GENERAL INFORMATION A. Request: The applicant is requesting approval of a tentative map to allow a 21 unit condominium on .68 acres of land located on lots 65, 66, 67 and 68 of Shelter Cove Map No. 5162 in the City of Carlsbad. B. Background: This same tentative map was approved by the City Council on January 18, 1972 and expired one year later. The units have been built and the final map is the only thing holding up the sales of the units. C. Zoning and General Plan: 1. Zoning: Existing: R-W Proposed: R-W Adjacent: R-W & P-C 2. General Plan: Land Use -Amendment No. 2 to the adopted General Plan designates the area as low-medium density residential (0-30 d.u./acre). The existing development involves slightly over that. (30.88 d.u./acre). D. Environmental Impact Considerations: The applicant has submitted an Environmental Impact Assessment -per City requirements, and the Planning Director has declared that the project would have a 11 non-significant11 impact on the environment. II. CONSIDERATION OF TENTATIVE MAP NO. CT .71-7 A. Description of Application: The tentative map will eliminate four existing lots in Shelter (Bristol) Cove and create one lot containing 21 condominium units . B. Staff Recommendation : Staff recommends that the Planning Commission recommend to the City Council that Tentative Map CT 71 -7 BE APPROVED. C. Conditions of Approval: Any approval should be subject to the following conditions: 1. All conditions as established in City Council Resolution No. 1940 shall be complied with. (Resolution attached) 2. The development of the property described herein shall be subject to the restrictions and limitation set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and State and Federal statutes now in force or which, hereafter, may be in force for the purpose of preserving the residential characteristics of adjacent properties . 3. The Developer shall enter into a mutually acceptable agreement with the Carlsbad Unified School District to provide for future school requirements that will result from the proposed development. That the proposed condominium shall be developed, genetall in conformance with the tentative map labeled exhibit PAP. 2. That an architectura l theme sha l l be developed as ihown on applicant ts r e nd e r i ng and e l evations l abeled exhibit 11 81' •. 3. That a ·landscaping and sprinkler plan prep~red by a registered landscape architect be submitted to the Parks and Recreation Director for r evi ew prior to issuance of a bu il ding permit. 4. That the applicant shall comply with the City of Carlsbad Ordinance 9190, 11 Dedication of Land for Par ks or Fees in Lieu of.11 5. That the proposed deve l opment be _constructed to meet s t a ndards of Fire Zone 2 . 6. I 7. That the applicant shall participate in the developfilent of street lights as required by the City Engineer. 8. A final subdivis i on ma p will be required, per Sub divi si o Map Act and City Ordina nces . 9. Documents concerning the maintenance of all com mon facilities and building exteriors s hall be submitted to the staff for approval as part of final map submi tted. 10. An offer of dedication for future street purposes for widening Park Drive and portions of Ma rina Drive at the inter- section to the ultimate width ~s required by the City Engineer shall be included on the final map. 11. Developer shall enter into ·a future improvement ag ree- ment for the construction of normal subdivision improvements~ including the widening of Park Drive adjacent to the development.
