BACKGROUND: This item was considered at the Planning Commission meeting of
April 10, 1973 and was tabled to permit the applicant to provide additional
ipformatiQn. Said information has been pr·ovided .. This matter was continued from

Oak Avenue, is located northerly of and adjacent to Oak Avenue, approximately
600 ft. easterly of the intersection of Pio Pico Drive and Oak Avenue. Said
property has a frontage on Oak Ave. of approximately 121.39 ft. and contains
0.55 acres. The subject site did have a residence on the site, but it was
removed. •
The site is relatively flat with three large euc~lyptus trees
being the only unique physical feature. The general area is predominately
single-fami"ly residential with a City fire station and County mica wave
installation located to the north of the subject parcel. The existing r'ight-
of-way of Oak Avenue is 80 ft. ·of which only 24 ft. of improvements presently
exists.
REQUEST: That the Planning Commission approve a Conditiona1 Use Permit to allow
the establishment of a Church facility on property located in the R-1-7500
(one-family residential) zone district. The applicant proposes to construct
an approximately 6,560 sq. ft. building with the indicated capacity ~f 120
persons. In addition, a parking area for a total of 20 cars is proposed.
Based upon a total of 120 fixed seats, this meets the Ordinance requirements
exactly.
ZON I MG MID GENERAL PLAN:
1. Zoning: On-Site -R-1-7500 (C.U.P.)
Adjacent -R-1-7500.
2. General Plan: The adopted General Plan indicates the property to be
potentia·1 lo\'J density residential with from 3-7 dwelling units to the acre. The
text of the General Plan indicates churches (institutional uses) to be appropriately
placed upon a minimu~ of l .5 acre sites and should be located on a secondary or
collector street which provides good access to the parts of the City or area
served.

ENVIRONMENTAL IMPACT CONSIDERATIONS: The Planning Director has determined that
this development will not have a significant environmental impact, and therefore,
no further environmental considerations are required to be made.
STAFF RECOMMENDATION: That the Planning Cammi ss ion find that:
l. The requested use is not necessary or desirable for the development
of the Community, is not essentially in harmony with the various elements and
objectives of the General Plan, and is detrimental to existing uses or to uses
specific.ally permitted in the zone in \•Jhich the proposed use is to be located.
2. The site is not adequate in size and shape to accommodate the use.
3 .. All of the yards, set~acks, walls, fences, landscaping and other
features necessary to adjust the requested use to existing or permitted uses in
the neighborhood will not be provided, therefore, the request should BE
DENIED .. Justification is based upon:
1. The size.of the lot 1s not believed to be sufficient to permit an
adequate development with provision for all the activities normally associated
with a church facility and still guarantee compatibility to existing and
proposed uses in the neighborhood.
2. The location of the proposed facility is considered an intrusion into
an existing neighborhood at such a point where it would be impossible to isolate
the proposed activities from the adjacent residential area. •
3. In terms of hours of operation, number of people, etc., a church
activity could not be integrated into the neighborhood.
4. ·Non-conformance to the standards adopted as a part of the General
Plan for institutional uses.
ATTACHED MATERIALS: Please find attached the following:
1. A letter in opposition.
2. A petition submitted to the Planning Commission on April 9, 1973 in
opposition to this request. • ~
CONDITIONS OF APPROVAL: Any approval should include the following:
l. The Conditional Use Permit is granted for the land as described in the
application and any attachments thereto, and as shown on the plot plan submitted
labeled Exhibit 11A11
• The location of all buildings, fences,, signs, roadviays,
parking areas, landscaping and other facilities or features shall be located sub-
stantially as shown on the plot plan labeled Exhibit "A", except or unless in-
dicated otherwise herein. •
2. Unless the construction of the structure or facility is commenced not
later than six months after the date the approval is granted and is diligently
pursued thereafter, 'this approval will automatically become null and void.
However, upon request, if the proposed pl-0t plan or adjacent areas are unchanged,
the Planning Director may appoint one additional six month extension of time.

3. Any minor change may be approved by the Planning · Dfrector. Any substantial
change vlill require the filing of an application for amendment to be considered
by the Planning Commission.
4. No signs or advertising of any type whatsoever shall be erected or install~d
until plans therefore have been approved by the CHy of. Carlsbad.
5. All areas shown as parking areas shall be surfaced with asphaltic concrete
and shall be visably marked outlining individual parking spaces and traffic
flow .. Said surfacing and marking shall be completed prior to final inspection
of the structure or structures by the Building Department. The surface shall be
kept in a reasonably good state of repair at all times.
S. Prior to obtaining a building permit and within 30 days hereof, the applicant
shall file \•Jith the Secretary of the Planning Commission written acceptance of
the conditions stated herein.
7. Compliance with and execution of all conditions listed hereon shall be
necessary prior to obtaining a final building inspection clearance. Deviation
from this requirement shall be pennitted only by written consent of the
Planning Director. •
8. Any mechanical and/or electrical equipment to be located on the roof of the
structure shall be screened in a manner acceptable to the Planning Director.
Detailed plans for said screening shall be submitted, in triplicate, to the
Planning Director.
9. All lighting shall be arranged to reflect away from adjoin1ng properties
and streets.
10. A detailed landscape and sprinkler plan prepared by a landscape architect,
shall be submitted to the Planning Director for consideration and approval.
11. Prior to final building inspection clearance, all landscaping shall be
installed. Said landscaping shall, at ~11 times, be maintained in a manner
acceptable to the Planning Director.
12. All landscape areas in parking lots shall be enclosed by a raised concrete
cufb or low wall. All planters adjacent to street right-of-way shall be con-
structed \-Jith weep holes per specifications of the City Engineer ..
13. This Conditional Use Permit is granted to the applicant only and is
not assignable to others.
14. All utilities, including electrical, telephone and television, shall be
installed underground and/or shall be completely concealed from view.
15. Oak Street shall be improved in acc6rdance with the specifications of the
City Engineer, or the permi.ttee sha 11 enter into a future agreement wtth the
City guaranteeing the construction of the improvements. •

16. Fire Fighting equipment as required and approved by the City Fire Department
shall be maintained on the premises at all times.
17. A 6 ft. high block wall shall be installed for the full length of the
north, east and west propertylines, except it shall be reduced to 3-5 ft. within
20 ft. of Oak Avenue.

I do not feel thst it is in the beB~ interest of myself
or other property owners in the immediate qrea to build
a Church in this vicinity. I purch~sod this home with the
thought of retiring in a quiet residential are9 such as this
area now affords. To have this residential area desecrated
by a Church or any other public building is unthinkable.
This is.now a quiet residential ares, Constructing a Church
will only serve to disrupt this. It, will result in noise,
p~rking ~nd traffic congestion and other congestion none of·
·v:hich ore -conducive to the public welfere. Surely in a city
es large as Carlsb9d there must be many other building sites
for a Church rcore suitable than the middle of a block in a
residential 1neo.
I first purch?.sed a home in C2i<lsbsd seven· and one-hslf' yeara
&go. Since then my family snd I have spent m:rny very enjoy-
,eble su~mers there. Now that my retirement is getting nearer
we ~re eagerly enticipating spendi~g more of our time in
your quiet relaxing corumunity. I hope you do .nothing to
di orupt our plans.
