GENERAL INFORMATION: A. Request : The applicant is requesting approval of a Variance to permit a twin lot split on .72 acres of land, located on a portion of the northeast 1/4 of the northwest 1/4 of Section 6, Township 12 South, Range 4 West, San Bernardino Base and Meridian in the City of Carlsbad . B. Background : This Variance is required by the City's 11 Panhandle 11 Lot Policy. The property is generally located on the north side of Knowles Avenue westerly of Elmwood Street. C. Zoning and General Plan: l. Zon i ng : Existing: R-1-7500 Proposed: R-1-7500 Adjacent: R-1-7500 2. General Plan : The adopted General Plan designates this area as Low Density Residential (3-7 d.u./acre). The applicant prpposes 4.2 d.u ./acre. D. Environmental Impact Considerations: This application is exempt from the requirements of the Environmental Protection Ordinance of 1972 (Ord . No . 1158, Section 19 .04 .090 C.4 (iii) ). E . Public Notification : The required public notices have been mailed regarding this item . II. CONSIDERATION OF VARIANCE NO. 229 A. Description of Project: The applicant proposes a twin lot split with the 25 ft. drive along the west property line. They will dedicate an additional 10 ft. of right-of -way along Knowles Avenue and each new lot created will exceed the minimum lot size of 7500 sq . ft. B. Staff Recommendation: Staff recommends that the Planning Commission APPROVE Variance No. 229 for the following reasons: l . The proposed lot split conforms to the requirements of the City's Panhandle Lot Policy . 2. The lots to be created will conform to the recommendations of the General Plan . C. Conditfons of Approval: Any approval should be subject to the following conditions: • l. The Variance is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A. The location of all buildings, fences, signs , roadways, parking areas , landscaping and other facilities or features shall be located substant ially as shown on the plot plan labeled Exhibit A, except or unless indicated otherwise herein. 2. Unless the use is inaugurated not later than one year after the date the approval is granted and is diligently pursued thereafter, this approval will automatically become null and void . 3. All requirements of any law , ordinance or regulation of the State of California, City of Carlsbad, and any other governmental entity shall be complied with . 4. Prior to obtaining a building permit and within 30 days hereof , the applicant shall file with the Secretary of the Planning Commission written acceptance of the conditions stated herein. 5. Compliance with and execution of all conditions listed hereon sh.all be necessary unless otherwi'se specified, prior to obtaining final building inspection clearance . Deviation from this requirement shall be permitted only by written consent of the Planning Director . 6. All utilities to any structure approved herein shall be supplied by, underground feed . -2- 7. Park-in-Lieu fees shall be granted to the City prior to recording the Final Map. 8. All public improvements shall be made in conformity to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City Standards to the satisfaction of the City Engineer without cost to the City of Carlsbad, and free of all liens and encumbrances. Improvement Plans for water and sewer system shall meet the requirements of the respective service districts. 9. Complete plans and specifications shall be submitted as required for checking and approval, before construction of any improvements is commenced. The subdivider shall submit the original drawings revised to reflect as-built conditions, prior to acceptance of the subdivision improvements by the City. 10. The applicant shall participate, to the satisfaction of the Fire Chief, in the hydrant replacement at Knowles Avenue and Elmwood Street. -3-
