Inc. for the Beach Access Repair and Upgrades from Pine Avenue to
Tamarack Avenue Project

Recommended Actions
Adopt a resolution accepting bids and awarding a contract to De La Fuente Construction, Inc.
for the Beach Access Repair and Upgrades from Pine Avenue to Tamarack Avenue Project for an
amount not to exceed $8,406,387.16.
Executive Summary
This project will replace the four upper seawall staircases along Carlsbad Boulevard and widen
the sidewalk on the west side of Carlsbad Boulevard between Pine Avenue and Cherry Avenue.
The sidewalks and stairways from the upper seawall to the lower seawall were built in the
1980s and are in urgent need of repair. In some places, concrete steps are crumbling, rusted
rebar is exposed, the steel railings are corroded and the pillars holding up the upper sidewalk
are deteriorating, with erosion along some of the foundations.
Staff request that the City Council accept the bids and award the construction contract for the
Beach Access Repair and Upgrades from Pine Avenue to Tamarack Avenue Project, Capital
Improvement Program Project No. 3896, to De La Fuente Construction, Inc., the lowest
responsive and responsible bidder, in an amount not to exceed $8,406,387.16.
Carlsbad Municipal Code Sections 3.28.080(C) and 3.28.080(I)(6), which cover purchasing in
construction contracts, require the City Council’s approval for all formally bid contracts when
the value exceeds $220,000, as this project does.
Explanation & Analysis
The City Council approved the project’s plans, specifications and contract documents; and
authorized advertising the project for construction bids on Nov. 19, 2024, with the adoption of

Resolution No. 2024-254. The project was then advertised using the city’s formal bidding
procedures.
Staff received eight bids for construction of the project on Feb. 20, 2025. Staff reviewed the
contract documents and found that De La Fuente Construction, Inc. was a responsible bidder,
with the lowest responsive bid in an amount of $8,406,387.16.
De La Fuente Construction, Inc. was found to be responsive because its bid met the
requirements of the bidding documents and responsible because it submitted a list of similar
projects to show its capability and qualification to perform the specified work.
The construction contract contains general performance standards and references technical
specifications, which if not met, allow the city to withhold payment. The contract also includes
a one-year warranty period from notice of completion.
Fiscal Analysis
Sufficient funds have already been appropriated for the project in prior years from the
Infrastructure Replacement and General Capital Construction funds. The available funds and
estimated costs for the project are shown in the following table:
Carlsbad Municipal Code sections 3.28.040(C)(5) and 3.28.090(B) authorize the City Manager or
designee to approve change orders in an amount equal to the contingency set at the time of
project award, which for this project is $1,681,300.
Environmental Evaluation
In keeping with the California Environmental Quality Act and the CEQA Guidelines, the Planning
Commission approved a mitigated negative declaration (State Clearinghouse No. 2023050505),
coastal development permit (CDP 2021-0011) and habitat management plan permit
(HMP 2021-0003) for this project on July 19, 2023.

Next Steps
Once the City Council accepts bids and awards the construction contract to De La Fuente
Construction, Inc., staff will issue a purchase order, schedule a pre-construction meeting with
De La Fuente Construction, Inc. and issue a notice to proceed for construction of the project.
The construction contract for the project provides for 20 months, excluding the summer
months between Memorial Day weekend and Labor Day weekend during which construction
would be paused, to complete the project improvements. Construction is expected to begin in
fall 2025 and be completed by late 2027.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT TO DE LA
FUENTE CONSTRUCTION, INC. FOR THE BEACH ACCESS REPAIR AND
UPGRADES FROM PINE AVENUE TO TAMARACK AVENUE PROJECT FOR AN
AMOUNT NOT TO EXCEED $8,406,387.16
WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary,
desirable and in the public interest to construct the Beach Access Repair and Upgrades from Pine
Avenue to Tamarack Avenue Project, Capital Improvement Program, or CIP, Project No. 3896, or
Project; and
WHEREAS, Carlsbad Municipal Code, or CMC, Sections 3.28.080(C) and 3.28.080(I)(6), which
govern purchasing in construction contracts, require the City Council to award all formally bid contracts
when the value exceeds $220,000; therefore, the Project is subject to this requirement; and
WHEREAS, on Nov. 19, 2024, the City Council adopted Resolution No. 2024-254, approving the
plans, specifications and contract documents and authorizing advertisement for construction bids for
the Project; and
WHEREAS, on Feb. 20, 2025, staff received eight bids for construction of the Project; and
WHEREAS, De La Fuente Construction, Inc. submitted the lowest responsive bid to construct
the Project, in an amount not to exceed $8,406,387.16, and is a responsible bidder; and
WHEREAS, CMC Sections 3.28.040(C)(5) and 3.28.090(B) authorize the City Manager or
designee to approve change orders in an amount equal to the contingency set at the time of project
award, which is $1,681,300 for the Project; and
WHEREAS, the Project funding sources include the Infrastructure Replacement and General
Capital Construction funds, and sufficient funding is available in the account for the CIP Project No.
3896, to complete the Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1.That the above recitations are true and correct.
2.That in accordance with the California Environmental Quality Act, or CEQA, and the
CEQA Guidelines, the Planning Commission approved a mitigated negative declaration

accepted, and the Mayor is authorized to execute the contract for the Project.
4.That the City Manager or designee is authorized to approve construction change orders
up to $1,681,300 for the Project.
5.That the City Manager or designee is authorized to sign all other documents necessary
for regulatory compliance, to extend funding opportunities, or to otherwise implement
and finalize the Project, all of which are subject to review and approval as to form by
the City Attorney’s office.
6.That the award of this contract is contingent upon De La Fuente Construction, Inc.
executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within 20 calendar days after adoption of this
Resolution. The City Manager may grant reasonable extensions of time to execute the
contract and assemble the required bonds and insurance policies.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 15th day of April, 2025, by the following vote, to wit:
AYES: Blackburn, Bhat-Patel, Acosta, Burkholder, Shin.
NAYS: None.
ABSTAIN: None.
