EA 2025-0046 Kelly Drive Channel Emergency Repair (CIP No. 6606)
Thank you for submitting an Early Assessment for the Kelly Drive Channel Emergency Repair. The
submission includes a project proposal for repair of the existing concrete-lined stormwater channel to
prevent further damage and protect adjacent private property and natural areas from an embankment
slip failure. The existing wall of the western channel embankment has eroded to the point of concrete
failure wherein a void measuring approximately 117 cubic yards has opened behind the foundation wall.
Without repair, the void could expand with future rain events, potentially encroaching upon the adjacent
residential properties and natural areas. The Kelly Drive Channel has undergone multiple, similar repairs
in the last decade.
The proposed work will include the installation of stormwater best management practices, de-watering
the site, installation of concrete forms, and placement of cement slurry at the repair site. Work to repair
the concrete channel will commence following the installation of stormwater best management practices
and the de-watering of the channel. De-watering will include using a pump to discharge ponded water
from the open void, downstream onto the fully lined portion of the concrete channel. Crews will then
install forms to match the elevation and shape of the as-built structure wherein 4000 PSI shotcrete will be
pumped into the void. The project is not expected to require the excavation or removal of sensitive
vegetation.
The project will service the channel wall adjacent to the property located at 4866 Kelly Drive, APN 207-
230-27-00. The channel is on private property, but easements grant the city the right to access and
maintain the channel for drainage. The channel and project site are also immediately adjacent to private
residentia I properties. Authorization to access the project site via the adjacent private residence is
currently in progress. Previous repairs to the channel have been granted right of entry by the adjacent
residents. Staging and project access will be located along and within the fully lined concrete portion of
the channel, providing sufficient space for staging and site ingress and egress. Cement slurry will be
delivered to the repair site via a 4-inch concrete pump hose . The hose will be routed either through the
yard of 4866 Park Drive or up the fully lined concrete channel.
The proposed area of work and the channel are zoned R-1 (One Family Residential) and R-A-10000
(Residential Agricultural, minimum 10,000 square foot lot size) and have a General Plan land use
designation of R-4 (Residential 0-4 du/ac). The property is also located within the Coastal Zone (Mello II
segment), which applies the same land use and zoning designations.

In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose of an Early Assessment is to provide you with direction and comments on the overall concept
of your project. This Early Assessment does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in your submittal.
This review is based upon the plans, policies, and standards in effect as of the date of this review. Please
be aware that at the time of a formal application submittal, new plans, policies, and standards may be
in effect and additional issues of concern may be raised through a more specific and detailed review.
Planning
1. The project is located within the Coastal Zone. If the project can be determined exempt from the
California Environmental Quality Act (CEQA), the project will not be subject to the requirement to
file for a Coastal Development Permit (CDP). However, if the project has significant environmental
impacts, such as to wetlands, the project would be subject to a CDP as well as environmental
review.
California Public Resources Code Section 30610(d) states: "Repair or maintenance activities that
do not result in an addition to, or enlargement or expansion of, the object of those repair or
maintenance activities; provided, however, that if the commission determines that certain
extraordinary methods of repair and maintenance involve a risk of substantial adverse
environmental impact, it shall, by regulation, require that a permit be obtained pursuant to this
chapter."
As part of the project, please ensure the proper analysis, such as a one identifying potential
impacts to wetlands, is performed to determine the significance of any environmental impacts
and thus project permitting requirements. If a CDP is required, it will be issued by the city, subject
to appeal by the Coastal Commission.
2. This project will require authorization by the U.S. Army Corps of Engineers, Regional Water Quality
Control Board, and the California Department of Fish and Wildlife. These agencies must provide
the appropriate authorizations prior to the commencement of work on the property.
3. To access and complete work on private property, the city must obtain the appropriate Right of
Access documentation from all property owners whose properties will be accessed during the
repairs. These authorizations must be obtained prior to the commencement of work on the
property.
Habitat Management
4. Because this is an emergency project and resources that potentially could be impacted include
jurisdictional wetlands, any Habitat Management Plan requirements would be satisfied through
the requirements of the wetland permitting agencies.
5. In addition to the pre-project vegetation mapping already completed, please ensure the project
biologist also maps and documents the post-work condition to calculate the acres of impact. If
mitigation is required, depending on the amount, a potential source of credits is the North County
