HomeMy WebLinkAbout2025-06-17; City Council; Resolution 2025-131Exhibit 1 RESOLUTION NO. 2025-131 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING A COMPLIANCE REPORT ON THE STATUS OF ALL STATE-MANDATED ANNUAL FIRE INSPECTIONS IN THE CITY OF CARLSBAD WHEREAS, California Health and Safety Code Sections 13146.2 and 13146.3 require all fire departments that provide fire protection services to perform annual inspections in every building used as a public or private school, hotel, motel, lodging house, apartment house and certain residential care facilities for compliance with building standards, as provided; and WHEREAS, California Health and Safety Code Section 13146.4 requires all fire departments that provide fire protection services to report annually to their administering authority on compliance with Sections 13146.2 and 13146.3; and WHEREAS, the City Council of the City of Carlsbad intends this resolution to fulfill the requirements of the California Health & Safety Code regarding acknowledgment of the Carlsbad Fire Department’s compliance with California Health and Safety Code Sections 13146.2 and 13146.3. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1.That the above recitations are true and correct. 2.The proposed action is not a “project” as defined by CEQA Section 21065 and CEQA Guidelines Section 15378(b)(5) and does not require environment review under CEQA Guidelines Section 15060(c)(3) and 15061(b)(3), because the proposed action to report on annual fire inspection compliance is an organizational or administrative government activity that does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. Any subsequent action or direction stemming from the proposed action may require the preparation of an environmental document in accordance with CEQA or the CEQA Guidelines. 3.That the City Council expressly acknowledges the measure of compliance of the Carlsbad Fire Department with California Health and Safety Code Sections 13146.2 and 13146.3 in the area encompassed by the City of Carlsbad, as follows: June 17, 2025 Item #6 Page 3 of 4 Docusign Envelope ID: 65601B2A-56C5-4803-A17A-39259DBB346F A.EDUCATIONAL GROUP E OCCUPANCIES: Educational Group E occupancies are generally those public and private schools, used by more than six persons at any one time for educational purposes through the 12th grade. There are 34 Group E occupancy campuses within the City of Carlsbad. During fiscal year 2024-25, the Carlsbad Fire Department completed the annual inspection of 34 Group E occupancies, with a total building count of 300 structures and/or facilities. This is a compliance rate of 100 percent for this reporting period. B.RESIDENTIAL GROUP R OCCUPANCIES: Residential Group R occupancies, for this resolution, are generally those occupancies containing sleeping units and include hotels, motels, apartments (three units or more), and other residential occupancies. There are 2,360 Group R (and their associated sub-categories) occupancies within the City of Carlsbad. During fiscal year 2024-25, the Carlsbad Fire Department completed the annual inspection of 2,360 Group R occupancies, buildings, structures and facilities. This is a compliance rate of 100 percent for this reporting period. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 17th day of June, 2025, by the following vote, to wit: AYES: Blackburn, Bhat-Patel, Acosta, Burkholder, Shin. NAYS: None. ABSTAIN: None.
