A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT TO DE LA
FUENTE CONSTRUCTION, INC. FOR THE BEACH ACCESS REPAIR AND
UPGRADES FROM PINE AVENUE TO TAMARACK AVENUE PROJECT FOR AN
AMOUNT NOT TO EXCEED $8,406,387.16
WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary,
desirable and in the public interest to construct the Beach Access Repair and Upgrades from Pine
Avenue to Tamarack Avenue Project, Capital Improvement Program, or CIP, Project No. 3896, or
Project; and
WHEREAS, Carlsbad Municipal Code, or CMC, Sections 3.28.080(C) and 3.28.080(I)(6), which
govern purchasing in construction contracts, require the City Council to award all formally bid contracts
when the value exceeds $220,000; therefore, the Project is subject to this requirement; and
WHEREAS, on Nov. 19, 2024, the City Council adopted Resolution No. 2024-254, approving the
plans, specifications and contract documents and authorizing advertisement for construction bids for
the Project; and
WHEREAS, on Feb. 20, 2025, staff received eight bids for construction of the Project; and
WHEREAS, De La Fuente Construction, Inc. submitted the lowest responsive bid to construct
the Project, in an amount not to exceed $8,406,387.16, and is a responsible bidder; and
WHEREAS, CMC Sections 3.28.040(C)(5) and 3.28.090(B) authorize the City Manager or
designee to approve change orders in an amount equal to the contingency set at the time of project
award, which is $1,681,300 for the Project; and
WHEREAS, the Project funding sources include the Infrastructure Replacement and General
Capital Construction funds, and sufficient funding is available in the account for the CIP Project No.
3896, to complete the Project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as
follows:
1.That the above recitations are true and correct.
2.That in accordance with the California Environmental Quality Act, or CEQA, and the
CEQA Guidelines, the Planning Commission approved a mitigated negative declaration

(State Clearinghouse No. 2023050505), Coastal Development Permit (CDP 2021-0011)
and Habitat Management Plan Permit (HMP 2021-0003) for this project on July 19, 2023.
3.That the lowest responsive bid of $8,406,387.16 submitted by De La Fuente
Construction, Inc., a responsible bidder, for construction of the Beach Access Repair and
Upgrades from Pine Avenue to Tamarack Avenue Project, CIP Project No. 3896, is
accepted, and the Mayor is authorized to execute the contract for the Project.
4.That the City Manager or designee is authorized to approve construction change orders
up to $1,681,300 for the Project.
5.That the City Manager or designee is authorized to sign all other documents necessary
for regulatory compliance, to extend funding opportunities, or to otherwise implement
and finalize the Project, all of which are subject to review and approval as to form by
the City Attorney’s office.
6.That the award of this contract is contingent upon De La Fuente Construction, Inc.
executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within 20 calendar days after adoption of this
Resolution. The City Manager may grant reasonable extensions of time to execute the
contract and assemble the required bonds and insurance policies.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of
Carlsbad on the 15th day of April, 2025, by the following vote, to wit:
AYES: Blackburn, Bhat-Patel, Acosta, Burkholder, Shin.
NAYS: None.
ABSTAIN: None.
ABSENT: None.
