CARLSBAD, COUNTY OF SAN DIEGO, STATE OF CALIFORNIA,
ACCORDING TO MAP THEREOF NO. 9935, FILED IN THE OFFICE OF
THE COUNTY RECORDER OF SAN DIEGO COUNTY, DECEMBER 16,
1980. PARCEL B: A NON-EXCLUSIVE EASEMENT ON AND OVER THE
"COMMON AREA" AS DEFINED IN THE DECLARATION OF
COVENANTS, CONDITIONS AND RESTRICTIONS TO WHICH
REFERENCE IS HEREAFTER MADE, FOR ACCESS, USE,
OCCUPANCY, ENJOYMENT, INGRESS AND EGRESS OF THE
AMENITIES LOCATED THEREON, SUBJECT TO THE TERMS AND
PROVISIONS OF THE DECLARATION OF COVENANTS, CONDITIONS
AND RESTRICTIONS TO WHICH REFERENCE IS HEREINAFTER
MADE. THIS EASEMENT IS APPURTENANT TO PARCEL 1 ABOVE
DESCRIBED
has been approved for an ACCESSORY DWELLING UNIT by the City of Carlsbad on April 3,
2025. Said approval restricts the property as follows:
1. The obligations and restrictions imposed on the ACCESSORY DWELLING UNIT
per California Government Code Section 65852.2 are binding on all present and future
property owners.
2. Pursuant to Section 21.10.030 of the City of Carlsbad Municipal Code, if the
ACCESSORY DWELLING UNIT is rented, a rental period of less than 30 days is

prior to January 1, 2020.
