are proposed via the paint improvements. (7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation; Response: The proposed improvements do not result in any significant environmental impact and do not require any additional mitigation. (8) The proposed change would not result in any health, safety, or welfare impacts; Response: The proposed improvements do not result in any health, safety, or welfare impacts. (9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change; and Response: The color. of the commercial buildings were not associated with any major issues or controversies associated with the original approval of the SDP or the Green Valley Master Plan. 2 (10) The proposed change would not be readily discernible to the decision makers as being substantially different from the project as originally approved. Response: The proposed improvements continue to comply with the color palette requirements as provided in Chapter VI of the Green Valley Master Plan, incorporated by reference into the approved SOP 00-10. The color palette is predominantly warm in character and is sensitive in the use of color accents. The principal colors used are complementary to the rnatural shades of the riparian and upland bluff areas. Thank you for your consideration of this request.
