GENERAL INFORMATION :
A. Request: The applicant is requesting approval of a tentative map for a
16 unit condominium development on Lot 1, Block Q, Palisades No. 2, Map 1803,
in the City of Carlsbad .
B. Background : The subject property ~containing approximately 0.85 acreshis
generally located north of and adjacent to Juniper Avenue between Garfield St .
and the A.T . & S.F. Railroad right-of-way. The subject parcel is within the
Garfield Specific Plan area and will have to comply to the requirements of the
Specific Plan.
C. Zoning and General Plan :
l. Zoning : Existing : R-3
Proposed : R-3
Adjacent : R-3
2. General Plan : Land Use Amendment No.l of the adopted Gener al Plan
designates the property to be potential 11 Low-Medium Density 11 residential
with from 0-30 dwelling units per net acre. The Applicant is proposing a
density of 18.8 d.u./acre .
D. Public Notification: No notifications are required for a tentative map
when adjoining properties have already been subdivided into sma ll urban lots.
E. Environmental Im2act Considerations :
The applicant has subm i tted an environmental impact assessment per City
requirements and the project has been declared to have a 11 non-significant11
impact on the environment and therefore no additional EIR considerations are
necessary . However, said property is within the Coasta l Zone and will require
consideration by the Coastal Commission .

II. CONSIDERATION OF TENTATIVE MAP NO. CT 73-30
A. Description of Project: The tentative map consists of a one-lot subdivision
with provisions for a total of 16 condominium units. All of the proposed units
are two-story, two-bedroom units. Each unit has a floor area of approximateJy
l ,400 sq. ft. There are four buildings with four units in each building . There
are 28 parking spaces (16 cover~d) provided on-site. There are no specific
recreation areas shown on the property, however, it should be noted that the ocean
is about 2 blocks· to the west and the developer will have to pay park-in-lieu
fees.
B. Staff Recommendation :· Staff recommends that the Planning Commission re-
commend to the City Council that Tentative Map No. 73-30 BE~APPROVED. Justification
is based upon:
l. Conformance of the tentative map to all requirements of the Carlsbad
Municipal Code and to the regulations of the State of California Subdivision Map
Act, as amended .
2. said map is in conformance with the adopted General Plan.
With regard to the Park Ordinance, it is recommended that the in-lieu fees be
required. Justification is based upon the fact that the subject property is not
of sufficient size to provide a large enough park that could be eff~ciently maintained.
C. Conditions of Approval: Any approval should be subject to the following
conditions :
l. All conditions as specified in Ordinance No. 9225 (Garfield Specific
Plan) shall be complied with , except that parking shall be provided to
conform to the existing Zoning Ordinance requirements, and no tandem spaces
shall be provided.
2. The development of the property described herein shall be subject to ,
the restrictions and limitations set forth herein which are in addition to all
the requirements, limitations and restrictions of all municipal ordinances
and State and Federal statutes now in force, or which, hereafter, may be
in force for the purpose of preserving the residential characteristics of
adjacent properties.
3. The developer shall establish and hereafter maintain a Homeowner 1s
Association for the purpose of maintainance of buildings, open space and
parking areas .
4. The C.C.&R 1 s for this development shall be submitted to the Planntng
Director for review and approval prior to the issuance of any building permits .
5. Park-In-Lieu fees shall be granted to the City prior to recording the
Final Map .
6. The Developer shall enter into a mutually acceptable agreement wi.tR
the Carlsbad School Distri ct to pro vi de for future school requirements that
will result from the proposed deve lopment .

7. In order to provide for reasonable fire protection during the con-
struction period, the subdivider shal l maintain passable vehicular access
to all buildings, and adequate fire hydrants with required fire flows shall
be installed as recommended by the Fire Department.
8. All public improvements shall be made in con formity to the City of
Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision
Ordinance and other City Standards to the satisfaction of the City Engineer
without cost to the Ci ty of Carlsbad , and free of all liens and encumbrances .
Improvement plans for water and sewer system shall meet the requirements
of the respective service districts.
9. All utilities, including provisions for cable TV, shall be placed
underground and/or shall be completely concealed from vi ew.
10 . All land and/or easements required by this Ordinance shal l be granted
to the City of Carlsbad without cost to the City, and free of a 11 liens
and encumbrances .
11. A detailed landscape and sprinkler plan prepared by a landscape
architect, shall be subm i tted to the Planning Director for consideration
and approval .
12. Pri or to final bui l di ng inspection clearance , all landscaping shall be
install ed . Landscaping shal l, at all times , be maintained in a manner
acceptable to the Planning Di rector.
13. All landscape areas in parking lots shall be enclosed by a raised
concrete curb or low wall . All planters adjacent to street right-of-way
shall be constructed with weep holes per specifications of the Ci ty Engineer.

BUILDING PERMIT. The following shall be grante d to the City of

SECTION 6. EFFECTIVE DATE. This Ordinance shall be affective

published once 1n the Carlsbad Journal within fifteen (15) days
1 after its adoption.

Gentlemen:
Reference: La Casa de la Playa
The Governing Board of the school district at a meeting held on June 2 5,
1973 reviewed the information presented by your department on June 6, 1973
concerning a real estate development known as La Casa de la Playa, which
will consist of approximately 16 condominium units.
As a result of this review, it is estimated from the number and types of
residences planned that the anticipated number of school age children ,
Kindergarten through 12th Grade, residing therein will be a total of 7 to
10 students.
The district does not have facilities to provide for a single-session
educational program for children who will be residing in this proposed
development. In addition, the district does not have any funds to provide
for facilities to house these children.
To date , no agreement has been reached with the subdivider to provide
financial assistance for school facilities which will be needed if and
when these residences are constructed. It is requested that approval of
this proposed residential development be withheld until a firm agreement
is reached between the developer and the Governing Board of the district
for provision of necessary school facilities.
It will be greatly cippreciated if copies of this letter are made available
to members of the City Council and the Planning Commission.
