HomeMy WebLinkAbout2025-06-17; City Council; Resolution 2025-142Exhibit 12 RESOLUTION NO. 2025-142 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DETERMINING THAT THE FISCAL YEAR 2025-26 CAPITAL IMPROVEMENT PROGRAM IS CONSISTENT WITH THE GENERAL PLAN AND APPLICABLE CLIMATE ACTION PLAN MEASURES AND ACTIONS WHEREAS, the City Council of the City of Carlsbad, California, has reviewed the Capital Improvement Program for FY 2025-26 and has held such public hearings as are necessary prior to adoption of the Capital Improvement Program; and WHEREAS, on June 17, 2025, the City Council reviewed for consistency with the General Plan goals and policies all Capital projects receiving an allocation of funds for FY 2025-26 pursuant to Carlsbad Municipal Code Section 2.24.040(B); and WHEREAS, the City Council also reviewed the FY 2025-26 Capital Improvement Program projects for consistency with applicable Climate Action Plan measures and actions; and WHEREAS, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, the City Council considered all factors relating to the City Council determination. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1.That the above recitations are true and correct. 2.The proposed action is not a “project” as defined by CEQA Section 21065 and CEQA Guidelines Section 15378(b)(4) and does not require environmental review under CEQA Guidelines Section 15060(c)(3) as it is a government fiscal activity and does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. 3.That based on the evidence presented at the hearing, the City Council determines that the Capital Improvement Program for FY 2025-26 is consistent with the General Plan based on the following findings: June 17, 2025 Item #14 Page 448 of 634 Docusign Envelope ID: D70A8178-1B2E-430B-BA45-CBB16FF52A23 a.The projects are consistent with the goals and policies of the city’s General Plan in that the projects are required to ensure the provision of adequate public facilities and services concurrent with or prior to need. b.The projects are consistent with applicable goals and policies of the Arts, History, Culture, and Education; Land Use and Community Design; Mobility; Public Safety; and Sustainability Elements, as described in Attachment A. c.Specific projects are consistent with, and support Climate Action Plan greenhouse gas reduction measures and actions, if applicable, as described in Attachment A. d.As required by the General Plan, the proposed improvements are consistent with the city’s Growth Management Plan in that the projects ensure that the necessary improvements are provided for facilities maintenance, park development, recycled water, sewer and storm drain projects, and circulation systems, in accordance with the performance standards contained in the city’s Growth Management regulations. 4.This action is final as of the date this resolution is adopted by the City Council. The Provisions of Chapter 1.16 of the Carlsbad Municipal Code, “Time Limits for Judicial Review” shall apply: “NOTICE” The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other action seeking review must be filed in the appropriate court not later than the ninetieth day following the date on which this decision becomes final; however, if within ten days after the decision becomes final a request for the record is filed with a deposit in an amount sufficient to cover the estimated cost or preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one. A written request for the preparation of the record of the proceedings shall be filed with the City Clerk, City of Carlsbad, 1200 Carlsbad Village Drive, Carlsbad, CA 92008. Project Need This project is needed for compliance with ADA requirements and the California Vehicle Code. General Plan Consistency Goal 3-G.1 of the Mobility Element: Keep Carlsbad moving with livable streets that provide a safe, balanced, cost-effective, multi-modal transportation system (vehicles, pedestrians, bikes, transit), accommodating the mobility needs of all community members, including children, the elderly and the disabled. Climate Action Plan Consistency Not applicable. Anticipated Environmental Review The proposed action for construction of minor modifications to existing parking stalls to improve accessibility and comply with ADA standards is categorically exempt from environmental review under CEQA Guidelines Section 15301 because it involves the maintenance, repair or minor alteration of existing facilities with negligible or no expansion of the existing or former use. No exceptions to the categorical exemption as set forth in CEQA Guidelines Section 15300.2 or Carlsbad Municipal Code Section 19.04.070(C) apply. Project Need Carlsbad engineering standards require sewer lift stations to have dual forcemains. The Cannon Lift Station currently only has one forcemain and requires an additional outfall to fulfill the operational redundancy requirements of the engineering standards. General Plan Consistency Goal 2-G.21 Ensure that adequate public facilities and services are provided in a timely manner to preserve the quality of life of residents. Climate Action Plan Consistency This project is consistent with Measure W-1, Wastewater System Improvements. Anticipated Environmental Review The level of environmental review and any potential environmental impacts will be determined upon further analysis. It is likely environmental review could range from a CEQA exemption (project is exempt from environmental review) to a Mitigated Negative Declaration (project has environmental impacts that can be mitigated). The last major renovations to playgrounds took place nearly 20 years ago. Project Need The city's community parks are highly used facilities and several of the playgrounds within these parks are near the end of their useful life. Proposed upgrades will provide additional play value, capacity and contemporary features. General Plan Consistency Goal 4-G.6 of the Open Space, Conservation and Recreation Element: Offer a wide variety of recreational activities and park facilities designed to encourage educational benefits and active or passive participation by users of all ages and interests Climate Action Plan Consistency Not applicable. Anticipated Environmental Review The proposed action for construction of replacements and upgrades to existing playground equipment and surfaces at community parks is categorically exempt from environmental review under CEQA Guidelines Section 15301 because it involves the maintenance, repair or minor alteration of existing facilities with negligible or no expansion of the existing or former use. No exceptions to the categorical exemption as set forth in CEQA Guidelines Section 15300.2 or Carlsbad Municipal Code Section 19.04.070(C) apply. Part of this project will seek water conservation grants and rebates from applicable authorities. Project Need This project will help ensure that the City of Carlsbad complies with AB1572, signed into law on Oct. 13, 2023. This law prohibits public agencies, restaurants, corporate campuses, industrial parks and certain other property owners from watering “nonfunctional turf” using potable water. The deadline for compliance for properties owned by local government agencies is Jan. 1, 2027. General Plan Consistency Goal 4-G.6 of the Open Space, Conservation and Recreation Element: Offer a wide variety of recreational activities and park facilities designed to encourage educational benefits and active or passive participation by users of all ages and interests. Climate Action Plan Consistency This project is consistent with Measure W-2, Water System Improvements. Anticipated Environmental Review The proposed action for construction of conversion of ornamental turf to water-wise landscaping at existing city facilities is categorically exempt from environmental review under CEQA Guidelines Section 15301 because it involves the maintenance, repair or minor alteration of existing facilities with negligible or no expansion of the existing or former use. No exceptions to the categorical exemption as set forth in CEQA Guidelines Section 15300.2 or Carlsbad Municipal Code Section 19.04.070(C) apply. Develop constraints and opportunities list of city buildings in support of the Climate Action Plan Measures E-1, E-3.1 and E-3.2. Project Need The project is needed to achieve compliance with NFPA and Climate Action Plan requirements. General Plan Consistency Goal 6-G.1 of the Public Safety Element: Minimize injury, loss of life and damage to property resulting from fire, flood, sea-level rise, hazardous material release or seismic disasters. Climate Action Plan Consistency This project is consistent with Measure E-1, Renewable Electricity at Municipal Facilities, Measure E-3.1, Nonresidential Building Energy – Existing Reach Code and Measure E-3.2, Nonresidential Building Energy – Solar Carports. Anticipated Environmental Review The proposed action to conduct arc flash hazard evaluations and related electrical safety inspections at municipal facilities is statutorily exempt from environmental review under CEQA Guidelines Section 15262, as it involves only feasibility or planning studies, including consideration of environmental factors, for possible future actions that have not been approved, adopted or funded. The proposed action does not have a legally binding effect on any possible future discretionary action. Project Need Improvements are needed to replace and rehabilitate pumps to increase hydraulic efficiency for the station and the recycled water system. General Plan Consistency Goal 2-G.21 of the Land Use & Community Design Element: Ensure that adequate public facilities and services are provided in a timely manner to preserve the quality of life of residents. Climate Action Plan Consistency This project is consistent with Measure W-2, Water System Improvements. Anticipated Environmental Review The proposed action for construction of recycled water pump replacements and associated improvements at the existing D-Site facility is categorically exempt from environmental review under CEQA Guidelines Section 15301 because it involves the maintenance, repair or minor alteration of existing facilities with negligible or no expansion of the existing or former use. No exceptions to the categorical exemption as set forth in CEQA Guidelines Section 15300.2 or Carlsbad Municipal Code Section 19.04.070(C) apply. Project Need Lift station upgrades are needed to accommodate anticipated development expansion in the Village and Barrio Master Plan area in accordance with current city standards. General Plan Consistency Policy 6-P.73 of the Public Safety Element: Ensure all new development complies with all applicable regulations regarding the provision of public utilities and facilities. Climate Action Plan Consistency This project is consistent with Measure W-1, Wastewater System Improvements. Anticipated Environmental Review The level of environmental review and any potential environmental impacts will be determined upon further analysis. It is likely environmental review could range from a CEQA exemption (project is exempt from environmental review) to a Mitigated Negative Declaration (project has environmental impacts that can be mitigated). TOTAL $1,500,000 About This Project Reimbursement funds for required public sewer improvements resulting from Jefferson Street development projects, to be installed by the developer. Project Need Following entitlement of the Jefferson Street Homes project—one of three active or planned developments along this corridor—this standalone capital project was established to provide necessary the offsite sewer upgrades along Jefferson Street between Buena Vista Way and Laguna Drive to serve the project(s). Approval conditions for Jefferson Street project includes an option for the developer, rather than the city, to complete public sewer improvements to increase capacity downstream of project. This funding will be used to either: 1) reimburse the developer for their direct costs to complete the sewer improvements or 2) fund additional design and environmental analysis for the city to complete the improvements at a later date. General Plan Consistency Goal 2-G.21 of the Land Use & Community Design Element: Ensure that adequate public facilities and services are provided in a timely manner to preserve the quality of life of residents. Climate Action Plan Consistency This project is consistent with Measure W-1, Wastewater System Improvements. Anticipated Environmental Review The level of environmental review will be determined based on whether the project is implemented by the developer or city as the two options detail below: • Option 1: Should the developer proceed with the installation of the sewer improvement, reimbursement of funds would not be a “project” as defined by CEQA Section 21065 and CEQA Guidelines Section 15378(a) and does not require environmental review under CEQA Guidelines Section 15060(c)(2) because the action is limited to the financial reimbursement of sewer improvement costs already subject to separate CEQA review and approval assuming developer completion of the required sewer improvements. It is likely environmental review could range from a CEQA exemption (project is exempt from environmental review) to a Mitigated Negative Declaration (project has environmental impacts that can be mitigated). Project Need The current elements of the Learning Center were constructed approximately 20 years ago and no longer function optimally for current operations. General Plan Consistency Policy 7-P.24 of the Arts, History, Culture and Education Element: Provide adequate library facilities and programs that align with the community’s learning needs, abilities and demographics and changes in technology, such as through facility design, services and service delivery methods and partnerships with educational and learning institutions. Climate Action Plan Consistency Not applicable. Anticipated Environmental Review The proposed action for renovation and remodeling of portions of the first floor of the Library Learning Center is categorically exempt from environmental review under CEQA Guidelines Section 15301 because it involves the maintenance, repair and minor alteration of existing public facilities with negligible or no expansion of the existing or former use. No exceptions to the categorical exemption as set forth in CEQA Guidelines Section 15300.2 or Carlsbad Municipal Code Section 19.04.070(C) apply. Project Need There has been an identified increase in the population within this park district. The project will include an evaluation of the offerings within these older parks in relation to the needs of a growing multi- generational area. General Plan Consistency Goal 4-G.6 of the Open Space, Conservation and Recreation Element: Offer a wide variety of recreational activities and park facilities designed to encourage educational benefits and active or passive participation by users of all ages and interests. Climate Action Plan Consistency Not applicable. Anticipated Environmental Review The level of environmental review and any potential environmental impacts will be determined upon further analysis. Phase 1 of the project will install a docking station so a rental generator could be deployed if needed. Phase 2 will install a permanent fixed generator. Project Need The emergency backup generator will allow for continuity of operations during grid power outages. General Plan Consistency Goal 2-G.3 of the Public Safety Element: Maintain safety services that are responsive to citizens’ needs to ensure a safe and secure environment for people and property in the community. Climate Action Plan Consistency Not applicable. Anticipated Environmental Review The proposed action for construction of an emergency backup generator and associated docking station is categorically exempt from environmental review under CEQA Guidelines Section 15303(d) because it involves the installation of small new equipment in small structures, with only minor exterior modifications. No exceptions to the categorical exemption as set forth in CEQA Guidelines Section 15300.2 or Carlsbad Municipal Code Section 19.04.070(C) apply.
