SUBJECT: CDP 02-51 -EL CAMINO REAULA COSTA INTERSECTION IMPROVEMENT
The City has completed a review of the application for a Minor Coastal Development Permit for
development located at the intersection of El Camino Real and La Costa Avenue.
It is the Planning Director's determination that the project request for the installation of a
southbound right turn lane at the intersection of El Camino Real and La Costa Avenue, CDP
02-51, is consistent with the applicable City's Coastal Development Regulations (Chapters
21.201 -21.205) and with all other applicable City ordinances and policies. The Planning
Director, therefore, APPROVES this request based upon the following:
Findings:
1. That the total cost of the proposed development is less than $60,000 .based up on the
submitted cost estimate of $49,351.00.
2. That the proposed development requires no discretionary approvals other than a Minor
Coastal Development Permit.
3. That the development has no adverse effect individually or cumulatively on coastal
resources or public access to the shoreline or the coast, in that the site is a rough
graded portion of the right of way for El Camino Real and therefore possesses no
significant coastal resources. A sidewalk currently runs along the West side of El
Camino Real that will be moved 4 feet to the West, within the existing right of way, to
accommodate a right hand turning bay. Since the sidewalk is merely being relocated,
no impact to currently existing public access to the shoreline or coast will occur.
4. That the proposed development is in conformance with the Certified Local Coastal
Program and all applicable policies in that
A. The site is a rough graded portion of the existing right of way for El Camino Real and
therefore possesses no significant agriculture resources.
B. A biology study prepared by Helix Environmental Planning, October 29, 2002,
indicates that no sensitive habitats exist in the project area, therefore the project will
have no direct impacts to sensitive habitats and no significant indirect impacts

associated with noise and light are anticipated beyond what currently exists at the
site.
C. The project involves the relocation of the existing sidewalk along the west side of El
Camino Real to accommodate a left hand turn bay. The sidewalk will be moved four
feet to the west to accommodate the street improvement. Since the sidewalk is not
being removed and simply being relocated, no adverse impact to coastal access will
occur.
D. Since the site has been rough graded and only minor grading will be required to
accommodate the street improvements. The project is conditioned to provide
protective fencing and silt fencing to avoid potential erosion and runoff impacts
during project construction.
5. That the development is in conformity with the public access and public recreation
policies of Chapter 3 of the Coastal Act, in that the project does not adversely impact
public access to coastal areas and does not require recreation facilities.
6. That this request for a minor coastal development permit was adequately noticed at
least fifteen (15) working days before the date of this decision pursuant to Section
21.201.080(8) and (C) of the Carlsbad Coastal Development Regulations.
7. That the Planning Director has determined that the project is exempt from the
requirements of the California Environmental Quality Act (CEQA) per Section 15301 (C),
Existing Facilities, of the State CEQA Guidelines and will not have any adverse
significant impact on the environment.
Conditions:
1. The Planning Director does hereby APPROVE the Minor Coastal Development Permit,
CDP 02-51 for the project entitled "El Camino Real/La Costa Avenue Intersection
Improvement" (Exhibit " A ", dated January 8, 2003), on file in the Planning
Department and incorporated by this reference, subject to the conditions herein set
forth. Staff is authorized and directed to make, or require the Developer to make, all
corrections and modifications to the Minor Coastal Development Permit documents,
as necessary to make them internally consistent and in conformity with the final action
on the project. Development shall occur substantially as shown on the approved
Exhibits. Any proposed development substantially different from this approval, shall
require an amendment to this approval.
2. To ensure that construction impacts to Batiquitos Lagoon are avoided, protective
construction fencing shall be installed prior to the initiation of work on the project and
removed upon completion of work.
3. Silt fencing shall be installed at the edge of the construction site, to ensure that no silt
enters the lagoon during project construction.
4. No grading for public improvements shall occur outside the limits of existing right of way
unless Developer obtains, records and submits a recorded copy to the City Engineer a

grading or slope easement or agreement from the owners of the affected properties. If
Developer is unable to obtain the grading or slope easement, or agreement, the
developer must either apply for and obtain an amendment of this approval or modify the
plans so grading will not occur outside the project and apply for and obtain a finding of
substantial conformance from both the City Engineer and Planning Director.
5. Developer shall comply with the City's requirements of the National Pollutant Discharge
Elimination System (NPDES) permit. Developer shall provide improvements constructed
pursuant to best management practices as referenced in the "California Storm Water
Best Management Practices Handbook" to reduce surface pollutants to an acceptable
level prior to discharge to sensitive areas. Plans for such improvements shall be
submitted to and subject to the approval of the City Engineer. Said plans shall include
but not be limited to the following:
A. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other such
fluids shall not be discharged into any street, public or private, or into storm drain
or storm water conveyance systems. Use and disposal of pesticides, fungicides,
herbicides, insecticides, fertilizers and other such chemical treatments shall meet
Federal, State, County and City requirements as prescribed in their respective
containers.
B. Best Management Practices shall be used to eliminate or reduce surface
pollutants when planning any changes to the landscaping and surface
improvements.
